§3.3.1ἀφικομένων δὲ τῶν πρεσβευτῶν εἰς Ῥώμην ὑποπτεύσας ὁ Τύλλος, ὅτι δίκας αἰτήσοντες ἥκοιεν, αὐτὸς τοῦτο ποιῆσαι πρότερος ἔγνω περιστῆσαι βουλόμενος εἰς ἐκείνους τὴν αἰτίαν τοῦ λύειν τὰ πρὸς τὴν ἀποικίαν συγκείμενα.
When the envoys arrived in Rome, Tullus, suspecting that they had come to demand satisfaction, resolved to be the first to do this himself, wishing to shift onto them the blame for breaking the agreements made with the colony.
συνθῆκαι γὰρ ἦσαν ταῖς πόλεσιν ἐπὶ Ῥωμύλου γενόμεναι τά τε ἄλλα ἔχουσαι δίκαια καὶ ἵνα μηδετέρα πολέμου ἄρχῃ· ἡ δʼ ἐγκαλοῦσα ὅ τι δή ποτε ἀδίκημα δίκας αἰτοῖ παρὰ τῆς ἀδικούσης, εἰ δὲ μὴ τυγχάνοι τότε τὸν ἐξ ἀνάγκης ἐπιφέροι πόλεμον, ὡς λελυμένων ἤδη τῶν σπονδῶν.
For there was a treaty between the cities made in the time of Romulus, which, besides other provisions, ordained that neither side should begin war; and that the city making an accusation for any injury whatsoever should demand satisfaction from the offending party, and if it did not obtain it, should then bring upon them an unavoidable war, as the treaty had already been dissolved.
§3.3.2φυλαττόμενος δὲ τὸ μὴ προτέρους αἰτηθέντας δίκας Ῥωμαίους ἀντειπεῖν, ἔπειτα ὑπαιτίους Ἀλβανοῖς γενέσθαι, προσέταξε τοῖς ἐπιφανεστάτοις τῶν ἑαυτοῦ φίλων τοὺς Ἀλβανῶν πρέσβεις ξενίζειν ἁπάσῃ φιλοφροσύνῃ καὶ κατέχειν ἔνδον παρʼ ἑαυτοῖς· αὐτὸς δʼ ἐν ἀσχολίαις εἶναι τισὶν ἀναγκαίοις σκηψάμενος διεκρούσατο §3.3.3τὴν πρόσοδον αὐτῶν.
But, guarding against the Romans refusing after having been asked first for satisfaction, and thereby becoming liable to blame by the Albans, he ordered the most distinguished of his friends to entertain the Alban envoys with all hospitality and keep them at their own houses; while he himself, pretending to be occupied with certain necessary business, avoided an audience with them.
τῇ δʼ ἔγγιστα νυκτὶ Ῥωμαίων ἄνδρας ἐπιφανεῖς ἐντειλάμενος αὐτοῖς ἃ χρὴ πράττειν ἀπέστειλεν εἰς Ἄλβαν ἅμα τοῖς εἰρηνοδίκαις αἰτήσοντας ὑπὲρ ὧν ἠδίκηντο Ῥωμαῖοι δίκας παρʼ Ἀλβανῶν λαβεῖν, οἳ πρὶν ἥλιον ἀνίσχειν διανύσαντες τὴν ὁδὸν πληθυούσης τῆς ἑωθινῆς ἀγορᾶς ἐντυγχάνουσι τῷ Κλοιλίῳ κατʼ ἀγορὰν ὄντι καὶ διεξιόντες ὅσα ἠδίκηντο Ῥωμαῖοι πρὸς Ἀλβανῶν ἠξίουν πράττειν τὰ συγκείμενα ταῖς πόλεσιν.
And on the very next night, having instructed prominent Roman men as to what they must do, he sent them to Alba together with the fetial priests to demand satisfaction from the Albans for the injuries the Romans had suffered. These men, having completed their journey before sunrise, met Cluilius in the marketplace when the morning market was full, and detailing all the injuries the Romans had suffered at the hands of the Albans, they demanded that they act according to the agreements between the cities.
§3.3.4ὁ δὲ Κλοίλιος, ὡς Ἀλβανῶν προτέρων ἀπεσταλκότων εἰς Ῥώμην τοὺς αἰτήσοντας δίκας καὶ μηδὲ ἀποκρίσεως ἠξιωμένων, ἀπιέναι τοὺς Ῥωμαίους ἐκέλευσεν ως παραβεβηκότας τὰς ὁμολογίας καὶ προεῖπεν αὐτοῖς τὸν πόλεμον.
But Cluilius, on the ground that the Albans had sent envoys first to Rome to demand satisfaction and had not even been deemed worthy of an answer, ordered the Romans to depart as violators of the agreements and declared war on them.
ἀπαλλαττόμενος δὲ ὁ τῆς πρεσβείας ἡγεμὼν τοῦτʼ ἠξίωσεν ἀκοῦσαι παρʼ αὐτοῦ μόνον, εἰ παραβαίνειν τὰς σπονδὰς ὁμολογεῖ τοὺς προτέρους αἰτηθέντας δίκας καὶ μηδὲν ὑπομείναντας ποιεῖν τῶν ὁσίων.
And as he was departing, the leader of the embassy asked to hear only this from him, whether he agreed that those who, having been asked first for satisfaction, perform none of their sacred duties, are the ones who violate the treaty.
§3.3.5ὁμολογήσαντος δὲ τοῦ Κλοιλίου, μαρτύρομαι τοίνυν, ἔφη, τοὺς θεούς, οὓς ἐποιησάμεθα τῶν σπονδῶν μάρτυρας, ὅτι Ῥωμαίοις οὐ τυχοῦσι τῶν δικαίων προτέροις ὅσιος ὁ κατὰ τῶν παραβάντων τὰς σπονδὰς πόλεμος ἔσται, οἱ δὲ πεφευγότες τοῦτο τὸ δίκαιον ὑμεῖς ἐστε, ὡς αὐτὰ τὰ ἔργα δηλοῖ.
When Cluilius agreed, he said, "I call to witness, then, the gods whom we made witnesses of our treaty, that to the Romans, who were the first to ask for satisfaction and did not obtain it, the war against those who have broken the treaty will be sacred; and you are the ones who have fled from this justice, as the facts themselves show.
πρότεροί τε γὰρ αἰτηθέντες τὸ δίκαιον οὐχ ὑπέσχετε καὶ πρότερον τὸν πόλεμον ἡμῖν προειρήκατε.
For, having been asked first for satisfaction, you did not grant it, and you have first declared war on us.
τοιγάρτοι τοὺς ἀμυνουμένους ὑμᾶς προσδέχεσθε μετὰ τῶν ὅπλων οὐκ εἰς μακράν. §3.3.6ταῦτα παρὰ τῶν πρεσβευτῶν ἀφικομένων εἰς Ῥώμην ἀκούσας ὁ Τύλλος, τότε τοὺς Ἀλβανοὺς προσάγειν ἐκέλευσε καὶ περὶ ὧν ἥκουσι λέγειν.
Therefore, expect those who will defend themselves to meet you with arms before long." When Tullus heard these things from the envoys upon their return to Rome, he then ordered the Albans to be brought before him and to speak of the matters for which they had come.
ἀπαγγειλάντων δʼ αὐτῶν ὅσα προσέταξεν ὁ Κλοίλιος καὶ τὸν πόλεμον ἀπειλούντων εἰ μὴ τεύξονται τῆς δίκης, Ἐγὼ πρότερος ὑμῶν, ἔφη, τοῦτο πεποίηκα καὶ μηδὲν εὑρόμενος ὧν ἐκέλευον αἱ συνθῆκαι. . .
And when they had reported all that Cluilius had commanded and threatened war if they did not obtain satisfaction, he said, "I have done this before you, and having obtained none of the things which the treaty ordained...
τὸν ἀναγκαῖόν τε καὶ δίκαιον Ἀλβανοῖς παραγγέλλω πόλεμον.
I declare to the Albans an unavoidable and just war."
