§10.32.1μετὰ τοῦτο τὸ ἔργον συναχθείσης τῆς βουλῆς οἱ μὲν ὕπατοι κατηγορίαν πολλὴν τῶν δημάρχων ἐποιήσαντο·
After this action, when the senate had been assembled, the consuls made a heavy accusation against the tribunes.
παραλαβὼν δὲ τὸν λόγον ὁ Ἰκίλλιος περί τε τῆς εἰς τὸν ὑπηρέτην ὀργῆς ἀπελογεῖτο τοὺς ἱεροὺς προφερόμενος νόμους, καθʼ οὓς οὔτε ἄρχοντι οὔτʼ ἰδιώτῃ συνεχωρεῖτο πράττειν οὐδὲν ἐναντίον δημάρχῳ, καὶ περὶ τοῦ συγκαλεῖν τὴν βουλὴν ἐδίδασκεν, ὡς οὐθὲν εἴη πεποιηκὼς ἄτοπον, πολλοὺς καὶ §10.32.2παντοδαποὺς εἰς τοῦτο παρασκευασάμενος λόγους.
But Icilius, taking the floor, defended himself regarding the anger against the attendant, bringing forward the sacred laws, according to which it was permitted neither to a magistrate nor to a private citizen to do anything contrary to a tribune; and concerning the calling of the senate, he argued that he had done nothing out of the way, having prepared many and various arguments for this purpose.
ὡς δʼ ἀπελύσατο ταύτας τὰς κατηγορίας, τὸν ὑπὲρ τοῦ λόφου νόμον εἰσέφερεν.
And when he had cleared himself of these accusations, he introduced the law concerning the hill.
ἦν δὲ τοιόσδε· ὅσα μὲν ἰδιῶταί τινες εἶχον ἐκ τοῦ δικαίου κτησάμενοι, ταῦτα τοὺς κυρίους κατέχειν· ὅσα δὲ βιασάμενοί τινες ἢ κλοπῇ λαβόντες ᾠκοδομήσαντο, κομισαμένους τὰς δαπάνας, ἃς ἂν οἱ διαιτηταὶ γνῶσι, τῷ δήμῳ παραδιδόναι· τὰ δὲ ἄλλα, ὅσα ἦν δημόσια, χωρὶς ὠνῆς τὸν δῆμον παραλαβόντα διελέσθαι.
It was as follows: whatever parts some private individuals held, having acquired them justly, these the owners should retain; but whatever parts some had built upon by force or having taken by theft, they should surrender to the people, after recovering the expenses which the arbitrators should decide; and the rest, whatever was public land, the people, taking it over without purchase, should divide among themselves.
§10.32.3ἐδίδασκέ τε, ὅτι τοῦτο τὸ πολίτευμα εἰς πολλὰ μὲν καὶ ἄλλα συνοίσει τῇ πόλει, μάλιστα δὲ εἰς τὸ μὴ στασιάζειν ἔτι περὶ τῆς δημοσίας χώρας τοὺς πένητας, ἣν οἱ πατρίκιοι κατεῖχον.
And he explained that this measure would be of advantage to the city in many other ways, but especially in that the poor would no longer riot concerning the public land which the patricians held.
ἀγαπήσειν γὰρ αὐτοὺς τῆς πόλεως λαχόντας μέρος, ἐπειδὴ τῆς χώρας οὐκ ἔξεστι διὰ τοὺς ἐσφετερισμένους αὐτὴν πολλοὺς ὄντας καὶ δυνατούς.
For they would be content with having obtained a share of the city, since obtaining a share of the country was not possible because of those who had usurped it, who were many and powerful.
§10.32.4τοιούτων ῥηθέντων ὑπʼ αὐτοῦ λόγων ὁ μὲν ἀντιλέγων Γάιος Κλαύδιος ἦν μόνος, οἱ δὲ συγκαταινοῦντες πολλοί, καὶ ἔδοξε διδόναι τῷ δήμῳ τὸν τόπον.
After such words had been spoken by him, Gaius Claudius was the only one who spoke against it, but those who assented were many, and it was resolved to give the place to the people.
μετὰ τοῦτο ἱεροφαντῶν τε παρόντων καὶ οἰωνοσκόπων καὶ ἱεροποιῶν δυεῖν καὶ ποιησαμένων τὰς νομίμους εὐχάς τε καὶ ἀρὰς ἐν τῇ λοχίτιδι ἐκκλησίᾳ συναχθείσῃ ὑπὸ τῶν ὑπάτων ὁ νόμος ἐκυρώθη, ὅς ἐστιν ἐν στήλῃ χαλκῇ γεγραμμένος, ἣν ἀνέθεσαν ἐν τῷ Αὐεντίνῳ §10.32.5κομίσαντες εἰς τὸ τῆς Ἀρτέμιδος ἱερόν.
After this, in the presence of the pontiffs, augurs, and two commissioners of sacrifices, who offered the customary prayers and curses, the law was ratified in the centuriate assembly convoked by the consuls; which law is written on a bronze pillar, which they set up on the Aventine, having carried it into the temple of Diana.
κυρωθέντος δὲ τοῦ νόμου συνελθόντες οἱ δημοτικοὶ τά τε οἰκόπεδα διελάγχανον καὶ κατῳκοδόμουν ὅσον ἕκαστοι τόπον δυνηθεῖεν ἀπολαμβάνοντες.
And when the law was ratified, the plebeians came together and drew lots for the building sites, and built upon them, each receiving as much space as they were able to build on.
εἰσὶ δʼ οἳ σύνδυο καὶ σύντρεις καὶ ἔτι πλείους συνιόντες οἰκίαν κατεσκευάζοντο μίαν ἑτέρων μὲν τὰ κατάγεια λαγχανόντων, ἑτέρων δὲ τὰ ὑπερῷα.
And there were some who, coming together by twos and threes and even more, built a single house, some obtaining by lot the ground floors, others the upper stories.
ὁ μὲν οὖν ἐνιαυτὸς ἐκεῖνος εἰς τὰς κατασκευὰς τῶν οἰκήσεων ἐδαπανήθη.
That year, therefore, was spent on the construction of the dwellings.
