§8.849ΑΘ. τῶν δὲ ἐν ἄστει κατὰ τὰ αὐτὰ ἐπιμεληθῆναι καὶ ἐπιμελεῖσθαι τὴν τῶν ἀστυνόμων ἀρχήν.
ATH. Regarding the same matters in the city, the office of the city-stewards has been and shall be in charge.
τοῖς δὲ δὴ ἀγορανόμοις τὰ περὶ ἀγοράν που δεῖ ἕκαστα μέλειν· ἡ δʼ ἐπιμέλεια, μετὰ τὴν τῶν ἱερῶν ἐπίσκεψιν τῶν κατʼ ἀγορὰν μή τις ἀδικῇ τι, τῆς τῶν ἀνθρώπων χρείας τὸ δεύτερον ἂν εἴη, σωφροσύνης τε καὶ ὕβρεως ἐπισκόπους ὄντας κολάζειν τὸν δεόμενον κολάσεως.
And to the market-stewards indeed, each of the matters concerning the market must be a care; and this care, after the inspection of the temples in the market lest anyone commit any injustice, would be secondarily that of the need of men, being inspectors of temperance and insolence to punish whoever needs punishment.
τῶν δὲ ὠνίων, πρῶτον μὲν τὰ περὶ τοὺς ξένους ταχθέντα πωλεῖν τοῖς ἀστοῖς σκοπεῖν εἰ γίγνεται κατὰ τὸν νόμον ἕκαστα.
And of the things for sale, first, they must inspect the things appointed to be sold to the citizens for the sake of the strangers, whether each takes place according to the law.
νόμος δʼ ἑκάστῳ μηνὸς τῇ νέᾳ ὧν δεῖ πραθῆναι τὸ μέρος τοῖς ξένοις ἐξάγειν τοὺς ἐπιτρόπους, ὅσοι τοῖς ἀστοῖς ξένοι ἢ καὶ δοῦλοι ἐπιτροπεύουσι, δωδεκατημόριον πρῶτον τοῦ σίτου, τὸν δὲ ξένον εἰς πάντα τὸν μῆνα ὠνεῖσθαι σῖτον μὲν καὶ ὅσα περὶ σῖτον ἀγορᾷ τῇ πρώτῃ· δεκάτῃ δὲ τοῦ μηνὸς τὴν τῶν ὑγρῶν οἱ μὲν πρᾶσιν, οἱ δὲ ὠνὴν ποιείσθωσαν διʼ ὅλου τοῦ μηνὸς ἱκανήν· τρίτῃ δὲ εἰκάδι τῶν ζῴων ἔστω πρᾶσις, ὅσα πρατέα ἑκάστοις ἢ ὠνητέα αὐτοῖς δεομένοις, καὶ ὁπόσων σκευῶν ἢ χρημάτων γεωργοῖς μὲν πρᾶσις, οἷον δερμάτων ἢ καὶ πάσης ἐσθῆτος ἢ πλοκῆς ἢ πιλήσεως ἤ τινων ἄλλων τοιούτων, ξένοις δὲ ἀναγκαῖον ὠνεῖσθαι παρʼ ἄλλων κτωμένοις.
And let the law be: on the new moon of each month, the managers—as many as manage for the citizens, whether strangers or even slaves—must bring out the portion of those things that must be sold to the strangers, first a twelfth part of the grain; and let the stranger buy grain and as much as concerns grain for the whole month on the first market; and on the tenth of the month, let some make sale, and others purchase, of liquids sufficient for the whole month; and on the twenty-third let there be a sale of animals, as many as must be sold by each or bought by those who need them, and of as many utensils or goods as are for sale by the farmers—such as skins or any clothing, woven or felted, or any other such things—and which it is necessary for the strangers to buy, acquiring them from others.
καπηλείας δὲ τούτων ἢ κριθῶν ἢ πυρῶν εἰς ἄλφιτα νεμηθέντων, ἢ καὶ τὴν ἄλλην σύμπασαν τροφήν, ἀστοῖς μὲν καὶ τούτων δούλοις μήτε τις πωλείτω μήτε ὠνείσθω παρὰ τοιούτου μηδεὶς μηδενός, ἐν δὲ ταῖς τῶν ξένων ξένος ἀγοραῖς πωλείτω τοῖς δημιουργοῖς τε καὶ τούτων δούλοις, οἴνου τε μεταβαλλόμενος καὶ σίτου πρᾶσιν, ὃ δὴ καπηλείαν ἐπονομάζουσιν οἱ πλεῖστοι· καὶ ζῴων διαμερισθέντων μάγειροι διατιθέσθων ξένοις τε καὶ δημιουργοῖς καὶ τούτων οἰκέταις.
But of retail trade in these things, or of barley or wheat distributed into flour, or indeed all the other food, let no one sell to citizens and their slaves, nor let anyone buy from such a person; but in the markets of the strangers, let a stranger sell to the craftsmen and their slaves, exchanging for wine and grain their sale, which indeed most people call retail trade; and let the cooks distribute to the strangers and craftsmen and their servants of the divided animals.
πᾶσαν δὲ ὕλην καύσιμον ὁσημέραι ξένος ὁ βουληθεὶς ὠνείσθω μὲν ἁθρόαν παρὰ τῶν ἐν τοῖς χωρίοις ἐπιτρόπων, πωλείτω δὲ αὐτὸς τοῖς ξένοις, καθʼ ὅσον ἂν βούληται καὶ ὁπόταν βούληται.
And let any stranger who wishes buy all the fuel-wood daily in bulk from the managers in the districts, and let him sell it himself to the strangers, in as much quantity and whenever he wishes.
τῶν δὲ ἄλλων χρημάτων πάντων καὶ σκευῶν ὁπόσων ἑκάστοισι χρεία, πωλεῖν εἰς τὴν κοινὴν ἀγορὰν φέροντας εἰς τὸν τόπον ἕκαστον, ἐν οἷς ἂν νομοφύλακές τε καὶ ἀγορανόμοι, μετʼ ἀστυνόμων τεκμηράμενοι ἕδρας πρεπούσας, ὅρους θῶνται τῶν ὠνίων, ἐν τούτοις ἀλλάττεσθαι νόμισμά τε χρημάτων καὶ χρήματα νομίσματος, μὴ προϊέμενον ἄλλον ἑτέρῳ τὴν ἀλλαγήν·
And of all the other goods and utensils which each has need of, they must carry them to the common market to sell, each to the place where the law-wardens and market-stewards, having determined suitable seats with the city-stewards, set boundaries for the things for sale; in these places they shall exchange coin for goods and goods for coin, one not releasing the exchange to the other without payment.
§8.850ΑΘ. ὁ δὲ προέμενος ὡς πιστεύων, ἐάντε κομίσηται καὶ ἂν μή, στεργέτω ὡς οὐκέτι δίκης οὔσης τῶν τοιούτων περὶ συναλλάξεων.
ATH. But he who releases it as trusting, whether he recovers it or not, let him be content, as there is no longer any lawsuit for such transactions.
τὸ δὲ ὠνηθὲν ἢ πραθὲν ὅσῳ πλέον ἂν ᾖ καὶ πλέονος ἢ κατὰ τὸν νόμον, ὃς εἴρηκεν πόσου προσγενομένου καὶ ἀπογενομένου δεῖ μηδέτερα τούτων ποιεῖν, ἀναγραφήτω τότʼ ἤδη παρὰ τοῖς νομοφύλαξιν τὸ πλέον, ἐξαλειφέσθω δὲ τὸ ἐναντίον.
And let the bought or sold property, by how much it may be more and of greater value than according to the law (which has said with what addition or subtraction one must do neither of these), be registered then immediately with the law-wardens, the excess, and let the opposite be wiped out.
τὰ αὐτὰ δὲ καὶ περὶ μετοίκων ἔστω τῆς ἀναγραφῆς πέρι τῆς οὐσίας.
And let the same rules apply concerning the registration of the property of metics.
ἰέναι δὲ τὸν βουλόμενον εἰς τὴν μετοίκησιν ἐπὶ ῥητοῖς, ὡς οἰκήσεως οὔσης τῶν ξένων τῷ βουλομένῳ καὶ δυναμένῳ κατοικεῖν, τέχνην κεκτημένῳ καὶ ἐπιδημοῦντι μὴ πλέον ἐτῶν εἴκοσιν ἀφʼ ἧς ἂν γράψηται, μετοίκιον μηδὲ σμικρὸν τελοῦντι πλὴν τοῦ σωφρονεῖν, μηδὲ ἄλλο αὖ τέλος ἕνεκά τινος ὠνῆς ἢ καὶ πράσεως· ὅταν δʼ ἐξήκωσιν οἱ χρόνοι, τὴν αὑτοῦ λαβόντα οὐσίαν ἀπιέναι.
And let him who wishes go into metic-status on stated terms, since residence is open to any of the strangers who wishes and is able to settle, possessing a trade and residing for not more than twenty years from when he registers, paying not even a small metic-tax except to be temperate, nor any other tax on account of any purchase or sale; and when the times have expired, let him depart, taking his own property.
ἐὰν δʼ ἐν τοῖς ἔτεσι τούτοις αὐτῷ συμβῇ λόγου ἀξίῳ πρὸς εὐεργεσίαν τῆς πόλεως γεγονέναι τινὰ ἱκανήν, καὶ πιστεύῃ πείσειν βουλὴν καὶ ἐκκλησίαν, ἤ τινα ἀναβολὴν τῆς ἐξοικήσεως ἀξιῶν αὑτῷ γίγνεσθαι κυρίως, ἢ καὶ τὸ παράπαν διὰ βίου τινὰ μονήν, ἐπελθὼν καὶ πείσας τὴν πόλιν, ἅπερ ἂν πείσῃ, ταῦτα αὐτῷ τέλεα γιγνέσθω.
And if during these years it happens that he has performed some sufficient service worthy of mention for the benefit of the city, and he trusts he will persuade the council and assembly, either requesting some postponement of his departure to be granted to him authoritatively, or even altogether a lifelong stay, having approached and persuaded the city, whatever he persuades, let these things be fulfilled for him.
παισὶ δὲ μετοίκων, δημιουργοῖς οὖσι καὶ γενομένοις ἐτῶν πεντεκαίδεκα, τῆς μὲν μετοικίας ἀρχέτω χρόνος ὁ μετὰ τὸ πέμπτον καὶ δέκατον ἔτος, ἐπὶ τούτοις δὲ εἴκοσιν ἔτη μείνας, ἴτω ὅπῃ αὐτῷ φίλον, μένειν δὲ ἂν βούληται, κατὰ τὰ αὐτὰ μενέτω πείσας· ὁ δὲ ἀπιὼν ἐξαλειψάμενος ἴτω τὰς ἀπογραφάς, αἵτινες ἂν αὐτῷ παρὰ τοῖς ἄρχουσιν γεγραμμέναι πρότερον ὦσιν.
And for the children of metics, being craftsmen and having become fifteen years of age, let the time of metic-status begin after the fifteenth year, and having remained for twenty years in addition to this, let them go wherever they please, but if they wish to remain, let them remain on the same terms after persuading the city; and let the one who departs go after wiping out the registrations which were previously written for him with the magistrates.
