§11.924ΑΘ. ἐὰν δὲ ὑός τῳ τελευτήσῃ παῖς ὤν, πρὶν εἰς ἄνδρας δυνατὸς εἶναι τελεῖν, εἴτε γεννητὸς ὢν εἴτε ποιητός, γραφέτω καὶ περὶ τῆς τοιαύτης τύχης ὁ τὴν διαθήκην γράφων τίνα χρὴ παῖδα αὐτῷ δεύτερον ἐπὶ τύχαις ἀμείνοσιν γίγνεσθαι.
ATH. And if anyone’s son dies while still a child, before being able to be enrolled among men, whether he is a natural or an adopted son, let the writer of the testament write also concerning such a chance, who must become his second child under better fortunes.
ἐὰν δέ τις ἄπαις ὢν τὸ παράπαν διαθήκην γράφῃ, τὸ τῆς ἐπικτήτου δεκατημόριον ἐξελόμενος, ἐὰν ἐθέλῃ τῳ δωρεῖσθαι, δωρείσθω· τὰ δὲ ἄλλα παραδιδοὺς πάντα τῷ ποιηθέντι ἄμεμπτος ἵλεων ὑὸν αὐτὸν ποιείσθω σὺν νόμῳ.
And if anyone writes a testament being altogether childless, having set aside a tenth part of his acquired property, if he wishes to present it to someone, let him present it; but delivering all the other things to the adopted son, let him blamelessly and graciously make him his son in accordance with the law.
ᾧ δʼ ἂν ἐπιτρόπων οἱ παῖδες δέωνται, ἐὰν μὲν διαθέμενος τελευτᾷ καὶ γράψας ἐπιτρόπους τοῖς παισὶν ἑκόντας τε καὶ ὁμολογοῦντας ἐπιτροπεύσειν οὑστινασοῦν καὶ ὁπόσους ἂν ἐθέλῃ, κατὰ ταῦτα τὰ γραφέντα ἡ τῶν ἐπιτρόπων αἵρεσις γιγνέσθω κυρία·
And for whichever of the cases where the children need guardians, if indeed the disposer dies having written as guardians for his children any persons whomsoever and as many as he wishes, they being willing and agreeing to act as guardians, let the choice of guardians be valid according to these written instructions.
ἐὰν δὲ ἢ τὸ παράπαν μὴ διαθέμενος τελευτήσῃ τις ἢ τῆς τῶν ἐπιτρόπων αἱρέσεως ἐλλιπής, ἐπιτρόπους εἶναι τοὺς ἐγγύτατα γένει πρὸς πατρὸς καὶ μητρὸς κυρίους, δύο μὲν πρὸς πατρός, δύο δὲ πρὸς μητρός, ἕνα δʼ ἐκ τῶν τοῦ τελευτήσαντος φίλων, τούτους δʼ οἱ νομοφύλακες καθιστάντων τῷ δεομένῳ τῶν ὀρφανῶν.
But if anyone dies having made no testament at all, or deficient in the choice of guardians, let the nearest relatives by birth on the father's and mother's side be valid as guardians, two indeed on the father's side, and two on the mother's side, and one from the friends of the deceased; and let the guardians of the law establish these for the orphan who needs them.
καὶ πάσης τῆς ἐπιτροπῆς καὶ τῶν ὀρφανῶν πεντεκαίδεκα τῶν νομοφυλάκων οἱ πρεσβύτατοι πάντων ἐπιμελείσθων ἀεὶ κατὰ πρέσβιν καὶ κατὰ τρεῖς διελόμενοι σφᾶς αὐτούς, κατʼ ἐνιαυτὸν τρεῖς καὶ κατʼ ἐνιαυτὸν ἄλλον ἕτεροι τρεῖς, ἕως ἂν αἱ πέντε περίοδοι γίγνωνται κύκλῳ· καὶ τοῦτο ἐκλιπέτω μηδέποτε κατὰ δύναμιν.
And of all the guardianship and of the orphans, let the fifteen eldest of the lawguards care for them always according to seniority, having divided themselves by threes, three for one year, and another three for another year, until the five periods are completed in a circle; and let this duty never fail, as far as possible.
ὃς δʼ ἂν μηδὲν τὸ παράπαν διαθέμενος ἀποθάνῃ, παῖδας μὲν καταλιπὼν δεομένους ἐπιτροπῆς, τῶν αὐτῶν νόμων τούτων ἡ χρεία τῶν παίδων αὐτοῦ μετεχέτω·
And whoever dies having disposed of nothing at all, leaving children who need guardianship, let the need of his children partake of these same laws.
θηλείας δὲ ἂν καταλείπῃ τις ἀπροσδοκήτῳ τύχῃ χρησάμενος, συγγνώμην τῷ τιθέντι τὸν νόμον ἐχέτω, ἐὰν τῶν τριῶν αὐτοῦ πρὸς τὰ δύο ἐπισκοπῶν τὴν ἔκδοσιν τῶν θυγατέρων ποιῆται, πρός τε τὴν τοῦ γένους ἀγχιστείαν καὶ τὴν τοῦ κλήρου σωτηρίαν, τὸ δὲ τρίτον, ὅπερ ἂν πατὴρ διασκέψαιτο, ἐξ ἁπάντων τῶν πολιτῶν βλέπων εἰς ἤθη τε καὶ τρόπους τὸν ἐπιτήδειον αὑτῷ μὲν ὑόν, νυμφίον δʼ εἶναι τῇ θυγατρί, τοῦτο δὲ παραλείπῃ διὰ τὴν ἀδύνατον σκέψιν. νόμος τοίνυν εἰς δύναμιν ὅδε περὶ τῶν τοιούτων κείσθω·
And if anyone leaves daughters, having met with unexpected fortune, let him have indulgence for the lawmaker, if looking to two of his three considerations he makes the giving in marriage of the daughters, namely, the kinship of the family and the preservation of the allotment, but the third, which a father would consider, looking among all the citizens at character and ways to find one suitable to be a son for himself and a bridegroom for his daughter, he omits this because of the impossibility of the inquiry.
ἐὰν ὁ μὴ διαθέμενος θυγατέρας λείπῃ, τοῦδε ἀποθανόντος, ἀδελφὸς ὁμοπάτωρ ἢ ἄκληρος ὁμομήτριος ἐχέτω τὴν θυγατέρα καὶ τὸν κλῆρον τοῦ τελευτήσαντος· ἐὰν δὲ μὴ ᾖ ἀδελφός, ἀδελφοῦ δὲ παῖς, ὡσαύτως, ἐὰν ἐν ἡλικίᾳ πρὸς ἀλλήλους ὦσιν· ἐὰν δὲ μηδὲ εἷς τούτων, ἀδελφῆς δὲ παῖς ᾖ, κατὰ ταὐτά· τέταρτος δὲ πατρὸς ἀδελφός, πέμπτος δὲ τούτου παῖς, ἕκτος δὲ ἀδελφῆς πατρὸς ἔκγονος.
Therefore, let this law, as far as possible, be established concerning such matters: If one who has made no testament leaves daughters, upon his death, let a brother by the same father, or a brother by the same mother who has no allotment, have the daughter and the allotment of the deceased; and if there is no brother, likewise a brother's son, if they are of suitable age to one another; and if there is none of these, likewise a sister's son; fourth, a father's brother, fifth, his son, and sixth, a descendant of the father's sister.
