§11.916ΑΘ. ὃς δʼ ἂν ἀποδόμενος τιμήν του λάβῃ μὴ ἐλάττω δραχμῶν πεντήκοντα, παραμενέτω κατὰ πόλιν ἐξ ἀνάγκης δέκα ἡμέρας, ὁ δὲ πριάμενος ἴστω τὴν οἰκίαν τὴν τοῦ ἀποδομένου, τῶν περὶ τὰ τοιαῦτα ἐγκλημάτων εἰωθότων γίγνεσθαι χάριν καὶ τῶν ἀναγωγῶν τῶν κατὰ νόμους εἵνεκα· ἡ δὲ κατὰ νόμους ἀναγωγὴ καὶ μὴ τῇδε ἔστω.
**ATH.**: "And whoever sells anything and receives a price of not less than fifty drachmae, let him remain of necessity in the city for ten days, and let the buyer know the dwelling of the seller, because accusations concerning such matters are accustomed to arise, and for the sake of the returns in accordance with the laws; and let the legal return, and the non-return, be as follows.
ἐάν τις ἀνδράποδον ἀποδῶται κάμνον φθόῃ ἢ λιθῶν ἢ στραγγουριῶν ἢ τῇ καλουμένῃ ἱερᾷ νόσῳ ἢ καὶ ἑτέρῳ τινὶ ἀδήλῳ τοῖς πολλοῖς νοσήματι μακρῷ καὶ δυσιάτῳ κατὰ τὸ σῶμα ἢ κατὰ τὴν διάνοιαν, ἐὰν μὲν ἰατρῷ τις ἢ γυμναστῇ, μὴ ἀναγωγῆς ἔστω τούτῳ πρὸς τὸν τοιοῦτον τυγχάνειν, μηδʼ ἐὰν τἀληθές τις προειπὼν ἀποδῶταί τῳ·
If anyone sells a slave suffering from consumption, or stones, or strangury, or the so-called 'sacred disease' (epilepsy), or any other disease of the body or mind that is long, hard to cure, and unnoticeable to most people: if he sells to a physician or a gymnastic trainer, it shall not be possible for this person to obtain a return against such a seller, nor if someone sells to anyone after telling the truth beforehand.
ἐὰν δέ τις ἰδιώτῃ τι τῶν τοιούτων ἀποδῶται δημιουργός, ὁ πριάμενος ἐντὸς ἑκμήνου ἀναγέτω, πλὴν τῆς ἱερᾶς, ταύτης δʼ ἐντὸς ἐνιαυτοῦ τὴν ἀναγωγὴν ἐξέστω ποιεῖσθαι τῆς νόσου.
But if a professional craftsman sells any such slave to a private individual, let the buyer make the return within six months, except for the sacred disease, for which disease it shall be permitted to make the return within a year.
διαδικαζέσθω δὲ ἔν τισι τῶν ἰατρῶν, οὓς ἂν κοινῇ προβαλόμενοι ἕλωνται· τὸν δὲ ὀφλόντα τὴν δίκην διπλάσιον ἀποτίνειν τῆς τιμῆς ἧς ἂν ἀποδῶται.
And let the case be decided before certain physicians whom they shall choose by mutual nomination; and let the one who loses the suit pay double the price for which he sold.
ἐὰν δὲ ἰδιώτῃ τις ἰδιώτης, ἀναγωγὴν μὲν εἶναι, καθάπερ καὶ τοῖς πρόσθεν ἐρρήθη, καὶ τὴν διαδικασίαν, ὁ δὲ ὀφλὼν τὴν τιμὴν ἁπλῆν ἀποτινέτω.
But if a private individual sells to a private individual, let the return and the trial be just as was said before, but let the one who loses the suit pay back the simple price.
ἐὰν δὲ ἀνδροφόνον ἀποδῶταί τίς τινι εἰδότι μὲν εἰδώς, μὴ τυγχανέτω ἀναγωγῆς τοῦ τοιούτου τῆς πράσεως, μὴ δὲ εἰδότι τὴν μὲν ἀναγωγὴν εἶναι τότε ὅταν τις αἴσθηται τῶν πριαμένων, ἐν πέντε δὲ τῶν νομοφυλάκων τοῖς νεωτάτοις εἶναι τὴν κρίσιν, εἰδὼς δὲ ἂν κριθῇ, τάς τε οἰκίας τοῦ πριαμένου καθηράτω κατὰ τὸν τῶν ἐξηγητῶν νόμον, τῆς τιμῆς τε ἀποδότω τῷ πριαμένῳ τριπλάσιον.
And if someone sells a murderer to one who knows, while knowing it himself, let him not obtain a return of such a sale; but if he sells to one who does not know, let there be a return when any of the buyers perceives it, and let the judgment rest with the five youngest of the guardians of the laws, and if he is judged to have known, let him purify the houses of the buyer according to the law of the interpreters, and let him pay back threefold the price to the buyer.
ὁ δὲ ἀλλαττόμενος ἢ νόμισμα ἀντὶ νομίσματος, ἢ καὶ τῶν ἄλλων ζῴων ὁτιοῦν ἢ καὶ μὴ ζῴων, ἀκίβδηλον πᾶν διδότω καὶ δεχέσθω τῷ νόμῳ συνεπόμενος·
And let the person who exchanges either coin for coin, or any of other animals or non-animals, give and receive everything unadulterated, following the law.
προοίμιον δέ, καθάπερ ἄλλων νόμων, δεξώμεθα καὶ περὶ ὅλης ταύτης τῆς κάκης.
And let us receive a prelude concerning this whole vice, just as for other laws.
κιβδηλείαν δὲ χρὴ πάντα ἄνδρα διανοηθῆναι καὶ ψεῦδος καὶ ἀπάτην ὡς ἕν τι γένος ὄν, τοῦτο ᾧ τὴν φήμην ἐπιφέρειν εἰώθασιν οἱ πολλοί, κακῶς λέγοντες, ὡς ἐν καιρῷ γιγνόμενον ἑκάστοτε τὸ τοιοῦτον πολλάκις ἂν ὀρθῶς ἔχοι, τὸν καιρὸν δὲ καὶ ὅπου καὶ ὁπότε ἀτάκτως καὶ ἀορίστως ἐῶντες, τῇ λέξει ταύτῃ πολλὰ ζημιοῦνταί τε καὶ ζημιοῦσιν ἑτέρους.
Every man ought to consider adulteration, falsehood, and deceit as being one single class, which is that on which the many are accustomed to bring the reputation, speaking badly, that such a thing, occurring each time in season, would often be right; but by leaving the season, and where and when, in a disorderly and indefinite state, they suffer much loss by this expression and cause loss to others.
νομοθέτῃ δὲ οὐκ ἐγχωρεῖ τοῦτο ἀόριστον ἐᾶν, ἀλλὰ ἢ μείζους ἢ ἐλάττους ὅρους ἀεὶ δεῖ διασαφεῖν, καὶ δὴ καὶ νῦν ὡρίσθω.
And it is not permitted for a legislator to leave this indefinite, but he must always make clear either larger or smaller limits, and indeed let it be defined now too."
