[MAECIANUS libro quarto fideicommissorum. ] §36.1.66.prSi eius pupilli, cui sine tutoris auctoritate pecunia credita erat, restituta ex eo senatus consulto mihi fuerit hereditas, si soluam creditori, non repetam: adquin heres si post restitutionem soluat, repetet: non ob aliud, quam quod ab eo in me naturalis obligatio translata intellegitur.
If the inheritance of a ward, to whom money had been lent without the authority of his tutor, has been restored to me under that senatusconsult, and if I pay the creditor, I shall not seek to recover it; yet if the heir pays after the restoration, he will recover it, for no other reason than that the natural obligation is understood to have been transferred from him to me.
et si eius mihi restituta sit hereditas, qui pupillo sine tutoris auctoritate crediderit, si soluerit mihi pupillus, non repetet: at si heredi soluerit, repetet, non repetiturus, si ante restitutionem soluisset.
And if there has been restored to me the inheritance of one who lent money to a ward without the authority of his tutor, and if the ward pays me, he will not recover it; but if he pays the heir, he will recover it, though he would not have recovered it if he had paid before the restoration.
§36.1.66.1Si necessarii heredes sub condicione quamuis leuissima heredes sint instituti, cui parere solent, dicendum est cogi restituere hereditatem desiderantibus his, quibus restituere rogati sunt, quia etiam necessari heredes fideicommissae hereditatis restituendae gratia condicioni parere erunt compellendi.
If necessary heirs are appointed heirs under any condition, however slight, which they are accustomed to obey, it must be said that they can be compelled to restore the inheritance at the desire of those to whom they were requested to restore it, because even necessary heirs must be compelled to comply with the condition for the sake of restoring the trust inheritance.
§36.1.66.2Si quis rogatus restituere hereditatem decessit, antequam eam restituat, heres eius poterit hereditatem restituere et ex Trebelliano senatus consulto transeunt actiones.
If anyone requested to restore an inheritance dies before restoring it, his heir can restore the inheritance, and the actions transfer under the Trebellian senatusconsult.
sed si duo ei heredes extitissent, uti quisque restituisset, pro ea parte transituras actiones: nam et si ipse partem restituisset, pro parte interim transituras uerius est.
But if two heirs have succeeded him, the actions will transfer in proportion to the share that each has restored; for even if the deceased himself had restored a part, it is more correct that the actions should transfer in the meantime for that part.
sed et si plures heredes extiterunt ei, qui rogatus est restituere hereditatem, si quidam interim restituerint, uel cum ei, cui restitui debuit, plures heredes extiterint: ut cui restituta erit, is pro ea parte ex hoc senatus consulto habebit actiones.
And likewise, if there were several heirs to the person requested to restore the inheritance, and some of them have restored in the meantime, or if there were several heirs to the person to whom it ought to be restored: he to whom it has been restored shall have the actions for his share under this senatusconsult.
§36.1.66.3Si patronus ex parte debita heres institutus rogatus fuerit eam liberis exheredatis defuncti liberti restituere, si sua sponte adierit, erit Falcidiae locus, si coactus, in solidum transibunt actiones ex hoc senatus consulto.
If a patron, appointed heir for his due share, has been requested to restore it to the disinherited children of the deceased freedman, if he enters upon the inheritance voluntarily, there will be room for the Lex Falcidia; but if he is compelled, the actions will transfer in full under this senatusconsult.
