[PAULUS, in his single book on the Law of Codicils.] Codicils are made in four ways: for they are confirmed either for the future, or for the past, or by way of a trust when a will has been made, or without a will.
§29.7.8.1Sed ideo fideicommissa dari possunt ab intestato succedentibus, quoniam creditur pater familias sponte sua his relinquere legitimam hereditatem.
But trusts can be given by those succeeding on intestacy for this reason, because the father of the family is believed to have left the statutory inheritance to them of his own free will.
§29.7.8.2Codicilli totiens ualent, quotiens quis testamentum quoque facere possit.
Codicils are valid as often as a person is also able to make a will.
We shall not, however, understand this in such a way as to require that he was able to make a will at the time when he writes those codicils: for what if he did not have the opportunity of obtaining a sufficient number of witnesses? But [rather] if he had the capacity to make a will in law.
If, after making a will, someone confirmed codicils, and then offered himself for arrogation and made codicils while in that state, and, having been emancipated, died, it is asked whether the legacies under the codicils are due: for the will also is valid, but he made those codicils at a time when he did not have the capacity to make a will.
Nor is he similar to a mute person who has properly confirmed codicils: for although a mute person cannot make a will, nevertheless the will which he had previously made remains in the same state, whereas this man's will was destroyed and he is, in a way, making a disposition concerning the property of another.
But we shall say that the codicils are valid: for even if a posthumous child is born and ruptures the will and dies, the codicils are nonetheless valid.
§29.7.8.4Si miles testamentum quidem ante militiam, sed codicillos in militia fecerit, an iure militari ualeant codicilli, quaeritur, quoniam testamentum iure communi ualet, nisi si militiae tempore signauit uel quaedam adiecerit.
If a soldier made a will before his military service, but made codicils during his military service, it is asked whether the codicils are valid by military law, since the will is valid by common law, unless he sealed it or added certain things during the time of his military service.
Certainly, codicils made during the time of military service ought not to be referred back to the will, but they are valid by military law.
If freedom is given by codicils to that slave who received a legacy by a will, we shall say that the legacy is valid, as if the legacy had been established from the beginning.
§29.7.8.6Si quis certi generis codicillos confirmauerit, puta 'quos nouissimos fecero', non utique statim quae codicillis dantur consistere uidebuntur, quamdiu alii quoque fieri possint, et ideo si alii postea fiant, legata in prioribus data non ualebunt.
If someone confirmed codicils of a certain class, for example, 'those which I shall have made last,' what is given by the codicils will certainly not be seen to be established immediately, as long as others can also be made, and therefore if others are made afterwards, the legacies given in the prior ones will not be valid.
