§59LIX. οἱ δὲ θεσμοθέται πρῶτον μὲν τοῦ προγράψαι τὰ δικαστήριά εἰσι κύριοι τίσιν ἡμέραις δεῖ δικάζειν, ἕπειτα τοῦναι ταῖς ἀρχαῖς· καθότι γὰρ ἄν οὖτοι σῶσιν, κατὰ τοῦτο χρῶνται.
LIX. And the thesmothetai indeed, first, have the authority to announce beforehand on which days the courts must judge, and next, to assign them to the magistrates; for in whatever way they assign them, the magistrates use them accordingly.
ἔτι δὲ τὰς εἰσαγγελίας εἰσαγγέλλουσιν εἰς τὸν δῆμον καὶ τὰς καταχειροτονίας καὶ τὰς προβολὰς ἁπάσας εἰσάγουσιν οὗ[τ]οι καὶ γραφὰς παρανόμων καὶ νόμον μὴ ἐπιτήδειον θεῖναι καὶ προεδρικὴν καὶ ἐπιστατικὴν καὶ στρατηγοῖς εὐθύνας.
Furthermore, they report impeachments to the People, and they introduce all votes of condemnation and preliminary accusations, and indictments for illegal proposals, and for proposing an unsuitable law, and against presiding officers and presidents, and the audits of accounts for generals.
εἰσὶ δὲ καὶ γραφαὶ πρὸς αὐτοὺς ὧν παράστασις τίθεται, ξενίας καὶ δωροξενίας, ἄν τι(δῶρα δοὺς ἀποφύγῃ τὴν ξενίαν, καὶ συκοφαντίας καὶ δώρων καὶ ψευδεγγραφῆς καὶ ψευδοκλητείας καὶ βουλεύσεως καὶ ἀγραφίου καὶ μοιχείας.
And there are also indictments brought before them for which a deposit is paid: for alienage, and for bribery to escape the charge of alienage (if anyone by giving bribes escapes the charge of alienage), and for sycophancy, and for bribery, and for false entry, and for false summons, and for conspiracy, and for non-registration, and for adultery.
εἰσάγουσιν 81 καὶ τὰς δοκιμασίας ταῖς ἀρχαῖς ἁπάσαις καὶ τοὺς ἀπεψηφισμένους ὑπὸ τῶν δημοτῶν καὶ τὰς καταγνώσεις τὰς ἐκ τῆς βουλῆς.
And they also introduce the scrutiny for all magistrates, and those rejected by their fellow-demesmen, and the condemnations coming from the Council.
εἰσάγουσι δὲ καὶ δίκας ἰδίας, ἐμπορικὰς καὶ μεταλλικὰς καὶ δούλων, ἄν τις τὸν ἐλεύθερον κακῶς λέγῃ.
And they also introduce private lawsuits: commercial and mining cases, and cases concerning slaves, if anyone speaks ill of a free person.
καὶ ἐπικληροῦσι ταῖς ἀρχαῖς οὖτοι τὰ δικαστήρια τὰ ἴδια καὶ τὰ δημόσια.
And they assign by lot the private and public courts to the magistrates.
καὶ τὰ σύμβολα τὰ πρὸς τὰς πόλεις οὗτοι κυροῦσι, καὶ τὰς δίκας τὰς ἀπὸ τῶν συμβόλων εἰσάγουσι, καὶ τὰ ψευδομαρτύρια εξ Ἀρείου πάγου.
And they ratify treaties with other cities, and they introduce lawsuits arising from treaties, and cases of false witness from the Areopagus.
τοὺς δὲ δικαστὰς κληροῦσι πάντες οἱ ἐννέα ἄρχοντες, δέκατος δ’ ὁ γραμματεὺς ὁ τῶν θεσμοθετῶν, τοὺς τῆς αὑτοῦ φυλῆς ἕκαστος.
And the drawing of lots for the jurors is done by all the nine archons, and as the tenth, the secretary of the thesmothetai, each for the members of his own tribe.
§60LX. τὰ μὲν οὖν περὶ τοὺς θ ἄρχοντας τοῦτον ἔχει τὸν τρόπον.
LX. Now the matters concerning the nine archons are in this manner.
κληροῦσι δὲ καὶ ἀθλοθέτας δέκα ἄνδρας, ἕνα τῆς φυλῆς ἑκάστης.
And they also elect by lot ten men as athletic directors, one from each tribe.
οὗτοι δὲ δοκιμασθέντες ἄρχουσι τέτταρα ἴτη, καὶ διοικοῦσι τήν τε πομπὴν τῶν παναθηναίων καὶ τὸν ἀγῶνα τῆς μουσικῆς καὶ τὸν γυμνικὸν ἀγῶνα καὶ τὴν ἱπποδρομίαν, καὶ τὸν πέπλον ποιουνται, καὶ τοὺς ἀμφορεῖς ποιοῦνται μετὰ μετὰ τῆς βουλῆς, καὶ τὸ ἔλαιον τοῖς ἀθληταῖς ἀποδιδόασι.
These, after being approved, hold office for four years, and they manage the procession of the Panathenaia, and the musical contest, and the athletic contest, and the horse-race, and they have the robe made, and they have the amphorae made in cooperation with the Council, and they distribute the olive oil to the athletes.
συλλέγεται δὲ τὸ ἔλαιον ἀπὸ τῶν μοριῶν· εἰσπράττει δὲ τοὺς τὰ χωρία κεκτημένους ἐν οἷς αἱ μορίαι εἰσὶν ὁ ἄρχων, τρί’ ἡμικοτύλια ἀπὸ τοῦ στελέχους ἑκάστου.
And the olive oil is collected from the sacred olive trees; and the archon exacts from those who possess the estates in which the sacred olive trees are, three half-kotylai from each trunk.
πρότερον δ’ ἐπώλει τὸν καρπὸν ἡ πόλις· καὶ εἴ τις ἐξορύξειεν ἐλαίαν μμορίαν ἤ κατάξειεν, ἔκρινεν ἡ ἐξ Ἀρείου πάγου βουλή, καὶ εἴ [τ]ου θαν[ά]τῳ τοῦτον ἐζημίουν.
Formerly, the city sold the fruit; and if anyone dug up a sacred olive tree or broke one down, the Council of the Areopagus judged them, and if they convicted anyone, they punished him with death.
ἐξ οὗ δὲ τὸ ἔλαιον ὁ τὸ χωρίον κε|κτημένος ἀποτίνει, ὁ μὲν νόμος ἔστιν, ἡ δὲ κρίσις καταλέλυται.
But since the time when the owner of the estate pays the olive oil, the law indeed exists, but the trial has been abolished.
τὸ δὲ ἔλα[ιον] έκ τοῦ κτήματος, οὐκ ἀπὸ τῶν στελεχῶν ἐστι τῇ πόλει.
And the olive oil belongs to the city from the estate, not from the trunks.
συλλέξας οὖν ὁ ἄρχων τὸ ἐφ’ ἑαυ[τοῦ] γιγνόμενον τοῖς ταμίαις παραδίδωσιν εἰς καὶ οὐκ ἔστιν ἀναβῆναι πρότερον εἰς [Ἄρε] πάγον, πρὶν ἄν παραδῷ τοῖς ταμίαις.
Therefore, the archon, having collected what is produced during his own term, delivers it to the treasurers on the Acropolis, and it is not permitted for him to go up to the Areopagus before he delivers it to the treasurers.
οἱ δὲ ταμίαι τὸv μὲν ἄλλον χρόνον τηροῦσιν ἐν ἀκροπόλει, τοῖς Παναθηναίοις ἀπομετροῦσι τοῖς ἀθλοθέταις, οἱ δ’ ἀθλοθέται τοῖς νικῶσι τῶν ἀγωνιστῶν.
And the treasurers for the rest of the time keep it on the Acropolis, and at the Panathenaia they measure it out to the athletic directors, and the athletic directors to the winners among the contestants.
ἔστι γὰρ ἆθλα τοῖς μὲν τὴν μουσικὴν νικῶσιν ἀργύρια καὶ χροσία, τοῖς δὲ τὴν εὐανδρίαν ἀσπίδες, τοῖς δὲ τὸν γυμνικὸν ἀγῶνα καὶ τὴν ἱπποδρομίαν ἔλαιον.
For the prizes are, for those winning the musical contest, silver and gold, and for those winning the physical fitness contest, shields, and for those winning the athletic contest and the horse-race, olive oil.
§61LXI. χειροτονοῦσι δὲ καὶ τὰς πρὸς τὸν πόλεμον ἀρχὰς ἁπάσας, στρατηγοὺς δέκα, πρότερον μὲν ἀφ’ φυλῆς ἔνα, νῦν δ’ ἐξ καὶ τούτους διατάττουσι τῇ χειροτονίᾳ, ἕνα μὲν ἐπὶ τοὺς ὁπλίτας, ὅς ἡγεῖται τῶν ὁπλιτῶν ἄν ἐξίωσι, ἕνα δ’ ἐπὶ τὴν χώραν, ὅς φυλάττει, κἂν πόλεμος ἐν τῇ χώρᾳ γίγνηται, πολεμεῖ οὗτος·
LXI. And they also elect by hand-vote all the offices for war: ten generals, formerly one from each tribe, but now from all citizens.
δύο δ’ ἐπὶ τοὺ Πειραιέα, τὸν μὲν εἰς τὴν Μουνιχίαν, τὸν δ’ εἰς τὴν Ἀκτήν, οἵ τῆς φυλακῆς ἐπιμελοῦνται [καὶ] τῶν ἐν Πειραιεῖ. ἕνα δ’ ἐπὶ τὰς συμμορίας, ὅς τούς τε τριηράρχους καταλέγει καὶ τὰς ἀντιδόσεις αὐτοῖς ποιεῖ καὶ τὰς διαδικασίας αὐτοῖς εἰσάγει·
And they assign them their duties by the hand-vote: one over the hoplites, who leads the hoplites if they go out; one over the country, who guards it, and if war occurs in the country, he fights; two over the Piraeus, one for Munychia and the other for Acte, who supervise the guard of the things in Piraeus; and one over the symmories, who enrolls the trierarchs and manages the exchanges of property for them and introduces their adjudication cases.
τοὺς δ’ ἄλλους πρὸς τὰ παρόντα πράγματα ἐκπέμπουσιν.
And they send out the others for the current affairs.
ἐπιχειροτονία δ’ αὐτῶν ἐστι κατὰ τὴν πρυτανείαν ἑκαστην, εἰ δοκοῦσιν καλῶς ἄρχειν· κἄν τινα ἀποχειροτονήσωσιν, κρίνουσιν ἐν τῷ δικαστηρίῳ, κἄν μὲν ἁλῷ, τιμῶσιν ὅ τι χρὴ παθεῖν ἢ ἀποτεῖσαι, ἂν δ’ ἀποφύγῃ, πάλι[ν] ἄρχει.
And a vote of confirmation on them is held in each prytany, whether they seem to rule well; and if they depose anyone by vote, they try him in the court, and if he is convicted, they assess what he must suffer or pay, but if he is acquitted, he resumes office.
κύριοι δὲ εἰσιν ὅταν ἡγῶνται καὶ δῆσαι τὸν ἀτακτοῦντα καὶ κ[η]ρῦξαι καὶ ἐπιβολὴν ἐπιβάλλειν· οὐκ εἰώθασι δὲ ἐπιβάλλειν.
And they have the authority, when they command, both to bind the insubordinate and to herald their dismissal and to impose a fine; but they are not accustomed to impose fines.
χειροτονοῦσι δὲ καὶ ταξ[ι]άρχους δέκα, ἕνα τῆς φυλῆς ἑκάστης· οὗτος δ’ ἡγεῖται τῶν φυλετῶν καὶ λοχαγοὺς καθίστησιν.
And they also elect ten taxiarches by hand-vote, one from each tribe; and each leads his own tribesmen and appoints lochagoi.
χειροτονοῦσι δὲ καὶ ἱππάρχους δύο ἐξ ἁπάντων· οὗτοι δ’ ἡγοῦνται τῶν ἱππέων, διελομ[ενοι] τὰς φυλὰς ݲ ἑκάτερος κύριοι δὲ τῶν αὐτῶν εἰσιν ὧνπερ οἱ στρατηγοὶ κατὰ τῶν ὁπλιτῶν.
And they also elect two hipparches by hand-vote from all citizens; and these lead the cavalry, having divided the tribes, five for each; and they have the same authority as the generals have over the hoplites.
ἐπιχειροτονία δὲ γίγνεται <καὶ< τούτων.
And a vote of confirmation is also held for them.
χειροτονοῦσι δὲ καὶ φυλαρχους ἕνα τῆς φυλῆς, τὸν ἠγησόμενον <τῶν ἱππέων> ὥσπερ οἱ ταξίαρχοι τῶν χειροτονοῦσι δὲ καὶ εἰς Λῆμνον ἄππαρχον, ὅς ἐπιμελεῖται τῶν ἱππέων τῶν ἐν Λήμνῳ.
And they also elect by hand-vote one phylarch for each tribe, to lead the cavalry, just as the taxiarches lead the hoplites. And they also elect by hand-vote a hipparch for Lemnos, who supervises the cavalry in Lemnos.
χειροτονοῦσι δὲ καὶ ταμίαν τῆς Παράλου καὶ δίχα τῆς το[ῦ] Ἄμμωνος.
And they also elect by hand-vote a treasurer of the Paralus, and separately one for the ship of Ammon.
