§12.18.1δεύτερος δὲ διωρθώθη νόμος ὁ διδοὺς ἐξουσίαν τῇ γυναικὶ ἀπολύειν τὸν ἄνδρα καὶ συνοικεῖν ᾧ ἂν βούληται.
Secondly, the law was revised which gave a wife the power to divorce her husband and remarry whomever she wished.
τῶν γὰρ προβεβηκότων τῇ ἡλικίᾳ τις, ἔχων γυναῖκα νεωτέραν καὶ καταλειφθείς, συνεβούλευε τοῖς Θουρίοις διορθῶσαι τὸν νόμον καὶ προσγράψαι τὴν καταλιποῦσαν ἄνδρα συνοικεῖν ᾧ ἂν βούληται μὴ νεωτέρῳ τοῦ προτέρου· ὁμοίως δὲ κἂν ἀνὴρ ἐκβάλῃ γυναῖκα, μὴ γαμεῖν ἄλλην νεωτέραν ταύτης τῆς ἐκβληθείσης.
For a certain man advanced in years, who had a younger wife and had been abandoned by her, advised the Thurians to revise the law and to add the provision that a woman who abandoned her husband could remarry whomever she wished, provided he was not younger than her former husband; and likewise, if a husband should cast out his wife, he should not marry another woman younger than the one who had been cast out.
§12.18.2εὐστοχήσας δʼ ἐν τῇ συμβουλίᾳ καὶ ἀκυρώσας τὸν πρότερον νόμον διέφυγε τὸν ἐκ τοῦ βρόχου κίνδυνον· τῆς δὲ γυναικὸς κωλυθείσης νεωτέρῳ συνοικῆσαι, πάλιν ἔγημε τὸν ἀπολυθέντα.
Having succeeded in his proposal and having invalidated the former law, he escaped the danger of the noose; and as the woman was prevented from marrying a younger man, she married again the husband from whom she had divorced.
§12.18.3τρίτος δὲ νόμος διωρθώθη ὁ περὶ τῶν ἐπικλήρων, ὁ καὶ παρὰ Σόλωνι κείμενος.
Thirdly, the law concerning heiresses was revised, which is also found in the legislation of Solon.
ἐκέλευε γὰρ τῇ ἐπικλήρῳ ἐπιδικάζεσθαι τὸν ἔγγιστα γένους, ὡσαύτως δὲ καὶ τὴν ἐπίκληρον ἐπιδικάζεσθαι τῷ ἀγχιστεῖ, ᾧ ἦν ἀνάγκη συνοικεῖν ἢ πεντακοσίας ἐκτῖσαι δραχμὰς εἰς προικὸς λόγον τῇ πενιχρᾷ ἐπικλήρῳ.
For it ordered the nearest of kin to claim the heiress in marriage, and likewise the heiress to claim the nearest of kin, who was obliged either to marry her or to pay five hundred drachmas as a dowry to the poor heiress.
§12.18.4ὀρφανὴ γάρ τις εὐγενὴς ἐπίκληρος, ἀπορουμένη παντελῶς τῶν κατὰ τὸν βίον καὶ διὰ τὴν πενίαν οὐ δυναμένη συνοικῆσαι, κατέφυγεν ἐπὶ τὸν δῆμον, καὶ μετὰ δακρύων ἐκθεμένη τὴν ἑαυτῆς ἐρημίαν τε καὶ καταφρόνησιν, πρὸς δὲ τούτοις ὑπογραψαμένη τὴν διόρθωσιν τοῦ νόμου, ὥστε ἀντὶ τῆς ἐκτίσεως τῶν πεντακοσίων δραχμῶν γράψαι συνοικεῖν κατʼ ἀνάγκην τὸν ἄγχιστα γένους τῇ ἐπιδικασθείσῃ ἐπικλήρῳ· τοῦ δὲ δήμου διὰ τὸν ἔλεον ψηφισαμένου διορθῶσαι τὸν νόμον, ἡ μὲν ὀρφανὴ τὸν ἐκ τοῦ βρόχου κίνδυνον ἐξέφυγεν, ὁ δʼ ἀγχιστεὺς πλούσιος ὢν ἠναγκάσθη γῆμαι γυναῖκα πενιχρὰν ἐπίκληρον ἄνευ προικός.
For a certain noble orphan heiress, being completely destitute of the means of life and unable to marry because of her poverty, fled to the people for help, and with tears set forth her own loneliness and the neglect she suffered, and in addition to this, proposed a revision of the law, to the effect that instead of the payment of the five hundred drachmas, it should be written that the nearest of kin must marry the adjudicated heiress; and when the people, out of pity, voted to revise the law, the orphan escaped the danger of the noose, while the nearest of kin, although he was wealthy, was compelled to marry a poor heiress without a dowry.
