§6.784ΑΘ. προσεχέτω δὴ καὶ ὁ νυμφίος τῇ τε νύμφῃ καὶ τῇ παιδοποιίᾳ τὸν νοῦν, κατὰ ταὐτὰ δὲ καὶ ἡ νύμφη, τοῦτον τὸν χρόνον διαφερόντως ὃν ἂν μήπω παῖδες αὐτοῖς ὦσιν γεγονότες.
ATH.: Let the bridegroom then pay attention to the bride and to the procreation of children, and in the same way the bride also, especially during this time in which children have not yet been born to them.
ἐπίσκοποι δʼ ἔστωσαν τούτων ἃς εἱλόμεθα γυναῖκες, πλείους εἴτʼ ἐλάττους, τοῖς ἄρχουσιν ὁπόσας ἂν δοκῇ προστάττειν τε καὶ ὁπόταν, πρὸς τὸ τῆς Εἰλειθυίας ἱερὸν ἑκάστης ἡμέρας συλλεγόμεναι μέχρι τρίτου μέρους ὥρας, οἷ δὴ συλλεχθεῖσαι διαγγελλόντων ἀλλήλαις εἴ τίς τινα ὁρᾷ πρὸς ἄλλʼ ἄττα βλέποντα ἄνδρα ἢ καὶ γυναῖκα τῶν παιδοποιουμένων ἢ πρὸς τὰ τεταγμένα ὑπὸ τῶν ἐν τοῖς γάμοις θυσιῶν τε καὶ ἱερῶν γενομένων.
And let the women whom we have chosen be supervisors of these matters, whether more or fewer, as many as and whenever it seems fit to the rulers to command; they shall assemble every day at the temple of Eileithyia for up to a third part of an hour. Meeting there, they shall report to one another if any of them sees any man or woman among those procreating children looking toward other matters, or contrary to what has been prescribed by the sacrifices and rites performed at marriages.
ἡ δὲ παιδοποιία καὶ φυλακὴ τῶν παιδοποιουμένων δεκέτις ἔστω, μὴ πλείω δὲ χρόνον, ὅταν εὔροια ᾖ τῆς γενέσεως·
And let the procreation of children and the supervision of those procreating last for ten years, and no longer, when there is a smooth flow of birth.
ἂν δὲ ἄγονοί τινες εἰς τοῦτον γίγνωνται τὸν χρόνον, μετὰ τῶν οἰκείων καὶ ἀρχουσῶν γυναικῶν διαζεύγνυσθαι κοινῇ βουλευομένους εἰς τὰ πρόσφορα ἑκατέροις.
But if some remain childless up to this time, they shall be separated after consulting in common with their relatives and the female supervisors, for what is suitable to each of them.
ἐὰν δʼ ἀμφισβήτησίς τις γίγνηται περὶ τῶν ἑκατέροις πρεπόντων καὶ προσφόρων, δέκα τῶν νομοφυλάκων ἑλομένους, οἷς ἂν ἐπιτρέψωσιν οἱ δὲ τάξωσι, τούτοις ἐμμένειν.
And if any dispute arises concerning what is proper and suitable for each, they shall choose ten of the guardians of the laws, and they must abide by whatever these men, to whom they have entrusted the matter, shall ordain.
εἰσιοῦσαι δʼ εἰς τὰς οἰκίας τῶν νέων αἱ γυναῖκες, τὰ μὲν νουθετοῦσαι, τὰ δὲ καὶ ἀπειλοῦσαι, παυόντων αὐτοὺς τῆς ἁμαρτίας καὶ ἀμαθίας· ἐὰν δʼ ἀδυνατῶσι, πρὸς τοὺς νομοφύλακας ἰοῦσαι φραζόντων, οἱ δʼ εἰργόντων.
The women, entering the houses of the young people, warning them in some cases and threatening them in others, shall stop them from their error and ignorance; and if they are unable to do so, they shall go and report to the guardians of the laws, and they shall restrain them.
ἂν δὲ καὶ ἐκεῖνοί πως ἀδυνατήσωσι, πρὸς τὸ δημόσιον ἀποφηνάντων, ἀναγράψαντές τε καὶ ὀμόσαντες ἦ μὴν ἀδυνατεῖν τὸν καὶ τὸν βελτίω ποιεῖν.
And if they also should somehow be unable, they shall declare it to the public, having registered and sworn that they are indeed unable to make so-and-so better.
ὁ δὲ ἀναγραφεὶς ἄτιμος ἔστω, μὴ ἑλὼν ἐν δικαστηρίῳ τοὺς ἐγγράψαντας, τῶνδε· μήτε γὰρ εἰς γάμους ἴτω μήτε εἰς τὰς τῶν παίδων ἐπιτελειώσεις, ἂν δὲ ἴῃ, πληγαῖς ὁ βουληθεὶς ἀθῷος αὐτὸν κολαζέτω.
And let the one who is registered be disenfranchised, unless he convicts in court those who registered him, in the following matters: he shall not go to marriages nor to the completion ceremonies of children, and if he does go, anyone who wishes may punish him with blows with impunity.
τὰ αὐτὰ δὲ καὶ περὶ γυναικὸς ἔστω νόμιμα· τῶν ἐξόδων γὰρ τῶν γυναικείων καὶ τιμῶν καὶ τῶν εἰς τοὺς γάμους καὶ γενέθλια τῶν παίδων φοιτήσεων μὴ μετεχέτω, ἐὰν ἀκοσμοῦσα ὡσαύτως ἀναγραφῇ καὶ μὴ ἕλῃ τὴν δίκην.
And let the same regulations apply to a woman; for let her not participate in women's public outings, honors, and visits to marriages and children's birthdays, if she is likewise registered for disorderly conduct and does not win the lawsuit.
ὅταν δὲ δὴ παῖδας γεννήσωνται κατὰ νόμους, ἐὰν ἀλλοτρίᾳ τις περὶ τὰ τοιαῦτα κοινωνῇ γυναικὶ ἢ γυνὴ ἀνδρί, ἐὰν μὲν παιδοποιουμένοις ἔτι, τὰ αὐτὰ ἐπιζήμια αὐτοῖς ἔστω καθάπερ τοῖς ἔτι γεννωμένοις εἴρηται·
And when indeed they have produced children according to the laws, if anyone has relations in such matters with another's wife, or a wife with another's husband, if they are still procreating children, let the same penalties be imposed on them as have been stated for those still producing.
§6.785ΑΘ. μετὰ δὲ ταῦτα ὁ μὲν σωφρονῶν καὶ σωφρονοῦσα εἰς τὰ τοιαῦτα ἔστω πάντα εὐδόκιμος, ὁ δὲ τοὐναντίον ἐναντίως τιμάσθω, μᾶλλον δὲ ἀτιμαζέσθω.
ATH.: But after these things, let the temperate man and woman be well-esteemed in all such matters, but let the opposite person be esteemed in the opposite way, or rather, be disenfranchised.
καὶ μετριαζόντων μὲν περὶ τὰ τοιαῦτα τῶν πλειόνων ἀνομοθέτητα σιγῇ κείσθω, ἀκοσμούντων δὲ νομοθετηθέντα ταύτῃ πραττέσθω κατὰ τοὺς τότε τεθέντας νόμους.
And if the majority are moderate in such matters, let them remain unlegislated and in silence; but if they are disorderly, let them be legislated and acted upon according to the laws enacted at that time.
βίου μὲν ἀρχὴ τοῦ παντὸς ἑκάστοις ὁ πρῶτος ἐνιαυτός· ὃν γεγράφθαι χρεὼν ἐν ἱεροῖσι πατρῴοις ζωῆς ἀρχή.
The beginning of the whole life for each person is the first year; which must be registered in the ancestral temples as the beginning of life.
κόρῳ καὶ κόρῃ παραγεγράφθω δʼ ἐν τοίχῳ λελευκωμένῳ ἐν πάσῃ φρατρίᾳ τὸν ἀριθμὸν τῶν ἀρχόντων τῶν ἐπὶ τοῖς ἔτεσιν ἀριθμουμένων· τῆς δὲ φρατρίας ἀεὶ τοὺς ζῶντας μὲν γεγράφθαι πλησίον, τοὺς δʼ ὑπεκχωροῦντας τοῦ βίου ἐξαλείφειν.
And for a boy and a girl, let there be registered on a whitened wall in every phratry the number of the rulers who are numbered by the years; and of the phratry let those who are living always be written near, and let those who depart from life be erased.
γάμου δὲ ὅρον εἶναι κόρῃ μὲν ἀπὸ ἑκκαίδεκα ἐτῶν εἰς εἴκοσι, τὸν μακρότατον χρόνον ἀφωρισμένον, κόρῳ δὲ ἀπὸ τριάκοντα μέχρι τῶν πέντε καὶ τριάκοντα· εἰς δὲ ἀρχὰς γυναικὶ μὲν τετταράκοντα, ἀνδρὶ δὲ τριάκοντα ἔτη· πρὸς πόλεμον δὲ ἀνδρὶ μὲν εἴκοσι μέχρι τῶν ἑξήκοντα ἐτῶν· γυναικὶ δέ, ἣν ἂν δοκῇ χρείαν δεῖν χρῆσθαι πρὸς τὰ πολεμικά, ἐπειδὰν παῖδας γεννήσῃ, τὸ δυνατὸν καὶ πρέπον ἑκάσταις προστάττειν μέχρι τῶν πεντήκοντα ἐτῶν.
And let the limit of marriage be for a girl from sixteen to twenty years, defined as the longest time, and for a boy from thirty to thirty-five; and for public offices, forty years for a woman, and thirty for a man; and for war, for a man from twenty to sixty years; and for a woman, when it seems necessary to employ her for military matters, after she has produced children, let there be enjoined what is possible and proper for each until fifty years of age.
