§10.909ΑΘ. ὡσαύτως δὲ καὶ τὸ θεοὺς νομίζον ἀμελεῖν δύʼ ἕτερα γεννᾷ, καὶ τὸ παραιτητοὺς ἄλλα δύο.
**ATH.**: "In the same way, the belief that gods exist but are neglectful produces two other classes, and the belief that they can be appeased produces another two.
τούτων δὴ ταύτῃ διεστηκότων, τοὺς μὲν ὑπʼ ἀνοίας ἄνευ κάκης ὀργῆς τε καὶ ἤθους γεγενημένους εἰς τὸ σωφρονιστήριον ὁ δικαστὴς τιθέμενος νόμῳ τιθέσθω μηδὲν ἔλαττον ἐτῶν πέντε, ἐν τούτῳ δὲ τῷ χρόνῳ μηδεὶς τῶν πολιτῶν αὐτοῖς ἄλλος συγγιγνέσθω πλὴν οἱ τοῦ νυκτερινοῦ συλλόγου κοινωνοῦντες, ἐπὶ νουθετήσει τε καὶ τῇ τῆς ψυχῆς σωτηρίᾳ ὁμιλοῦντες·
Since these are thus distinguished, those who have become so through foolishness, without a wicked temper or character, the judge, placing them in the reformatory in accordance with the law, shall place them there for not less than five years. During this time, let no other citizen associate with them, except those who share in the nocturnal council, conversing with them for their admonition and the salvation of their soul.
ὅταν δʼ ὁ χρόνος αὐτοῖς ἐξέλθῃ τῶν δεσμῶν, ἐὰν μὲν δοκῇ τις σωφρονεῖν αὐτῶν, οἰκείτω μετὰ τῶν σωφρόνων, ἐὰν δὲ μή, ὀφείλῃ δʼ αὖθις τὴν τοιαύτην δίκην, θανάτῳ ζημιούσθω.
And when their time of imprisonment has expired, if any of them seems to be reformed, let him dwell with the temperate, but if not, and if he is convicted again of such a charge, let him be punished with death.
ὅσοι δʼ ἂν θηριώδεις γένωνται πρὸς τῷ θεοὺς μὴ νομίζειν ἢ ἀμελεῖς ἢ παραιτητοὺς εἶναι, καταφρονοῦντες δὲ τῶν ἀνθρώπων ψυχαγωγῶσι μὲν πολλοὺς τῶν ζώντων, τοὺς δὲ τεθνεῶτας φάσκοντες ψυχαγωγεῖν καὶ θεοὺς ὑπισχνούμενοι πείθειν, ὡς θυσίαις τε καὶ εὐχαῖς καὶ ἐπῳδαῖς γοητεύοντες, ἰδιώτας τε καὶ ὅλας οἰκίας καὶ πόλεις χρημάτων χάριν ἐπιχειρῶσιν κατʼ ἄκρας ἐξαιρεῖν, τούτων δὲ ὃς ἂν ὀφλὼν εἶναι δόξῃ, τιμάτω τὸ δικαστήριον αὐτῷ κατὰ νόμον δεδέσθαι μὲν ἐν τῷ τῶν μεσογέων δεσμωτηρίῳ, προσιέναι δὲ αὐτοῖς μηδένα ἐλεύθερον μηδέποτε, τακτὴν δὲ ὑπὸ τῶν νομοφυλάκων αὐτοὺς τροφὴν παρὰ τῶν οἰκετῶν λαμβάνειν.
But as for those who have become like wild beasts, in addition to not believing in gods, or believing that they are neglectful or appeasable, and who, despising men, play upon the souls of many of the living, claiming also to conjure the dead and promising to persuade the gods, as if charming them with sacrifices, prayers, and incantations, and who attempt to utterly destroy individuals, whole houses, and cities for the sake of money—whosoever of these is judged to be guilty, let the court assess for him, in accordance with the law, that he be imprisoned in the prison of the inland, and that no free person ever approach them, and that they receive from the slaves a fixed portion of food appointed by the guardians of the laws.
ἀποθανόντα δὲ ἔξω τῶν ὁρίων ἐκβάλλειν ἄταφον· ἐὰν δέ τις ἐλεύθερος συνθάπτῃ, δίκας ἀσεβείας τῷ ἐθέλοντι λαγχάνειν ὑπεχέτω.
And when he dies, let him be cast out unburied beyond the borders; and if any free person joins in burying him, let him be liable to a charge of impiety to anyone who wishes to prosecute.
παῖδας δὲ ἂν μὲν καταλείπῃ τῇ πόλει ἱκανούς, οἱ τῶν ὀρφανῶν ἐπιμελούμενοι καὶ τούτων ὡς ὄντων ὀρφανῶν ἐπιμελείσθων μηδὲν χεῖρον τῶν ἄλλων ἀπὸ τῆς ἡμέρας ἧς ἂν ὁ πατὴρ αὐτῶν ὄφλῃ τὴν δίκην.
And if he leaves children sufficient for the state, let those who care for orphans care for these also as being orphans, no worse than the others, from the day on which their father is convicted.
κοινὸν δʼ ἐπὶ τούτοις πᾶσιν νόμον κεῖσθαι χρεών, ὃς ἐλάττω τε εἰς θεοὺς αὐτῶν τοὺς πολλοὺς ἔργῳ καὶ λόγῳ πλημμελεῖν ἂν ποιοῖ, καὶ δὴ καὶ ἀνοήτους ἧττον γίγνεσθαι, διὰ τὸ μὴ ἐξεῖναι θεοπολεῖν παρὰ νόμον.
And a common law should be established for all of them, which would make most of them commit fewer errors against the gods in deed and word, and indeed make them less foolish, because it is not permitted to practice private rites contrary to the law.
ἔστω γὰρ νόμος ὅδε τοῖς σύμπασιν κείμενος ἁπλῶς· Ἱερὰ μηδὲ εἷς ἐν ἰδίαις οἰκίαις ἐκτήσθω· θύειν δʼ ὅταν ἐπὶ νοῦν ἴῃ τινί, πρὸς τὰ δημόσια ἴτω θύσων, καὶ τοῖς ἱερεῦσί τε καὶ ἱερείαις ἐγχειριζέτω τὰ θύματα, οἷς ἁγνεῖαι τούτων ἐπιμελεῖς.
For let this law be established simply for all: 'No one shall possess shrines in private houses; and when anyone has a mind to sacrifice, let him go to the public places to sacrifice, and let him deliver the victims to the priests and priestesses, who are concerned with their purification.
συνευξάσθω δὲ αὐτός τε καὶ ὃν ἂν ἐθέλῃ μετʼ αὐτοῦ συνεύχεσθαι. §10.910ΑΘ.ταῦτα δὲ γιγνόμενα τῶν τοιῶνδε χάριν ἔστω. ἱερὰ καὶ θεοὺς οὐ ῥᾴδιον ἱδρύεσθαι, μεγάλης δὲ διανοίας τινὸς ὀρθῶς δρᾶν τὸ τοιοῦτον, ἔθος τε γυναιξί τε δὴ διαφερόντως πάσαις καὶ τοῖς ἀσθενοῦσι πάντῃ καὶ κινδυνεύουσι καὶ ἀποροῦσιν, ὅπῃ τις ἂν ἀπορῇ, καὶ τοὐναντίον ὅταν εὐπορίας τινὸς λάβωνται, καθιεροῦν τε τὸ παρὸν ἀεὶ καὶ θυσίας εὔχεσθαι καὶ ἱδρύσεις ὑπισχνεῖσθαι θεοῖς καὶ δαίμοσιν καὶ παισὶν θεῶν, ἔν τε φάσμασιν ἐγρηγορότας διὰ φόβους καὶ ἐν ὀνείροις, ὡς δʼ αὕτως ὄψεις πολλὰς ἀπομνημονεύοντας ἑκάσταισί τε αὐτῶν ἄκη ποιουμένους, βωμοὺς καὶ ἱερὰ πάσας μὲν οἰκίας, πάσας δὲ κώμας ἔν τε καθαροῖς ἱδρυομένους ἐμπιμπλάναι καὶ ὅπῃ τις ἔτυχε τῶν τοιούτων.
And let him pray himself, and anyone who wishes to pray with him.' "**ATH.**: "And let these things be done for the sake of the following: It is not easy to establish shrines and gods, and to do such a thing rightly requires a great mind; but it is the custom especially for all women and for those who are weak in any way, or in danger, or in distress, in whatever way one may be distressed, and conversely when they obtain some prosperity, to consecrate whatever is at hand, and to pray for sacrifices and promise the establishment of shrines to gods, spirits, and children of gods, both in waking visions due to fears and in dreams, and likewise remembering many sights and making remedies for each of them, to fill all houses and all villages with altars and shrines, establishing them both in clean places and wherever anyone happened to be.
ὧν ἕνεκα χρὴ πάντων ποιεῖν κατὰ τὸν νῦν λεγόμενον νόμον· πρὸς τούτοις δὲ ἕνεκα τῶν ἀσεβούντων, ἵνα μὴ καὶ ταῦτα κλέπτοντες ταῖς πράξεσιν, ἱερά τε καὶ βωμοὺς ἐν ἰδίαις οἰκίαις ἱδρυόμενοι, λάθρᾳ τοὺς θεοὺς ἵλεως οἰόμενοι ποιεῖν θυσίαις τε καὶ εὐχαῖς, εἰς ἄπειρον τὴν ἀδικίαν αὐξάνοντες αὑτοῖς τε ἐγκλήματα πρὸς θεῶν ποιῶνται καὶ τοῖς ἐπιτρέπουσιν, οὖσιν αὐτῶν βελτίοσιν, καὶ πᾶσα οὕτως ἡ πόλις ἀπολαύῃ τῶν ἀσεβῶν τρόπον τινὰ δικαίως.
For all these reasons, we must act according to the law now stated; and furthermore, for the sake of the impious, lest, stealing these things also in their practices, establishing shrines and altars in private houses, and thinking to make the gods propitious in secret by sacrifices and prayers, they increase their injustice to an infinite degree, and bring charges from the gods upon themselves and upon those who permit them, who are better than they, and so the whole city may reap the fruits of the impious in some way justly.
τὸν μὲν δὴ νομοθέτην ὁ θεὸς οὐ μέμψεται· κείσθω γὰρ νόμος οὗτος·
The legislator, indeed, will not be blamed by the god.
μὴ κεκτῆσθαι θεῶν ἐν ἰδίαις οἰκίαις ἱερά, τὸν δὲ φανέντα κεκτημένον ἕτερα καὶ ὀργιάζοντα πλὴν τὰ δημόσια, ἐὰν μὲν ἄδικον μηδὲν τῶν μεγάλων καὶ ἀνοσίων εἰργασμένος ἀνὴρ ἢ καὶ γυνὴ κεκτῆταί τις, ὁ μὲν αἰσθανόμενος καὶ εἰσαγγελλέτω τοῖς νομοφύλαξιν, οἱ δὲ προσταττόντων εἰς τὰ δημόσια ἀποφέρειν ἱερὰ τὰ ἴδια, μὴ πείθοντες δὲ ζημιούντων ἕως ἂν ἀπενεχθῇ·
Let this law be established: 'No one shall possess shrines of the gods in private houses; and if anyone is shown to possess others and to practice rites other than the public ones, if a man or a woman possesses them without having committed any great and unholy injustice, let anyone who perceives it report it to the guardians of the laws, and let them order them to carry their private shrines to the public ones, and if they do not obey, let them fine them until they are carried away.
ἐὰν δέ τις ἀσεβήσας μὴ παιδίων ἀλλʼ ἀνδρῶν ἀσέβημα ἀνοσίων γένηται φανερός, εἴτε ἐν ἰδίοις ἱδρυσάμενος εἴτʼ ἐν δημοσίοις θύσας ἱερὰ θεοῖς οἱστισινοῦν, ὡς οὐ καθαρὸς ὢν θύων θανάτῳ ζημιούσθω.
But if anyone is shown to have committed an act of impiety, not of children, but of unholy men, whether by establishing shrines in private or by sacrificing to any gods whatsoever in public, since he sacrifices not being pure, let him be punished with death.
τὸ δὲ παίδειον ἢ μὴ κρίναντες οἱ νομοφύλακες, εἰς τὸ δικαστήριον οὕτως εἰσαγαγόντες, τὴν τῆς ἀσεβείας δίκην τούτοις ἐπιτελούντων.
And the guardians of the laws, having judged whether it is childish or not, and thus bringing them before the court, let them execute the sentence of impiety on them.'"
