§14πρῶτον μὲν οὖν ἐπιβουλεύει μοι μετὰ τῶν ἀντιδίκων, καὶ πίστιν αὐτοῖς δίδωσιν· ἔπειτʼ ἀγώνων μοι συνεστηκότων πρὸς αὐτούς, τούς τε λόγους ἐκφέρει μου εἰδώς, καὶ ἐγγράφει τῷ δημοσίῳ ἀπρόσκλητον ἐξ ἐμφανῶν καταστάσεως ἐπιβολὴν ἑξακοσίας καὶ δέκα δραχμάς, διὰ Λυκίδου τοῦ μυλωθροῦ ποιησάμενος τὴν δίκην.
First of all, then, he plotted against me with my opponents in the lawsuits, and gave them pledges of faith; then, when I had lawsuits pending against them, knowing my arguments, he disclosed them, and registered against me in the public treasury, without any summons, a fine of six hundred and ten drachmae arising from a non-production of property, having brought the suit through Lycidas the miller.
κλητῆρα δὲ κατʼ ἐμοῦ τόν τε ἀδελφὸν τὸν αὑτοῦ τὸν Ἀρεθούσιον τοῦτον ἐπιγράφεται, οὗπέρ ἐστιν τὰ ἀνδράποδα ταῦτα, καὶ ἄλλον τινά· καὶ παρεσκευάζοντο, εἰ ἀνακρινοίμην κατὰ τῶν οἰκείων τῶν ἀδικούντων με τὰς δίκας ἃς εἰλήχειν αὐτοῖς, ἐνδεικνύναι με ὡς ὀφείλοντα τῷ δημοσίῳ καὶ ἐμβάλλειν εἰς τὸ δεσμωτήριον.
And as witnesses to the summons against me he registered his own brother, this Arethusius, to whom these slaves belong, and another person; and they were prepared, if I should attend the preliminary hearing of the suits which I had brought against their relatives who were injuring me, to denounce me as a debtor to the state and throw me into prison.
§15ἔτι δὲ πρὸς τούτοις ὁ ἀπρόσκλητόν μου ἑξακοσίων καὶ δέκα δραχμῶν δίκην καταδικασάμενος καὶ ψευδεῖς κλητῆρας ἐπιγραψάμενος, εἰσελθὼν εἰς τὴν οἰκίαν βίᾳ τὰ σκεύη πάντα ἐξεφόρησεν, πλέον ἢ εἴκοσι μνῶν ἄξια, καὶ οὐδʼ ὁτιοῦν κατέλιπεν.
In addition to this, the man who had obtained this judgement of six hundred and ten drachmae against me without summons, having registered false witnesses to the summons, entered my house by force and carried off all my furniture, worth more than twenty minae, leaving absolutely nothing.
ὅτε δὲ τιμωρεῖσθαι ᾤμην δεῖν, καὶ ἐκτείσας τῷ δημοσίῳ τὸ ὄφλημα, ἐπειδὴ ἐπυθόμην τὴν ἐπιβουλήν, ἐβάδιζον ἐπὶ τὸν κλητῆρα τὸν ὁμολογοῦντα κεκλητευκέναι, τὸν Ἀρεθούσιον, τῆς ψευδοκλητείας κατὰ τὸν νόμον, ἐλθὼν εἰς τὸ χωρίον τῆς νυκτός, ὅσα ἐνῆν φυτὰ ἀκροδρύων γενναῖα ἐμβεβλημένα καὶ τὰς ἀναδενδράδας ἐξέκοψε, καὶ φυτευτήρια ἐλαῶν περιστοίχων κατέκλασεν, οὕτως δεινῶς ὡς οὐδʼ ἂν οἱ πολέμιοι διαθεῖεν.
When I thought I ought to take vengeance, and, after paying the debt to the treasury because I had found out their plot, was proceeding against the witness who acknowledged having served the summons, namely Arethusius, for false summons according to the law, he came to my land by night, cut down all the fine grafted fruit trees that were there and the climbing vines, and broke down the nursery plants of the olive trees planted in rows, in so devastating a manner as not even enemies would have done.
§16πρὸς δὲ τούτοις μεθʼ ἡμέραν παιδάριον ἀστὸν εἰσπέμψαντες διὰ τὸ γείτονες εἶναι καὶ ὅμορον τὸ χωρίον, ἐκέλευον τὴν ῥοδωνιὰν βλαστάνουσαν ἐκτίλλειν, ἵνα, εἰ καταλαβὼν αὐτὸν ἐγὼ δήσαιμι ἢ κατάξαιμι ὡς δοῦλον ὄντα, γραφήν με γράψαιντο ὕβρεως.
In addition to this, by day, since they were neighbors and the land was adjacent, they sent in a free-born boy and ordered him to tear up my budding rose-garden, so that, if I caught him and bound him or struck him down, thinking him to be a slave, they might bring a public prosecution for outrage against me.
ὡς δὲ τούτου διήμαρτον, καὶ ἐγὼ μάρτυρας μὲν ὧν ἔπασχον ἐποιούμην, αὐτὸς δὲ οὐδὲν ἐξημάρτανον εἰς αὐτούς, ἐνταῦθα ἤδη μοι ἐπιβουλεύουσι τὴν μεγίστην ἐπιβουλήν· §17ἀνακεκριμένου γὰρ ἤδη μου κατʼ αὐτοῦ τὴν τῆς ψευδοκλητείας γραφὴν καὶ μέλλοντος εἰσιέναι εἰς τὸ δικαστήριον, τηρήσας με ἀνιόντα ἐκ Πειραιῶς ὀψὲ περὶ τὰς λιθοτομίας παίει τε πὺξ καὶ ἁρπάζει μέσον καὶ ἐώθει με εἰς τὰς λιθοτομίας, εἰ μή τινες προσιόντες, βοῶντός μου ἀκούσαντες, παρεγένοντο καὶ ἐβοήθησαν.
But when they failed in this, and while I called witnesses to what I was suffering, but committed no offense against them, then at last they plotted against me the greatest plot of all: for when I had already held the preliminary hearing against him in the public prosecution for false summons and was about to enter the court, he watched for me as I was coming up from Peiraeus late in the evening near the stone-quarries, struck me with his fist, seized me by the waist, and was pushing me into the quarries, and would have done so had not some people who were coming along, hearing me cry out, run up and helped me.
ἡμέραις δὲ οὐ πολλαῖς ὕστερον εἰσελθὼν εἰς τὸ δικαστήριον πρὸς ἡμέραν διαμεμετρημένην, καὶ ἐξελέγξας αὐτὸν τὰ ψευδῆ κεκλητευκότα καὶ τὰ ἄλλα ὅσα εἴρηκα ἠδικηκότα, εἷλον.
A few days later, I entered the court for a trial where the time was measured by the day-water-clock, and having proved that he had served a false summons and committed all the other wrongs I have mentioned, I convicted him.
§18καὶ ἐν τῇ τιμήσει βουλομένων τῶν δικαστῶν θανάτου τιμῆσαι αὐτῷ, ἐδεήθην ἐγὼ τῶν δικαστῶν μηδὲν διʼ ἐμοῦ τοιοῦτον πρᾶξαι, ἀλλὰ συνεχώρησα ὅσουπερ αὐτοὶ ἐτιμῶντο, ταλάντου, οὐχ ἵνα μὴ ἀποθάνῃ ὁ Ἀρεθούσιος (ἄξια γὰρ αὐτῷ θανάτου εἴργαστο εἰς ἐμέ), ἀλλʼ ἵνα ἐγὼ Πασίωνος ὢν καὶ κατὰ ψήφισμα πολίτης μηδένα Ἀθηναίων ἀπεκτονὼς εἴην.
And in assessing the penalty, when the jurors wished to sentence him to death, I begged them to do no such thing on my account, but agreed to the penalty which they themselves assessed, namely, one talent; not that I wished Arethusius to escape death (for his conduct toward me deserved death), but because I, being the son of Pasion and a citizen by decree, did not want to have been the cause of the death of any Athenian.
ὡς δʼ ἀληθῆ εἴρηκα πρὸς ὑμᾶς, τούτων ὑμῖν πάντων τοὺς μάρτυρας παρέξομαι. ΜΑΡΤΥΡΕΣ. §19ἃ μὲν τοίνυν ἀδικούμενος, ὦ ἄνδρες δικασταί, ὑπʼ αὐτῶν τὴν ἀπογραφὴν ἐποιησάμην, δεδήλωκα ὑμῖν· ὡς δʼ ἔστιν Ἀρεθουσίου τὰ ἀνδράποδα ταῦτα καὶ ὄντα ἐν τῇ οὐσίᾳ τῇ ἐκείνου ἀπέγραψα, ἐπιδείξω ὑμῖν.
And to prove that I am speaking the truth, I will present to you witnesses to all these facts. [WITNESSES] The wrongs, then, men of the jury, which I suffered at their hands, and which led me to make the registration of the property, I have made clear to you; and that these slaves belong to Arethusius, and that I registered them as being part of his property, I will now demonstrate to you.
τὸν μὲν γὰρ Κέρδωνα ἐκ μικροῦ παιδαρίου ἐξεθρέψατο· καὶ ὡς ἦν Ἀρεθουσίου, τούτων ὑμῖν τοὺς εἰδότας μάρτυρας παρέξομαι. ΜΑΡΤΥΡΕΣ. §20παρʼ οἷς τοίνυν ἠργάσατο πώποτε, ὡς τοὺς μισθοὺς Ἀρεθούσιος ἐκομίζετο ὑπὲρ αὐτοῦ, καὶ δίκας ἐλάμβανε καὶ ἐδίδου, ὁπότε κακόν τι ἐργάσαιτο, ὡς δεσπότης ὤν, τούτων ὑμῖν τοὺς εἰδότας μάρτυρας παρέξομαι. ΜΑΡΤΥΡΕΣ.
τὸν δὲ Μάνην, δανείσας ἀργύριον Ἀρχεπόλιδι τῷ Πειραιεῖ, ἐπειδὴ οὐχ οἷός τʼ ἦν αὐτῷ ἀποδοῦναι ὁ Ἀρχέπολις οὔτε τὸν τόκον οὔτε τὸ ἀρχαῖον ἅπαν, ἐναπετίμησεν αὐτῷ.
For he brought up Cerdon from a little child; and to prove that Cerdon belonged to Arethusius, I will present to you witnesses who know the facts. [WITNESSES] Moreover, I will present to you witnesses who know the facts, showing that, wherever Cerdon ever worked, Arethusius received his wages on his behalf, and that he received and paid damages, whenever Cerdon committed any wrong, as being his master. [WITNESSES] And as for Manes, Arethusius, having lent money to Archepolis of Peiraeus, when Archepolis was unable to pay him either the interest or any of the principal, took Manes from him as payment.
καὶ ὅτι ἀληθῆ λέγω, τούτων ὑμῖν τοὺς μάρτυρας παρέξομαι. ΜΑΡΤΥΡΕΣ.
