§8τὸ δὲ τέλος ὃ ἐγένετο, τοῦθʼ ὑμᾶς ἀναγκαίως ἔχει ἀκοῦσαι.
As for the end which came about, you must of necessity hear this.
αὐτὸς γὰρ ἐγὼ ἐδίκασα τούτῳ καὶ οὗτος ἐμοὶ τὰ ἡμίσεα ἑκάτερον ἡμῶν λαβεῖν ὧν κατέλιπε Κόμων, καὶ μηδεμίαν ἀηδίαν εἶναι περαιτέρω.
For I myself decided between him and me, and he between me and him, that each of us should take half of what Comon left, and that there should be no further unpleasantness.
καὶ προειλόμην, ὦ ἄνδρες δικασταί, ἑκὼν μεταδοῦναι τούτῳ μᾶλλον ἢ εἰς δικαστήριον εἰσιὼν κινδυνεύειν πρὸς οἰκεῖον ὄντα τοῦτον καὶ εἰπεῖν τι ἀηδές, ἀδελφὸν ὄντα τῆς ἐμῆς γυναικὸς καὶ θεῖον τῶν ἐμῶν παίδων, καὶ ὑπὸ τούτου ἀκοῦσαί τι ἀνεπιτήδειον.
And I preferred, gentlemen of the jury, willingly to share with him rather than to run the risk of going to court against this man who is a relative, and saying something unpleasant—he being my wife's brother and my children's uncle—and hearing from him something disagreeable.
§9ταῦτα πάντα ἐνθυμούμενος συνεχώρησα αὐτῷ.
Reflecting on all these things, I yielded to him.
καὶ μετὰ ταῦτα συνθήκας ἐγράψαμεν πρὸς ἡμᾶς αὐτοὺς περὶ ἁπάντων, καὶ ὅρκους ἰσχυροὺς ὠμόσαμεν ἀλλήλοις, ἦ μὴν τά τε ὑπάρχοντα φανερὰ ὄντα καλῶς καὶ δικαίως διαιρήσεσθαι καὶ μηδʼ ὁτιοῦν πλεονεκτήσειν τὸν ἕτερον τοῦ ἑτέρου ὧν κατέλιπεν Κόμων, καὶ τἄλλα πάντα κοινῇ ζητήσειν, καὶ πράξειν μετʼ ἀλλήλων βουλευόμενοι ὅ τι ἂν ἀεὶ δέῃ.
And after this we drew up a written agreement between ourselves concerning all matters, and swore solemn oaths to one another, that we would indeed divide the visible assets fairly and justly, and that neither of us would take any advantage over the other of what Comon left behind, and that we would seek all other matters in common, and act in consultation with each other in whatever might be necessary from time to time.
§10ὑπενοοῦμεν γάρ, ὦ ἄνδρες δικασταί, ἥξειν τινὰς ἀμφισβητήσοντας τῶν τοῦ Κόμωνος καὶ ἑτέρους· οἷον καὶ ὁ ἐμὸς ἀδελφὸς ὁ ὁμοπάτριος, ὁμομήτριος δʼ οὔ, ὃς ἀπεδήμει, καὶ εἰ δή τις ἄλλος ἐβούλετʼ ἀμφισβητεῖν, οὐκ ἦν ἡμῖν κωλύειν· οἱ γὰρ νόμοι κελεύουσι τὸν βουλόμενον ἀμφισβητεῖν.
For we suspected, gentlemen of the jury, that others also would come to claim a share of Comon's property; for example, my own brother by the same father, though not by the same mother, who was abroad, and if indeed anyone else wished to make a claim, it was not in our power to prevent them; for the laws permit anyone who wishes to make a claim.
ταῦτα δὴ πάντα προνοούμενοι ἐγράψαμεν τὰς συνθήκας καὶ ὅρκους ὠμόσαμεν, ὅπως ἂν μήτε ἑκόντι μήτε ἄκοντι μηδετέρῳ ἐξουσία ἡμῶν γένηται μηδʼ ὁτιοῦν ἰδίᾳ πρᾶξαι, ἀλλὰ κοινῇ βουλευόμενοι μεθʼ ἡμῶν αὐτῶν ἅπαντα πράττωμεν.
Foreseeing all these things, we drew up the agreement and swore oaths, so that neither of us, whether willingly or unwillingly, should have the power to do anything at all privately, but that we should do everything in common, consulting with one another.
§11καὶ μάρτυρας ἐποιησάμεθα περὶ τούτων πρῶτον μὲν τοὺς θεοὺς οὓς ὠμόσαμεν ἀλλήλοις, καὶ τοὺς οἰκείους τοὺς ἡμετέρους αὐτῶν, ἔπειτʼ Ἀνδροκλείδην Ἀχαρνέα, παρʼ ᾧ κατεθέμεθα τὰς συνθήκας.
And we made witnesses of these things, first the gods by whom we swore to one another, and our own relatives, and then Androclides of Acharnae, with whom we deposited the agreement.
βούλομαι οὖν, ὦ ἄνδρες δικασταί, τόν τε νόμον ἀναγνῶναι, καθʼ ὃν τὰς συνθήκας ἐγράψαμεν πρὸς ἡμᾶς αὐτούς, καὶ μαρτυρίαν τοῦ ἔχοντος τὰς συνθήκας.
I wish, therefore, gentlemen of the jury, that the law according to which we drew up the agreement between ourselves, and the testimony of the one who holds the agreement, be read.

§12ἐπειδὴ δὲ ὠμόσαμεν ἀλλήλοις καὶ αἱ συνθῆκαι ἦσαν κείμεναι παρὰ τῷ Ἀνδροκλείδῃ, διεῖλον ἐγὼ δύο μερίδας, ὦ ἄνδρες δικασταί.
When we had sworn to one another and the agreement was deposited with Androclides, I divided the property into two shares, gentlemen of the jury.
καὶ ἡ μὲν ἑτέρα ἦν μερὶς ἡ οἰκία ἐν ᾗ ᾤκει αὐτὸς ὁ Κόμων, καὶ τἀνδράποδα οἱ σακχυφάνται, ἡ δʼ ἑτέρα ἦν μερὶς οἰκία ἑτέρα καὶ τἀνδράποδα οἱ φαρμακοτρίβαι.
One share was the house in which Comon himself lived, and the slaves who were sack-weavers; the other share was another house and the slaves who were drug-grinders.
ἀργύριον δὲ εἴ τι κατέλιπεν ὁ Κόμων φανερὸν ἐπὶ τῇ τραπέζῃ τῇ Ἡρακλείδου, τοῦθʼ ἅπαν σχεδόν τι ἀνηλώθη εἴς τε τὴν ταφὴν καὶ τἄλλα τὰ νομιζόμενα καὶ εἰς τὴν οἰκοδομίαν τοῦ μνήματος.
As for any money that Comon left visible at the bank of Heraclides, almost all of this was spent on the funeral, the other customary rites, and the building of the tomb.
§13διελὼν δʼ ἐγὼ τὰς δύο ταύτας μερίδας, ἔδωκα αἵρεσιν τουτῳὶ Ὀλυμπιοδώρῳ ὁποτέραν βούλεται τῶν μερίδων λαβεῖν, καὶ οὗτος εἵλετο τοὺς φαρμακοτρίβας καὶ τὴν οἰκίσκην· ἐγὼ δʼ ἔλαβον τοὺς σακχυφάντας καὶ τὴν οἰκίαν τὴν ἑτέραν.
Having divided these into two shares, I gave this Olympiodorus here his choice of whichever of the shares he wished to take, and he chose the drug-grinders and the small house; and I took the sack-weavers and the other house.
καὶ ταῦτʼ ἔστιν ἃ ἑκάτερος ἡμῶν εἶχεν.
And these are the things which each of us held.
§14ἐν δὲ τῇ μερίδι τῇ τουτουὶ Ὀλυμπιοδώρου ἦν εἷς τῶν φαρμακοτριβῶν, ὃν μάλιστα ἐνόμιζεν πιστὸν ἑαυτῷ εἶναι ὁ Κόμων· ὄνομα δὲ τῷ ἀνθρώπῳ ἐστὶν Μοσχίων.
In the share of this Olympiodorus here was one of the drug-grinders, whom Comon considered to be most faithful to himself; the man's name is Moschion.
οὗτος ὁ οἰκέτης σχεδόν τι ᾔδει τά τε ἄλλα τὰ τοῦ Κόμωνος ἅπαντα, καὶ δὴ τὸ ἀργύριον οὗ ἦν, τὸ ἔνδον κείμενον τῷ Κόμωνι.
This servant knew almost everything else of Comon's affairs, and indeed where the money was, which was kept inside by Comon.
§15καὶ δὴ καὶ ἔλαθεν τὸν Κόμωνα, πρεσβύτερόν τε ὄντα καὶ πεπιστευκότα αὐτῷ, ὑφαιρούμενος τὸ ἀργύριον οὗτος ὁ οἰκέτης ὁ Μοσχίων.
And indeed, without the knowledge of Comon, who was elderly and had trusted him, this servant Moschion secretly stole the money.
καὶ πρῶτον μὲν ὑφαιρεῖται αὐτοῦ χιλίας δραχμὰς χωρίς που κειμένας τοῦ ἄλλου ἀργυρίου, ἔπειτα ἑτέρας ἑβδομήκοντα μνᾶς.
First, he stole a thousand drachmae which were lying somewhere apart from the rest of the money, and then another seventy minae.
καὶ ταῦτα ποιῶν ἐλάνθανεν τὸν Κόμωνα.
And in doing this, he escaped the notice of Comon.
καὶ τὸ ἀργύριον τοῦτο ἅπαν εἶχεν αὐτὸς διʼ ἑαυτοῦ ὁ ἄνθρωπος.
And this man kept all this money to himself.
