§51Ἀνδροκλείδης δὲ οὑτοσὶ πάρεστιν.
Androcleides here is present.
ἐγὼ γὰρ αὐτῷ ἐπήγγειλα ἥκειν ἔχοντι τὰς συνθήκας.
For I summoned him to come with the agreement.
καὶ συγχωρῶ, ὦ ἄνδρες δικασταί, ἐν τῷ τούτου λόγῳ ἢ ἐν τῷ προτέρῳ ἢ ἐν τῷ ὑστέρῳ ἀνοιχθῆναι· οὐδὲν γάρ μοι διαφέρει.
And I agree, gentlemen of the jury, that it be opened either in his speech, or in the former, or in the latter speech; for it makes no difference to me.
ὑμᾶς δὲ βούλομαι ἀκοῦσαι τὰς συνθήκας καὶ τοὺς ὅρκους, οὓς ὠμόσαμεν ἀλλήλοις ἐγὼ καὶ Ὀλυμπιόδωρος οὑτοσί.
But I wish you to hear the agreement and the oaths which we swore to one another, I and Olympiodorus here.
καὶ εἰ μὲν συγχωρεῖ, ἔστω ταῦτα, καὶ ὑμεῖς ἀκούετε, ἐπειδὰν τούτῳ δοκῇ· ἐὰν δὲ μὴ ʼθέλῃ ταῦτα ποιεῖν, οὐκ ἤδη καταφανὴς ἔσται, ὦ ἄνδρες δικασταί, ὅτι ἀναισχυντότατός ἐστιν ἀνθρώπων ἁπάντων, καὶ δικαίως οὐδʼ ἂν ὁτιοῦν ἀποδέχοισθε τούτου ὡς ὑγιές τι λέγοντος;
And if he agrees, let it be so, and you hear them whenever it pleases him; but if he is unwilling to do this, will it not at once be clear, gentlemen of the jury, that he is the most shameless of all men, and that you would justly not accept anything from him on the ground that he is speaking anything sound?
§52ἀλλὰ τί ταῦτα σπουδάζω;
But why do I trouble myself about this?
οὐδὲ γὰρ αὐτὸς ἀγνοεῖ ταῦτα οὗτος, ὅτι ἀδικεῖ μὲν ἐμέ, ἀδικεῖ δὲ τοὺς θεοὺς οὓς ὤμοσεν, καὶ ἐπιορκεῖ.
For this man himself is not ignorant of these things, that he is wronging me, and wronging the gods by whom he swore, and is committing perjury.
ἀλλὰ διέφθαρται, ὦ ἄνδρες δικασταί, καὶ παραφρονεῖ.
But he is corrupted, gentlemen of the jury, and is out of his mind.
ἀνιῶμαι μὲν οὖν καὶ αἰσχύνομαι, ὦ ἄνδρες δικασταί, οἷς μέλλω λέγειν πρὸς ὑμᾶς, ἐξ ἀνάγκης δέ μοί ἐστιν εἰπεῖν, ὅπως ἂν ὑμεῖς οἱ τὴν ψῆφον ἔχοντες ἀκούσαντες ἅπαντα, βουλεύσησθε ὅ τι ἂν ὑμῖν δοκῇ βέλτιστον εἶναι περὶ ἡμῶν.
Now I am pained and ashamed, gentlemen of the jury, at what I am about to tell you, but it is necessary for me to speak, in order that you who hold the vote, having heard everything, may deliberate whatever seems best to you concerning us.
§53ὧν δὲ μέλλω λέγειν, οὗτος αἴτιός ἐστιν οὐκ ἐθέλων ἐν τοῖς οἰκείοις περὶ τούτων πρός με διαλύσασθαι, ἀλλʼ ἀναισχυντῶν.
For the things I am about to tell, this man is responsible, since he was unwilling to settle these matters with me among relatives, but acted shamelessly.
Ὀλυμπιόδωρος γὰρ οὑτοσί, ὦ ἄνδρες δικασταί, γυναῖκα μὲν ἀστὴν κατὰ τοὺς νόμους τοὺς ὑμετέρους οὐδεπώποτε ἔγημεν, οὐδʼ εἰσὶν αὐτῷ παῖδες οὐδὲ ἐγένοντο, ἑταίραν δὲ λυσάμενος ἔνδον ἔχει, καὶ αὕτη ἐστὶν ἡ λυμαινομένη ἅπαντας ἡμᾶς καὶ ποιοῦσα τουτονὶ περαιτέρω μαίνεσθαι.
For Olympiodorus here, gentlemen of the jury, never married a citizen woman according to your laws, nor does he have children, nor did any ever born to him, but having ransomed a courtesan, he keeps her inside, and she is the one who is ruining all of us and making this man rage beyond measure.
§54πῶς γὰρ οὐ μαίνεται ὅστις οἴεται δεῖν, ἃ μὲν ὡμολόγησεν καὶ συνέθετο ἑκὼν πρὸς ἑκόντα καὶ ὤμοσεν, τούτων μὲν μηδʼ ὁτιοῦν ποιεῖν, καὶ ταῦτα ἐμοῦ σπουδάζοντος οὐχ ὑπὲρ ἐμαυτοῦ μόνον, ἀλλὰ καὶ ὑπὲρ τῆς τούτου ἀδελφῆς τῆς ὁμοπατρίας καὶ ὁμομητρίας, ἣ ἐμοὶ συνοικεῖ, καὶ ὑπὲρ τῆς τούτου ἀδελφιδῆς, θυγατρὸς δὲ ἐμῆς;
For how is he not mad, who thinks he ought to do not a single one of the things which he agreed and contracted willingly with a willing party and swore to, and that too when I am concerned not only on my own behalf, but also on behalf of his sister by the same father and same mother, who lives with me, and on behalf of his niece, who is my daughter?
αὗται γάρ εἰσιν αἱ ἀδικούμεναι οὐχ ἧττον ἐμοῦ, ἀλλὰ καὶ μᾶλλον.
For these are the ones who are wronged no less than I, but even more.
§55πῶς γὰρ οὐκ ἀδικοῦνται ἢ πῶς οὐ δεινὰ πάσχουσιν, ἐπειδὰν ὁρῶσι τὴν μὲν τούτου ἑταίραν περαιτέρω τοῦ καλῶς ἔχοντος καὶ χρυσία πολλὰ ἔχουσαν καὶ ἱμάτια καλά, καὶ ἐξόδους λαμπρὰς ἐξιοῦσαν, καὶ ὑβρίζουσαν ἐκ τῶν ἡμετέρων, αὐταὶ δὲ καταδεεστέρως περὶ ταῦτα ἔχωσιν ἅπαντα, πῶς οὐκ ἐκεῖναι μᾶλλον ἔτι ἀδικοῦνται ἢ ἐγώ;
For how are they not wronged, or how do they not suffer dreadful things, when they see this man's courtesan possessing much gold and fine clothes beyond what is proper, and going out in splendid processions, and insulting us at our expense, while they themselves are in a far inferior position regarding all these things? How are they not even more wronged than I?
οὗτος δὲ πῶς οὐ καταφανῶς μαίνεται καὶ παραφρονεῖ, τοιαῦτα περὶ αὑτοῦ βουλευόμενος;
And how is he not clearly mad and out of his mind, taking such counsel concerning himself?
ἵνα δὲ μὴ φάσκῃ, ὦ ἄνδρες δικασταί, ἐπὶ διαβολῇ ταῦτα λέγειν με τοῦ ἀγῶνος ἕνεκα τουτουί, μαρτυρίαν ὑμῖν ἀναγνώσεται τῶν τούτου οἰκείων καὶ ἐμῶν.
And lest he claim, gentlemen of the jury, that I say these things for the purpose of slander for the sake of this trial, the clerk shall read to you the testimony of his relatives and mine.

§56Ὀλυμπιόδωρος μὲν οὑτοσὶ τοιοῦτός ἐστιν ἄνθρωπος, οὐ μόνον ἄδικος, ἀλλὰ καὶ μελαγχολᾶν δοκῶν ἅπασιν τοῖς οἰκείοις καὶ τοῖς γνωρίμοις τῇ προαιρέσει τοῦ βίου, καὶ ὅπερ Σόλων ὁ νομοθέτης λέγει, παραφρονῶν ὡς οὐδεὶς πώποτε παρεφρόνησεν ἀνθρώπων, γυναικὶ πειθόμενος πόρνῃ.
Olympiodorus here is such a man, not only unjust, but also appearing to all his relatives and acquaintances to be mad by his choice of life, and, as Solon the lawgiver says, being out of his mind as no man ever was out of his mind, obeying a prostitute woman.
καὶ ἄκυρά γε ταῦτα πάντα ἐνομοθέτησεν εἶναι ὁ Σόλων, ὅ τι ἄν τις γυναικὶ πειθόμενος πράττῃ, ἄλλως τε καὶ τοιαύτῃ.
And Solon indeed legislated that all these things are invalid, whatever anyone does obeying a woman, especially such a woman.
§57περὶ μὲν οὖν τούτων καλῶς ὁ νομοθέτης ἐπεμελήθη, ἐγὼ δὲ ὑμῶν δέομαι, καὶ οὐ μόνον ἐγώ, ἀλλὰ καὶ ἡ ἐμὴ γυνή, Ὀλυμπιοδώρου δὲ τουτουὶ ἀδελφή, καὶ ἡ θυγάτηρ ἡ ἐμή, Ὀλυμπιοδώρου δὲ τουτουὶ ἀδελφιδῆ, ἱκετεύομεν ὑμᾶς καὶ ἀντιβολοῦμεν, ὦ ἄνδρες δικασταί, ἅπαντες ἡμεῖς (νομίσατε γὰρ ἐκείνας ἐνθάδε παρεῖναι) §58μάλιστα μὲν τουτονὶ Ὀλυμπιόδωρον πεῖσαι μὴ ἀδικεῖν ἡμᾶς, ἐὰν δʼ ἄρα μὴ ʼθέλῃ πείθεσθαι, ὑμᾶς μεμνημένους ἁπάντων τῶν εἰρημένων ψηφίζεσθαι ὅ τι ἂν ὑμῖν δοκῇ βέλτιστον καὶ δικαιότατον εἶναι.
Concerning these things, then, the lawgiver made excellent provision, but I beg of you, and not only I, but also my wife, who is the sister of Olympiodorus here, and my daughter, who is the niece of Olympiodorus here, we all entreat and implore you, gentlemen of the jury—for you must consider that those women are present here— above all, to persuade Olympiodorus here not to wrong us, but if, after all, he is unwilling to be persuaded, that you, remembering all that has been said, vote whatever seems to you to be best and most just.
καὶ ταῦτα ποιοῦντες τά τε δίκαια γνώσεσθε καὶ τὰ συμφέροντα ἡμῖν ἅπασιν, οὐχ ἥκιστα δὲ Ὀλυμπιοδώρῳ αὐτῷ τουτῳί.
And in doing this, you will decide what is just and what is advantageous for all of us, and not least for Olympiodorus himself here.
