Demosthenes · Against Olympiodorus §43-50

Explanation of Past Silence and Demand to Open Agreement

Passage 6 of 7 · Greek

Summary

The plaintiff explains that he co-operated and remained silent during the previous trial because he was acting in common with Olympiodorus, exposes the opponent's refusal to disclose the agreement, and demands that the agreement be opened in court.

§43ἔτι πρὸς τούτοις ἡγεῖ ἄν μʼ ἐπιτρέπειν σοι, Ὀλυμπιόδωρε, ἐν τῷ τελευταίῳ ἀγῶνι τῷ περὶ τοῦ κλήρου, ἢ ἃ ἔλεγες πρὸς τοὺς δικαστάς, εἰκῇ οὑτωσὶ λέγειν, ἢ περὶ ὧν τὰς μαρτυρίας παρέσχου, οὕτως ἂν παρασχέσθαι, εἰ μὴ μετὰ σοῦ κοινῇ συνηγωνιζόμην;
In addition to this, Olympiodorus, do you think that in the final contest concerning the estate, I would have allowed you either to speak as you did at random before the judges, or to produce testimonies as you did concerning those matters, if I had not been fighting in common with you?
For this man, gentlemen of the jury, spoke whatever he pleased in the court, and asserted to the judges that I had rented from him the house which I received as my share, and that I had borrowed from him the money which I received, the half of the thousand drachmae from the slave.
And he not only said this, but also produced testimonies to these things.
And I did not oppose them in any way, nor did any human being hear a word from me, either small or great, when this man was conducting his case, but I fully admitted that everything this man wished to say was true.
For I was fighting in common with you, as seemed best to you and me.
§45ἐπεὶ εἰ μή ἐστιν ταῦτα ἀληθῆ ἃ λέγω, διὰ τί οὐκ ἐπεσκηψάμην ἐγὼ τότε τοῖς μάρτυσιν τοῖς ταῦτα μαρτυροῦσιν, ἀλλʼ ἡσυχίαν εἶχον πολλήν;
Since, if the things I say are not true, why did I not then prosecute the witnesses who testified to these things, but kept perfectly quiet?
ἢ διὰ τί σύ, Ὀλυμπιόδωρε, οὐδεπώποτέ μοι ἔλαχες ἐνοικίου δίκην τῆς οἰκίας ἧς ἔφασκες μισθῶσαί μοι ὡς σαυτοῦ οὖσαν, οὐδὲ τοῦ ἀργυρίου οὗ ἔλεγες πρὸς τοὺς δικαστὰς ὅτι ἐδάνεισάς μοι, τούτων οὐδὲν ἐποίησας;
Or why did you, Olympiodorus, never bring a suit against me for the rent of the house which you claimed to have rented to me as your own, nor do anything regarding the money which you told the judges you had lent to me?
ὥστε πῶς ἂν μᾶλλον ἄνθρωπος ἐξελέγχοιτο ψευδόμενος καὶ ὑπεναντία λέγων αὐτὸς αὑτῷ καὶ αἰτιώμενος τὰ οὐδεπώποτε γενόμενα;
Therefore, how could a man be more clearly convicted of lying, and of contradicting himself, and of bringing charges about things that never happened?
And what is the greatest thing of all, gentlemen of the jury, by which you will also know that this man is unjust and greedy; for if there was any truth in what he says, he ought to have said and demonstrated these things before the trial took place and before making trial of what the judges would decide, and, taking many witnesses, to have demanded that the agreement be recovered from Androcleides, on the ground that I was violating it and acting in opposition to him, and that the agreement was no longer binding on me and him, and to have protested to Androcleides, who held the agreement, that he had no longer anything to do with this agreement.
These things he ought to have done, gentlemen of the jury, if there was any truth in what he says, protesting to Androcleides both when going alone and with many witnesses, so that he might have many who were privy to it.
But since he never did any of these things, he will read to you the testimony of Androcleides himself, with whom the agreement is deposited.
Read the testimony.
Consider another thing, gentlemen of the jury, which he has done.
For I challenged him and demanded that he follow me to Androcleides, with whom the agreement is deposited, and that we, having made a copy of the agreement in common, should seal it again, and put the copies into the echinus, so that there might be no suspicion, but that you, having heard everything well and justly, might decide whatever seems most just to you.
When I challenged him to do this, he refused to do any of these things, but has so contrived that it should not be possible for you to hear the agreement from the common document.
And to prove that I made this challenge, he will read to you the testimony of those in whose presence I made the challenge.
Read the testimony.
§50πῶς ἂν οὖν μᾶλλον καταφανὴς γένοιτο ἄνθρωπος, ὅτι δικαίως μὲν οὐδὲν βούλεται πρός με πράττειν, ἀποστερήσειν δʼ οἴεται ἃ προσήκει ἐμοὶ λαβεῖν, προφάσεις λέγων καὶ ἐγκλήματα ἐγκαλῶν, τὰς δὲ συνθήκας, ἅς φησί με παραβεβηκέναι, οὐκ ᾠήθη δεῖν ὑμᾶς ἀκοῦσαι;
How, then, could a man be more clearly revealed as wishing to do nothing just toward me, but intending to deprive me of what it is proper for me to receive, by speaking of pretexts and bringing charges, while he did not think it necessary that you should hear the agreement which he says I have violated?
I challenged him then in the presence of the witnesses who were present, and now I challenge him again in the presence of you, the judges, and I demand that he agree, as I agree, that the agreement be opened here in the court, and that you hear it, and that it be sealed again in your presence.

Notes

συνηγωνιζόμην (imperfect indicative) takes the potential/unreal construction in the main clause expressed by ἡγεῖ ἄν μʼ ἐπιτρέπειν (the infinitive ἐπιτρέπειν with ἄν dependent on ἡγεῖ: "do you think I would have allowed you... if I were not fighting in common with you?").
  2. §44μεμισθωμένος εἴην — Since the main verb κατεχρήσατο is in the past tense (aorist), the perfect indicative (μεμίσθωμαι) in the indirect discourse introducing by ὅτι has been changed into the optative of indirect discourse (μεμισθωμένος εἴην).
— The phrase ὃ δὲ πάντων μέγιστόν ἐστιν is an appositive clause at the beginning of the sentence. The following relative pronoun ᾧ (dative) expresses means ("by which you will also know...").
πρὶν τὸν ἀγῶνα γενέσθαι — The imperfect of the impersonal verb ἐχρῆν expresses an unfulfilled obligation in the past ("he ought to have..."). πρὶν is constructed with an accusative and infinitive (τὸν ἀγῶνα γενέσθαι), meaning "before the trial took place."
