§19γέγραπται μὲν ταῦτα ἐν τῇ συγγραφῇ, ὦ ἄνδρες δικασταί, ἧς ὑμεῖς ἀκηκόατε·
These terms, gentlemen of the jury, are written in the agreement which you have heard.
οὗτοι δὲ ἀντὶ τῶν τρισχιλίων κεραμίων οὐδὲ πεντακόσια κεράμια εἰς τὸ πλοῖον ἐνέθεντο, ἀλλʼ ἀντὶ τοῦ ἠγοράσθαι αὐτοῖς τὸν οἶνον, ὅσον προσῆκεν, τοῖς χρήμασιν ἐχρῶντο ὅ τι ἐδόκει τούτοις, τὰ δὲ κεράμια τὰ τρισχίλια οὐδʼ ἐμέλλησαν οὐδὲ διενοήθησαν ἐνθέσθαι εἰς τὸ πλοῖον κατὰ τὴν συγγραφήν.
But these men, instead of the three thousand jars, did not even put five hundred jars on board the ship; indeed, instead of purchasing the wine they ought to have purchased with the money, they used the funds as they pleased, and they never even intended or planned to put the three thousand jars on board the ship in accordance with the agreement.
ὅτι δʼ ἀληθῆ ταῦτα λέγω, λαβὲ τὴν μαρτυρίαν τῶν συμπλεόντων ἐν τῷ αὐτῷ πλοίῳ τούτοις.
To show that I am speaking the truth, take the deposition of those who sailed in the same ship with them.

DEPOSITION "Erasicles testifies that he was helmsman of the ship of which Hyblesius was master, and that he knows that Apollodorus carried in the ship four hundred and fifty jars of Mendaean wine, and no more; and that Apollodorus carried no other cargo in the ship to the Pontus." "Hippias, son of Athenippus, of Halicarnassus, testifies that he sailed in the ship of Hyblesius, serving as inspector of the ship, and that he knows that Apollodorus of Phaselis carried in the ship from Mende to the Pontus four hundred and fifty jars of Mendaean wine, and no other cargo." "Before these, the deposition was confirmed: Archiades, son of Mnesonides, of Acharnae; Sostratus, son of Philippus, of Hestiaea; Eumarichus, son of Euboeus, of Hestiaea; Philtades, son of Ctesias, of Xypete; Dionysius, son of Democratides, of Cholleidae." In regard, then, to the quantity of wine which they ought to have put on board the ship, such were their actions, and they began straightway from this first written clause to violate and fail to perform the terms written.
μετὰ δὲ ταῦτʼ ἔστιν ἐν τῇ συγγραφῇ ὅτι ὑποτιθέασιν ταῦτα ἐλεύθερα καὶ οὐδενὶ οὐδὲν ὀφείλοντες, καὶ ὅτι οὐδʼ ἐπιδανείσονται ἐπὶ τούτοις παρʼ οὐδενός.
After this, it is stated in the agreement that they pledge these goods free from all encumbrances and owing money to no one, and that they will not borrow any additional money upon them from anyone.
ταῦτα διαρρήδην γέγραπται, ὦ ἄνδρες δικασταί.
These terms, gentlemen of the jury, are explicitly written.
§22οὗτοι δὲ τί ἐποίησαν;
But what did these men do?
ἀμελήσαντες τῶν γεγραμμένων ἐν τῇ συγγραφῇ δανείζονται παρά τινος νεανίσκου, ἐξαπατήσαντες ὡς οὐδενὶ οὐδὲν ὀφείλοντες· καὶ ἡμᾶς τε παρεκρούσαντο καὶ ἔλαθον δανεισάμενοι ἐπὶ τοῖς ἡμετέροις, ἐκεῖνόν τε τὸν νεανίσκον τὸν δανείσαντα ἐξηπάτησαν ὡς ἐπʼ ἐλευθέροις τοῖς χρήμασιν δανειζόμενοι·
Disregarding the terms written in the agreement, they borrowed money from a certain young man, deceiving him by pretending that they owed nothing to anyone; and they both defrauded us and secretly borrowed money on our security, and they also deceived that young man who lent the money, pretending that they were borrowing on unencumbered property.
τοιαῦτα τούτων ἐστὶν τὰ κακουργήματα.
Such are their misdeeds.
ταῦτα δὲ πάντʼ ἐστὶν τὰ σοφίσματα Λακρίτου τουτουί.
And all these are the clever tricks of Lacritus here.
ὅτι δὲ ἀληθῆ λέγω καὶ ἐπεδανείσαντο χρήματα παρὰ τὴν συγγραφήν, μαρτυρίαν ἀναγνώσεται ὑμῖν αὐτοῦ τοῦ ἐπιδανείσαντος.
To prove that I speak the truth and that they borrowed additional money contrary to the agreement, the clerk shall read to you the deposition of the additional lender himself.

"Ἄρατος Ἁλικαρνασσεὺς μαρτυρεῖ δανεῖσαι Ἀπολλοδώρῳ ἕνδεκα μνᾶς ἀργυρίου ἐπὶ τῇ ἐμπορίᾳ, ἣν ἦγεν ἐν τῇ Ὑβλησίου νηὶ εἰς τὸν Πόντον, καὶ τοῖς ἐκεῖθεν ἀνταγορασθεῖσι, καὶ μὴ εἰδέναι αὐτὸν δεδανεισμένον παρὰ Ἀνδροκλέους ἀργύριον· οὐ γὰρ ἂν δανεῖσαι αὐτὸς Ἀπολλοδώρῳ τὸ ἀργύριον. DEPOSITION "Aratus of Halicarnassus testifies that he lent to Apollodorus eleven minae of silver on the cargo which he was carrying to the Pontus in the ship of Hyblesius, and on the goods purchased in return from there, and that he did not know that Apollodorus had borrowed money from Androcles; for otherwise he himself would not have lent the money to Apollodorus." Such are the villainies of these men.
γέγραπται δὲ μετὰ ταῦτα ἐν τῇ συγγραφῇ, ὦ ἄνδρες δικασταί, ἐπειδὰν ἀποδῶνται ἐν τῷ Πόντῳ ἃ ἦγον, πάλιν ἀνταγοράζειν χρήματα καὶ ἀντιφορτίζεσθαι καὶ ἀπάγειν Ἀθήναζε τὰ ἀντιφορτισθέντα, καὶ ἐπειδὰν ἀφίκωνται Ἀθήναζε, ἀποδοῦναι εἴκοσιν ἡμερῶν τὸ ἀργύριον ἡμῖν δόκιμον· ἕως δʼ ἂν ἀποδῶσιν, κρατεῖν τῶν χρημάτων ἡμᾶς, καὶ ἀνέπαφα ταῦτα παρέχειν τούτους, ἕως ἂν ἀπολάβωμεν.
And after this, gentlemen of the jury, it is written in the agreement that, when they have sold in the Pontus what they carried, they must purchase other goods in return, load them as return cargo, and bring back the return cargo to Athens; and when they arrive at Athens, they must repay us the money in good coin within twenty days; and until they repay, we are to have control of the goods, and they must provide them undamaged until we receive our due.
§25γέγραπται μὲν ταῦτα οὑτωσὶ ἀκριβῶς ἐν τῇ συγγραφῇ·
These terms are written thus precisely in the agreement.
οὗτοι δέ, ὦ ἄνδρες δικασταί, ἐνταῦθα καὶ ἐπεδείξαντο μάλιστα τὴν ὕβριν καὶ τὴν ἀναίδειαν τὴν ἑαυτῶν, καὶ ὅτι οὐδὲ μικρὸν προσεῖχον τοῖς γράμμασι τοῖς γεγραμμένοις ἐν τῇ συγγραφῇ, ἀλλʼ ἡγοῦντο εἶναι τὴν συγγραφὴν ἄλλως ὕθλον καὶ φλυαρίαν.
But these men, gentlemen of the jury, here especially displayed their insolence and shamelessness, and showed that they paid not the slightest attention to the written clauses in the agreement, but regarded the agreement as mere nonsense and babble.
οὔτε γὰρ ἀντηγόρασαν οὐδὲν ἐν τῷ Πόντῳ οὔτε ἀντεφορτίσαντο ὥστε ἄγειν Ἀθήναζε· ἡμεῖς τε οἱ δανείσαντες τὰ χρήματα ἡκόντων αὐτῶν τούτων ἐκ τοῦ Πόντου οὐκ εἴχομεν ὅτου ἐπιλαβοίμεθα οὐδʼ ὅτου κρατοῖμεν, ἕως κομισαίμεθα τὰ ἡμέτερʼ αὐτῶν· οὐδʼ ὁτιοῦν γὰρ εἰσήγαγον εἰς τὸν λιμένα τὸν ὑμέτερον οὗτοι.
For they neither purchased anything in the Pontus nor loaded any return cargo to bring to Athens; and we, who lent the money, when these men returned from the Pontus, had nothing to lay hold of or to keep in our control until we should recover our own; for these men imported absolutely nothing into your harbor.
