§31τὸν τοίνυν πλέον ἢ πεντήκοντʼ ἀνδράποδα κεκτημένον καὶ δυοῖν τέχναιν ἐπιμελούμενον, ὧν θάτερον ἐργαστήριον εἰς τὰς κλίνας ῥᾳδίως δύο μνᾶς τοῦ μηνὸς ἀνήλισκεν ἐλέφαντος, τὸ δὲ μαχαιροποιεῖον οὐκ ἔλαττον ἢ τοσοῦτον ἕτερον σὺν σιδήρῳ, τοῦτον οὔ φασιν καταλιπεῖν οὐδὲν τούτων· εἰς τοῦτʼ ἀναιδείας ἐληλύθασιν.
Therefore, a man who possessed more than fifty slaves and managed two crafts, —one of which workshops easily consumed two minae of ivory a month for the couches, and the sword-maker's shop not less than another such amount along with iron,— this man, they say, left none of these materials; to such a pitch of impudence have they come.
§32ὅτι μὲν οὖν οὐ πιστὰ λέγουσιν, καὶ ἐκ τούτων αὐτῶν ῥᾴδιόν ἐστι μαθεῖν· ὅτι δʼ ἐκεῖνος κατέλιπε τοσοῦτον τὸ πλῆθος ὥστε μὴ μόνον ἱκανὸν εἶναι κατεργάζεσθαι τοῖς ἑαυτοῦ δημιουργοῖς, ἀλλὰ καὶ τῷ βουλομένῳ πρὸς ὠνεῖσθαι τῶν ἄλλων, ἐκεῖθεν φανερόν, ὅτι αὐτός τʼ ἐπώλει ζῶν καὶ Δημοφῶν καὶ οὗτος τοῦ πατρὸς ἤδη τετελευτηκότος ἐκ τῆς οἰκίας τῆς ἐμῆς ἀπεδίδοντο τοῖς βουλομένοις.
That indeed they do not speak what is credible, it is easy to learn also from these very things; but that he left so great a quantity as not only to be sufficient for his own artisans to work, but also for anyone else who wished to buy besides, is manifest from this: that he himself used to sell it when alive, and Demophon and this man, after my father had already died, sold it from my house to those who wished.
§33καίτοι πόσον τινὰ χρὴ τὸν καταλειφθέντα νομίζειν εἶναι, ὅταν φαίνηται τηλικούτοις τʼ ἐργαστηρίοις ἐξαρκῶν καὶ χωρὶς ὑπὸ τῶν ἐπιτρόπων πιπρασκόμενος;
And yet how great a quantity must we suppose that which was left to have been, when it appears to have sundered for such large workshops and to have been sold privately by the guardians?
ἆρʼ ὀλίγον, ἀλλʼ οὐ πολλῷ πλείω τῶν ἐγκεκλημένων;
Was it then small, and not much more than what has been claimed?
λαβὲ τοίνυν τὰς μαρτυρίας ταυτασὶ καὶ ἀνάγνωθʼ αὐτοῖς. ΜΑΡΤΥΡΙΑΙ
τούτου τοίνυν τοῦ ἐλέφαντός ἐστι πλέον ἢ τάλαντον, ὃν οὔτʼ αὐτὸν οὔτε τὸ ἔργον μοι ἀποφαίνουσιν, ἀλλὰ καὶ τοῦτον ἄρδην ἀφανίζουσιν ὅλον.
Take then these depositions and read them to them. ΜΑΡΤΥΡΙΑΙ Now, of this ivory the value is more than a talent, which they declare neither itself nor its profit to me, but they completely make this too disappear entirely.
§34ἔτι τοίνυν, ὦ ἄνδρες δικασταί, παρὰ τὸν λόγον ὃν ἀποφέρουσιν, ἐξ ὧν αὐτοὶ λαβεῖν ὁμολογοῦσιν, ἐπιδείξω ὑμῖν τρεῖς μὲν ὄντας αὐτοὺς πλέον ἢ ὀκτὼ τάλαντʼ ἐκ τῶν ἐμῶν ἔχοντας, ἰδίᾳ δʼ ἐκ τούτων Ἄφοβον τρία τάλαντα καὶ χιλίας εἰληφότα, τά τʼ ἀνηλωμένα χωρὶς τούτων πλείω τιθεὶς καὶ ὅσʼ ἐκ τούτων ἀπέδοσαν ἀφαιρῶν, ἵνʼ εἰδῆθʼ ὅτι οὐ μικρᾶς ἀναιδείας τὰ ἐγχειρήματʼ αὐτῶν ἐστίν.
Furthermore, men of the jury, besides the account which they bring in, from what they themselves confess to have taken, I will demonstrate to you that they, being three, have more than eight talents from my property, and that privately from this Aphobos has taken three talents and a thousand drachmae, estimating the expenses apart from these as more and subtracting what they paid back from these, so that you may know that their undertakings are of no small impudence.
§35λαβεῖν γὰρ ἐκ τῶν ἐμῶν ὁμολογοῦσιν οὗτος μὲν ὀκτὼ καὶ ἑκατὸν μνᾶς, χωρὶς ὧν ἔχοντʼ αὐτὸν ἐγὼ ἐπιδείξω νῦν, Θηριππίδης δὲ δύο τάλαντα, Δημοφῶν δʼ ἑπτὰ καὶ ὀγδοήκοντα μνᾶς.
For they confess to have taken from my property: this man, one hundred and eight minae (apart from what I shall now demonstrate that he has), Therippides, two talents, and Demophon, eighty-seven minae.
τοῦτο δʼ ἐστὶ πέντε τάλαντα καὶ πεντεκαίδεκα μναῖ.
This is five talents and fifteen minae.
τούτου τοίνυν ὃ μὲν οὐχ ἅθρουν ἐλήφθη, σχεδόν εἰσιν ἑβδομήκοντα μναῖ καὶ ἑπτά, ἡ πρόσοδος ἡ ἀπὸ τῶν ἀνδραπόδων, ὃ δʼ εὐθὺς ἔλαβον οὗτοι, μικροῦ δέοντα τέτταρα τάλαντα· οἷς τὸ ἔργον ἂν προσθῆτʼ ἐπὶ δραχμῇ μόνον τῶν δέκʼ ἐτῶν, ὀκτὼ τάλανθʼ εὑρήσετε σὺν τοῖς ἀρχαίοις καὶ χιλίας γιγνομένας.
Now, of this, the part which was not received all at once is nearly seventy-seven minae, being the income from the slaves; and the part which these men took immediately is nearly four talents; to which if you add the profit for the ten years at only one drachma, you will find that they become eight talents and a thousand drachmae with the principal.
§36τὴν μὲν τοίνυν τροφὴν ἀπὸ τῶν ἑβδομήκοντα μνῶν καὶ ἑπτὰ λογιστέον τῶν ἀπὸ τοῦ ἐργαστηρίου γενομένων.
Therefore, the maintenance must be calculated from the seventy-seven minae which came from the workshop.
Θηριππίδης γὰρ ἑπτὰ μνᾶς ἐδίδου καθʼ ἕκαστον τὸν ἐνιαυτὸν εἰς ταῦτα, καὶ ἡμεῖς τοῦτο λαβεῖν ὁμολογοῦμεν.
For Therippides used to give seven minae each year for this, and we confess to have received this.
ὥσθʼ ἑβδομήκοντα μνῶν ἐν τοῖς δέκʼ ἔτεσιν τροφὴν τούτων ἡμῖν ἀνηλωκότων, τὸ περιὸν τὰς ἑπτακοσίας προστίθημʼ αὐτοῖς, καὶ τούτων πλείω εἰμὶ τεθηκώς.
So that, as they have spent seventy minae of these for our maintenance in the ten years, I add the remaining seven hundred drachmae to them, and I have estimated more than these.
ὃ δʼ ἐμοὶ δοκιμασθέντι παρέδοσαν καὶ ὅσον εἰς τὴν πόλιν εἰσενηνόχασιν, τοῦτʼ ἀπὸ τῶν ὀκτὼ ταλάντων καὶ τοῦ προσόντος ἀφαιρετέον ἐστίν.
But what they delivered to me when I was approved, and how much they have paid to the city, must be subtracted from the eight talents and the accession.
§37ἀπέδοσαν μὲν τοίνυν οὗτος καὶ Θηριππίδης μίαν καὶ τριάκοντα μνᾶς, εἰσφορὰς δʼ εἰσενηνοχέναι λογίζονται δυοῖν δεούσας εἴκοσι μνᾶς.
Now, this man and Therippides paid back thirty-one minae, and they calculate to have paid as tax eighteen minae.
ἐγὼ δʼ ὑπερβαλὼν τοῦτο ποιήσω τριάκοντα μνᾶς, ἵνα πρὸς ταῦτα μηδʼ ἀντειπεῖν ἔχωσιν.
But I, overestimating this, will make it thirty minae, so that they may not even have anything to say against this.
οὐκοῦν ἂν ἀφέλητε τὸ τάλαντον ἀπὸ τῶν ὀκτὼ ταλάντων, ἑπτὰ τὰ λειπόμενʼ ἐστί, καὶ ταῦτα, ἐξ ὧν αὐτοὶ λαβεῖν ὁμολογοῦσι, τούτους ἔχειν ἐστὶν ἀναγκαῖον.
If then you subtract the talent from the eight talents, the remainder is seven, and these, from what they themselves confess to have taken, they must necessarily have.
τοῦτο τοίνυν, εἰ καὶ τἄλλα πάντʼ ἀποστεροῦσιν ἀρνούμενοι μὴ ἔχειν, ἀποδοῦναι προσῆκεν, ὁμολογοῦντάς γε λαβεῖν ταῦτʼ ἐκ τῶν ἐμῶν.
Therefore, even if they deprive me of all other things, denying that they have them, they ought to have paid back this, since they confess indeed to have taken this from my property.
§38νῦν δὲ τί ποιοῦσιν;
But now what do they do?
ἔργον μὲν οὐδὲν ἀποφαίνουσι τοῖς χρήμασιν, αὐτὰ δὲ τὰ ἀρχαῖα πάντʼ ἀνηλωκέναι φασὶ σὺν ταῖς ἑπτὰ καὶ ἑβδομήκοντα μναῖς· Δημοφῶν δὲ καὶ πρὸς ὀφείλοντας ἡμᾶς ἐνέγραψε.
They declare no profit for the money, but they say they have spent all the principal itself along with the seventy-seven minae; and Demophon even wrote us down as debtors besides.
ταῦτʼ οὐ μεγάλη καὶ περιφανὴς ἀναισχυντία;
Are these things not a great and manifest impudence?
ταῦτʼ οὐχ ὑπερβολὴ δεινῆς αἰσχροκερδίας;
Are these things not an excess of terrible greed?
τί οὖν ποτʼ ἐστὶ τὸ δεινόν, εἰ μὴ ταῦτα δόξει τηλικαύτας ὑπερβολὰς ἔχοντα.
What then can ever be terrible, if these things, having such great excesses, shall not seem so?
