§23ταύτας τοίνυν ἔχει τριάκοντα μνᾶς ἀπὸ τοῦ ἐργαστηρίου, καὶ τὸ ἔργον αὐτῶν ὀκτὼ ἐτῶν· ὃ ἂν ἐπὶ δραχμῇ τις τιθῇ μόνον, ἄλλας τριάκοντα μνᾶς εὑρήσει.
Thus indeed he has these thirty minae from the workshop, and their profit for eight years; if anyone should calculate it at only one drachma, he will find another thirty minae.
καὶ ταῦτα μὲν ἰδίᾳ μόνος εἴληφεν· ἃ συντεθέντα πρὸς τὴν προῖκα μάλιστα τέτταρα τάλαντα γίγνεται σὺν τοῖς ἀρχαίοις.
And these things indeed he alone has taken privately; which, when added to the dowry, become almost four talents with the principal.
ἃ δὲ μετὰ τῶν ἄλλων ἐπιτρόπων κοινῇ διήρπακεν, καὶ ὅσʼ ἔνια μηδὲ καταλειφθῆναι παντάπασιν ἠμφεσβήτηκεν, ταῦθʼ ὑμῖν ἤδη ἐπιδείξω καθʼ ἕκαστον.
On the other hand, the property which he has plundered in common with the other guardians, and some of which he has disputed whether it was left at all, I will now demonstrate to you one by one.
§24πρῶτον μὲν οὖν περὶ τῶν κλινοποιῶν, οὓς κατέλιπεν μὲν ὁ πατήρ, ἀφανίζουσι δʼ οὗτοι, τετταράκοντα μὲν μνῶν ὑποκειμένους, εἴκοσι δʼ ὄντας τὸν ἀριθμόν, ἐπιδείξω ὑμῖν ὡς λίαν ἀναιδῶς καὶ φανερῶς μʼ ἀποστεροῦσι.
First indeed, then, concerning the couch-makers, whom my father left, but these men are making disappear, being valued at forty minae and being twenty in number, I will demonstrate to you how very impudently and clearly they are depriving me of them.
τούτους γὰρ καταλειφθῆναι μὲν οἴκοι παρʼ ἡμῖν πάντες ὁμολογοῦσιν, καὶ τὰς δώδεκα μνᾶς ἑκάστου τοῦ ἐνιαυτοῦ τῷ πατρὶ γίγνεσθαί φασιν· αὐτοὶ δὲ λῆμμα μὲν παρʼ αὐτῶν ἐν δέκʼ ἔτεσιν οὐδὲν ἐμοὶ γεγενημένον ἀποφαίνουσιν ἀλλʼ οὐδὲ μικρόν, ἀναλώματος δὲ κεφάλαιον εἰς αὐτοὺς οὗτος ὀλίγου δεῖν λογίζεται χιλίας· εἰς τοῦτʼ ἀναιδείας ἐλήλυθεν.
For that these were left at home with us, they all confess, and they say that twelve minae accrued to my father each year; but they themselves show no profit at all from them to me in ten years, not even a tiny bit, but this man accounts for a total of nearly a thousand drachmae as expenses for them; to such a degree of impudence has he come.
§25αὐτοὺς δὲ τοὺς ἀνθρώπους, εἰς οὓς ταῦτʼ ἀνηλωκέναι φησίν, οὐδαμοῦ μοι παραδεδώκασιν, ἀλλὰ πάντων κενότατον λόγον λέγουσιν, ὡς ὁ ὑποθεὶς τῷ πατρὶ τἀνδράποδα πονηρότατος ἀνθρώπων ἐστὶν καὶ ἐράνους τε λέλοιπε πλείστους καὶ ὑπέρχρεως γέγονε, καὶ τούτων οὐκ ὀλίγους κεκλήκασι κατʼ ἐκείνου μάρτυρας.
But the men themselves, upon whom he says he spent these things, they have nowhere delivered to me, but they tell a most empty story of all, that the man who mortgaged the slaves to my father is the most wicked of men and has defaulted on very many contributions and become over-indebted, and they have called not a few witnesses of these things against him.
τὰ δʼ ἀνδράποδʼ ὅστις ἐστὶν ὁ λαβών, ἢ πῶς ἐκ τῆς οἰκίας ἐξῆλθεν, ἢ τίς ἀφείλετο, ἢ πρὸς τίνα δίκην ἥττηνται περὶ αὐτῶν, οὐκ ἔχουσιν εἰπεῖν.
But who the person is who took the slaves, or how they went out of the house, or who took them away, or in what lawsuit they have been defeated concerning them, they are not able to say.
§26καίτοι εἴ τι ἔλεγον ὑγιές, οὐκ ἂν κατὰ τῆς ἐκείνου πονηρίας παρείχοντο μάρτυρας, ἧς οὐδέν μοι προσήκει φροντίζειν, ἀλλὰ τούτων ἂν ἀντελαμβάνοντο καὶ τοὺς λαβόντας ἀπεδείκνυσαν καὶ οὐδὲν ἂν αὐτῶν παρέλειπον.
And yet, if they were saying anything sound, they would not be producing witnesses of that man's wickedness, which is of no concern to me, but they would have laid claim to these and shown who took them, and would have omitted nothing concerning them.
νῦν δʼ ὠμότατʼ ἀνθρώπων, ὁμολογοῦντες καταλειφθῆναι καὶ λαβόντες ὡς αὑτοὺς καὶ καρπωσάμενοι δέκʼ ἔτη τοὺς ἀνθρώπους, ἄρδην ὅλον τὸ ἐργαστήριον ἀφανίζουσι.
But now, as the most cruel of men, though confessing that they were left and taking them to themselves and enjoying the fruits of the men for ten years, they completely make the whole workshop disappear.
καὶ ταῦθʼ ὡς ἀληθῆ λέγω, λαβέ μοι τὰς μαρτυρίας καὶ ἀναγίγνωσκε. ΜΑΡΤΥΡΙΑΙ.
And that I speak the truth, take the depositions and read them. ΜΑΡΤΥΡΙΑΙ.
§27ὅτι τοίνυν οὐκ ἄπορος ἦν ὁ Μοιριάδης, οὐδʼ ἦν τῇ πατρὶ τοῦτο τὸ συμβόλαιον εἰς τἀνδράποδʼ ἠλιθίως συμβεβλημένον, μεγίστῳ τεκμηρίῳ γνώσεσθε· λαβὼν γὰρ ὡς ἑαυτὸν Ἄφοβος τοῦτο τὸ ἐργαστήριον, ὡς αὐτοὶ τῶν μαρτύρων ἠκούσατε, καὶ δέον αὐτόν, εἰ καί τις ἄλλος ἐβούλετʼ εἰς ταῦτα συμβαλεῖν, τοῦτον διακωλύειν ἐπίτροπόν γʼ ὄντα, αὐτὸς ἐπὶ τούτοις τοῖς ἀνδραπόδοις τῷ Μοιριάδῃ πεντακοσίας δραχμὰς ἐδάνεισεν, ἃς ὀρθῶς καὶ δικαίως παρʼ ἐκείνου κεκομίσθαι ὡμολόγηκεν.
That therefore Moiriades was not without means, nor was this contract entered into foolishly by my father for the slaves, you will know by the greatest proof; for Aphobos, having taken this workshop to himself, as you yourselves heard from the witnesses, and though he ought, even if anyone else wished to enter into a contract for these, to prevent him, being a guardian at least, himself lent five hundred drachmae to Moiriades on these slaves, which he has confessed to have recovered rightly and justly from him.
§28καίτοι πῶς οὐ δεινόν, εἰ ἡμῖν μὲν πρὸς τῷ λῆμμʼ ἀπʼ αὐτῶν μηδὲν γεγονέναι καὶ αὐτὰ τὰ ὑποτεθέντʼ ἀπόλωλεν, οἳ πρότερον συνεβάλομεν, τῷ δʼ εἰς τὰ ἡμέτερα δανείσαντι καὶ τοσούτῳ χρόνῳ πράξαντι καὶ οἱ τόκοι καὶ τἀρχαῖʼ ἐκ τῶν ἡμετέρων ἀποδέδοται καὶ οὐδεμίʼ ἀπορία γέγονεν;
And yet how is it not monstrous, if to us, in addition to no profit having accrued from them, the mortgaged property itself has perished, who previously contracted with him, while to the man who lent upon our property and managed it for so long a time, both the interest and the principal have been paid out of our property, and no difficulty has arisen?
ἀλλὰ μὴν ὡς ἀληθῆ λέγω, λαβὲ τὴν μαρτυρίαν καὶ ἀνάγνωθι. ΜΑΡΤΥΡΙΑ.
Indeed, to prove that I speak the truth, take the deposition and read it. ΜΑΡΤΥΡΙΑ.
§29σκέψασθε τοίνυν ὅσον ἀργύριον οὗτοι παρὰ τοὺς κλινοποιοὺς κλέπτουσι, τετταράκοντα μὲν μνᾶς αὐτὸ τὸ ἀρχαῖον, δέκα δʼ ἐτῶν τὸ ἔργον αὐτῶν δύο τάλαντα· δώδεκα γὰρ μνᾶς ἑκάστου τοῦ ἐνιαυτοῦ τὴν πρόσοδον αὐτῶν ἐλάμβανον.
Consider then how much money these men are stealing in respect of the couch-makers: forty minae for the principal itself, and their profit for ten years, two talents; for they received twelve minae each year as income from them.
ἆρα μικρόν τι καὶ ἐξ ἀφανοῦς ποθεν καὶ παραλογίσασθαι.
Is it then some small sum, from some obscure place, and easy to misrepresent?
ῥᾴδιον, ἀλλʼ οὐ φανερῶς οὑτωσὶ μικροῦ δεῖν τρία τάλαντα ταῦτʼ ἀνηρπάκασιν;
No, have they not thus clearly snatched away almost three talents?
ὧν κοινῇ διαπεφορημένων τὸ τρίτον δήπου μέρος παρὰ τούτου μοι προσήκει κεκομίσθαι.
Of which, since they have been plundered in common, it is proper that I should recover the third part from this man.
§30καὶ μήν, ὦ ἄνδρες δικασταί, καὶ τὰ περὶ τοῦ ἐλέφαντος καὶ σιδήρου τοῦ καταλειφθέντος παραπλήσιά πως τούτοις πεποιήκασιν· οὐδὲ γὰρ ταῦτʼ ἀποφαίνουσιν.
And indeed, men of the jury, also concerning the ivory and iron which were left, they have done in somewhat the same manner as these; for they do not declare these either.
καίτοι κεκτημένον μὲν τοσούτους κλινοποιούς, κεκτημένον δὲ μαχαιροποιοὺς οὐχ οἷόν τε μὴ οὐχὶ καὶ σίδηρον καὶ ἐλέφαντα καταλιπεῖν, ἀλλʼ ἀνάγκη ταῦτά γʼ ὑπάρχειν· τί γὰρ ἂν ἠργάζοντο τούτων μὴ ὑπαρξάντων.
And yet, possessing so many couch-makers, and possessing sword-makers, it is impossible not to have left both iron and ivory, but it is necessary that these at least were available; for what would they have worked if these had not been available?
