§9καὶ πρὸς τούτοις, ὦ ἄνδρες δικασταί, ἐνόμιζεν, εἰ μὲν αὐτοῦ μένειν ἐπιχειροίην, ἐκδοθήσεσθαι, μʼ ὑπὸ τῆς πόλεως Σατύρῳ, εἰ δʼ ἄλλοσέ ποι τραποίμην, οὐδὲν μελήσειν αὑτῷ τῶν ἐμῶν λόγων, εἰ δʼ εἰσπλευσοίμην εἰς τὸν Πόντον, ἀποθανεῖσθαί με μετὰ τοῦ πατρός·
In addition to these things, gentlemen of the jury, he believed that if I should attempt to remain here, I would be surrendered to Satyrus by the city; if I should turn elsewhere, he would not care at all for my words; and if I should sail into the Pontus, I would die along with my father.
ταῦτα διαλογιζόμενος διενοεῖτό μʼ ἀποστερεῖν τὰ χρήματα.
Reasoning thus, he intended to deprive me of my money.
καὶ πρὸς μὲν ἐμὲ προσεποιεῖτʼ ἀπορεῖν ἐν τῷ παρόντι καὶ οὐκ ἂν ἔχειν ἀποδοῦναι· ἐπειδὴ δὲ βουλόμενος εἰδέναι σαφῶς τὸ πρᾶγμα προσπέμπω Φιλόμηλον αὐτῷ καὶ Μενέξενον ἀπαιτήσοντας, ἔξαρνος γίγνεται πρὸς αὐτοὺς μηδὲν ἔχειν τῶν ἐμῶν.
To me, he pretended to be in difficulty at present and unable to repay; but when, wishing to know the matter clearly, I sent Philomelus and Menexenus to him to demand it back, he denied to them that he had any of my property.
§10πανταχόθεν δέ μοι τοσούτων κακῶν προσπεπτωκότων τίνʼ οἴεσθέ με γνώμην ἔχειν, ᾧ γʼ ὑπῆρχε σιγῶντι μὲν ὑπὸ τούτου ἀπεστερῆσθαι τῶν χρημάτων, λέγοντι δὲ ταῦτα μὲν μηδὲν μᾶλλον κομίσασθαι, πρὸς Σάτυρον δʼ εἰς τὴν μεγίστην διαβολὴν καὶ ἐμαυτὸν καὶ τὸν πατέρα καταστῆσαι;
When so many troubles had fallen upon me from all sides, what do you think my feelings were, since it was my lot that if I remained silent I would be deprived of my money by this man, but if I spoke out I would recover it no more, and would bring both myself and my father into the greatest suspicion with Satyrus?
κράτιστον οὖν ἡγησάμην ἡσυχίαν ἄγειν.
Therefore I thought it best to keep quiet.
§11μετὰ δὲ ταῦτʼ, ὦ ἄνδρες δικασταί, ἀφικνοῦνταί μοι οἱ ἀπαγγέλλοντες ὅτι ὁ πατὴρ ἀφεῖται, καὶ Σατύρῳ οὕτως ἁπάντων μεταμέλει τῶν πεπραγμένων, ὥστε πίστεις τὰς μεγίστας αὐτῷ δεδωκὼς εἴη, καὶ τὴν ἀρχὴν ἔτι μείζω πεποιηκὼς ἧς εἶχε πρότερον, καὶ τὴν ἀδελφὴν τὴν ἐμὴν εἰληφὼς γυναῖκα τῷ αὑτοῦ υἱεῖ.
After these things, gentlemen of the jury, there arrived messengers reporting to me that my father had been released, and that Satyrus so regretted all that had been done that he had given him the greatest pledges, and had made his rule even larger than he had before, and had taken my sister as a wife for his own son.
πυθόμενος δὲ ταῦτα Πασίων καὶ εἰδὼς ὅτι φανερῶς ἤδη πράξω περὶ τῶν ἐμαυτοῦ, ἀφανίζει Κίττον τὸν παῖδα, ὃς συνῄδει περὶ τῶν χρημάτων.
Hearing this, Pasion, knowing that I would now act openly concerning my property, made the slave Cittus disappear, who was aware of the money.
§12ἐπειδὴ δʼ ἐγὼ προσελθὼν ἐξῄτουν αὐτόν, ἡγούμενος ἔλεγχον ἂν τοῦτον σαφέστατον γενέσθαι περὶ ὧν ἐνεκάλουν, λέγει λόγον πάντων δεινότατον, ὡς ἐγὼ καὶ Μενέξενος διαφθείραντες καὶ πείσαντες αὐτὸν ἐπὶ τῇ τραπέζῃ καθήμενον ἓξ τάλαντʼ ἀργυρίου λάβοιμεν παρʼ αὐτοῦ·
When I went and demanded him back, believing this would be the clearest proof concerning what I was accusing him of, he told the most terrible story of all: that I and Menexenus had corrupted and persuaded the slave, while he was sitting at the bank, to take six talents of silver from him.
ἵνα δὲ μηδεὶς ἔλεγχος μηδὲ βάσανος γένοιτο περὶ αὐτῶν, ἔφασκεν ἡμᾶς ἀφανίσαντας τὸν παῖδʼ ἀντεγκαλεῖν αὑτῷ καὶ ἐξαιτεῖν τοῦτον, ὃν αὐτοὶ ἠφανίσαμεν.
And in order that there might be no examination or torture concerning them, he claimed that we had made the slave disappear and were bringing a counter-charge against him and demanding the return of the one whom we ourselves had made disappear.
καὶ ταῦτα λέγων καὶ ἀγανακτῶν καὶ δακρύων εἷλκέ με πρὸς τὸν πολέμαρχον, ἐγγυητὰς αἰτῶν, καὶ οὐ πρότερον ἀφῆκεν, ἕως αὐτῷ κατέστησʼ ἓξ ταλάντῶν ἐγγυητάς.
Saying this, and being indignant and weeping, he dragged me to the polemarch, demanding guarantors, and did not let me go until I provided him with guarantors for six talents.
καί μοι κάλει τούτων μάρτυρας. ""

§13τῶν μὲν μαρτύρων ἀκηκόατε, ὦ ἄνδρες δικασταί·
You have heard the witnesses, gentlemen of the jury.
ἐγὼ δὲ τὰ μὲν ἀπολωλεκὼς ἤδη, περὶ δὲ τῶν αἰσχίστας αἰτίας ἔχων, αὐτὸς μὲν εἰς Πελοπόννησον ᾠχόμην ζητήσων, Μενέξενος δʼ εὑρίσκει τὸν παῖδʼ ἐνθάδε, καὶ ἐπιλαβόμενος ἠξίου αὐτὸν βασανίζεσθαι καὶ περὶ τῆς παρακαταθήκης καὶ περὶ ὧν οὗτος ἡμᾶς ᾐτιάσατο.
I, having already lost my property and facing the most shameful charges, went to the Peloponnese myself to search for him, while Menexenus found the slave here, and taking hold of him, demanded that he be tortured both concerning the deposit and concerning the things this man accused us of.
§14Πασίων δʼ εἰς τοῦτο τόλμης ἀφίκεθʼ ὥστʼ ἀφῃρεῖτʼ αὐτὸν ὡς ἐλεύθερον ὄντα, καὶ οὐκ ᾐσχύνετʼ οὐδʼ ἐδεδοίκει, ὃν ἔφασκεν ὑφʼ ἡμῶν ἠνδραποδίσθαι καὶ παρʼ οὗ τοσαῦτα χρήμαθʼ ἡμᾶς ἔχειν, τοῦτον ἐξαιρούμενος εἰς ἐλευθερίαν καὶ κωλύων βασανίζεσθαι.
But Pasion reached such a point of audacity that he tried to take him away on the ground that he was a free man, and he was not ashamed nor afraid to rescue into freedom and prevent from being tortured the very person whom he claimed had been enslaved by us and from whom we had obtained so much money.
ὃ δὲ πάντων δεινότατον· κατεγγυῶντος γὰρ Μενεξένου πρὸς τὸν πολέμαρχον τὸν παῖδα, Πασίων αὐτὸν ἑπτὰ ταλάντων διηγγυήσατο.
And the most terrible thing of all: when Menexenus applied to the polemarch to hold the slave in custody, Pasion bailed him out for seven talents.
καί μοι τούτων ἀνάβητε μάρτυρες. ""
Step up, witnesses of these things, for me.
§15τούτων τοίνυν αὐτῷ πεπραγμένων, ὦ ἄνδρες δικασταί, ἡγούμενος περὶ μὲν τῶν παρεληλυθότων φανερῶς ἡμαρτηκέναι, οἰόμενος δʼ ἐκ τῶν λοιπῶν ἐπανορθώσεσθαι, προσῆλθεν ἡμῖν φάσκων ἕτοιμος εἶναι παραδοῦναι βασανίζειν τὸν παῖδα.
When these things had been done by him, gentlemen of the jury, believing that he had clearly erred regarding the past, and thinking that he could set things right from what remained, he came to us saying he was ready to hand over the slave for torture.
ἑλόμενοι δὲ βασανιστὰς ἀπηντήσαμεν εἰς τὸ Ἡφαιστεῖον.
Choosing torturers, we met at the Hephaesteum.
κἀγὼ μὲν ἠξίουν αὐτοὺς μαστιγοῦν τὸν ἐκδοθέντα καὶ στρεβλοῦν, ἕως τἀληθῆ δόξειεν αὐτοῖς λέγειν· Πασίων δʼ οὑτοσὶ οὐ δημοκοίνους ἔφασκεν αὐτοὺς ἑλέσθαι, ἀλλʼ ἐκέλευε λόγῳ πυνθάνεσθαι παρὰ τοῦ παιδός, §16εἴ τι βούλοιντο.
And I demanded that they scourge the one handed over and rack him until he seemed to them to speak the truth; but Pasion here said they had not chosen them as public executioners, but ordered them to question the slave by word of mouth, if they wished anything.
διαφερομένων δʼ ἡμῶν οἱ βασανισταὶ αὐτοὶ μὲν οὐκ ἔφασαν βασανιεῖν, ἔγνωσαν δὲ Πασίωνʼ ἐμοὶ παραδοῦναι τὸν παῖδα.
Since we disagreed, the torturers themselves said they would not perform the torture, but decided that Pasion should hand over the slave to me.
οὗτος δʼ οὕτω σφόδρʼ ἔφευγε τὴν βάσανον, ὥστε περὶ μὲν τῆς παραδόσεως οὐκ ἤθελεν αὐτοῖς πείθεσθαι, τὸ δʼ ἀργύριον ἕτοιμος ἦν ἀποτίνειν, εἰ καταγνοῖεν αὐτοῦ.
But he avoided the torture so intensively that he did not wish to obey them regarding the handover, but was ready to pay the money if they should find him guilty.
καί μοι κάλει τούτων μάρτυρας. ""
