§17ἐπειδὴ τοίνυν ἐκ τῶν συνόδων, ὦ ἄνδρες δικασταί, πάντες αὐτοῦ κατεγίγνωσκον ἀδικεῖν καὶ δεινὰ ποιεῖν, ὅστις τὸν παῖδα, ὃ ἔφασκον ἐγὼ συνειδέναι περὶ τῶν χρημάτων, πρῶτον μὲν αὐτὸς ἀφανίσας ὑφʼ ἡμῶν αὐτὸν ᾐτιᾶτʼ ἠφανίσθαι, ἔπειτα δὲ συλληφθέντα ὡς ἐλεύθερον ὄντα διεκώλυσε βασανίζεσθαι, μετὰ δὲ ταῦθʼ ὡς δοῦλον ἐκδοὺς καὶ βασανιστὰς ἑλόμενος λόγῳ μὲν ἐκέλευσε βασανίζειν, ἔργῳ δʼ οὐκ εἴα, διὰ ταῦθʼ ἡγούμενος οὐδεμίαν αὑτῷ σωτηρίαν εἶναι, ἐάνπερ εἰς ὑμᾶς εἰσέλθῃ, προσπέμπων ἐδεῖτό μου εἰς ἱερὸν ἐλθόνθʼ ἑαυτῷ συγγενέσθαι.
Therefore, gentlemen of the jury, from what happened in the meetings, everyone condemned him of wrongdoing and of acting outrageously—a man who, having first hid the slave himself (the one whom I claimed was aware of the money), accused him of having been made to disappear by us; then, when the slave was apprehended, prevented him from being tortured on the ground that he was free; and after these things, having handed him over as a slave and chosen torturers, ordered them in word to torture him, but in deed did not allow it.
§18καὶ ἐπειδὴ ἤλθομεν εἰς ἀκρόπολιν, ἐγκαλυψάμενος ἔκλαε καὶ ἔλεγεν, ὡς ἠναγκάσθη μὲν διʼ ἀπορίαν ἔξαρνος γενέσθαι, ὀλίγου δὲ χρόνου πειράσοιτο τὰ χρήματʼ ἀποδοῦναι·
For these reasons, believing that there was no safety for him if he should come before you, he sent messengers and begged me to go to a temple and meet with him. And when we went up to the Acropolis, he veiled his face and wept, saying that he had been forced to deny it due to financial distress, but that in a short time he would try to repay the money.
ἐδεῖτο δέ μου συγγνώμην ἔχειν αὐτῷ καὶ συγκρύψαι τὴν συμφοράν, ἵνα μὴ παρακαταθήκας δεχόμενος φανερὸς γένηται τοιαῦτʼ ἐξημαρτηκώς.
He begged me to have forgiveness for him and to keep his misfortune secret, so that while receiving deposits, he might not be exposed as having committed such an error.
ἡγούμενος δʼ αὐτῷ μεταμέλειν τῶν πεπραγμένων συνεχώρουν καὶ ἐκέλευον αὐτὸν ἐξευρεῖν, ὅντινʼ ἂν βούληται τρόπον, ὅπως τούτῳ τε καλῶς ἕξει κἀγὼ τἀμαυτοῦ κομιοῦμαι. §19τρίτῃ δʼ ἡμέρᾳ συνελθόντες πίστιν τʼ ἔδομεν ἀλλήλοις ἦ μὴν σιωπήσεσθαι τὰ πραχθέντα, ἣν οὗτος ἔλυσεν, ὡς ὑμεῖς αὐτοὶ προιόντος τοῦ λόγου γνώσεσθε, καὶ ὡμολόγησεν εἰς τὸν Πόντον μοι συμπλευσεῖσθαι κἀκεῖ τὸ χρυσίον ἀποδώσειν, ἵνʼ ὡς πορρωτάτω ἀπὸ τῆσδε τῆς πόλεως διαλύσειε τὸ συμβόλαιον, καὶ τῶν μὲν ἐνθάδε μηδεὶς εἰδείη τὸν τρόπον τῆς ἀπαλλαγῆς, ἐκπλεύσαντι δʼ αὐτῷ ἐξείη λέγειν ὅ τι αὐτὸς βούλοιτο·
Believing that he repented of what he had done, I agreed and urged him to find whatever way he wished, so that it would be well for him and I would recover my own property. On the third day we met and gave each other a pledge that we would indeed keep silent about what had been done—which this man broke, as you yourselves will know as the speech proceeds—and he agreed to sail with me to the Pontus and to return the gold there, in order that he might dissolve the contract as far away as possible from this city, and that no one here might know the manner of the settlement, and that it might be permitted for him, once sailed, to say whatever he himself wished.
εἰ δὲ μὴ ταῦτα ποιήσειε, δίαιταν ἐπὶ ῥητοῖς ἐπέτρεπε Σατύρῳ, ἐφʼ ᾧτε καταγιγνώσκειν ἡμιόλιʼ αὐτοῦ τὰ χρήματα. §20ταῦτα δὲ συγγράψαντες καὶ ἀναγαγόντες εἰς ἀκρόπολιν Πύρωνα Φεραῖον ἄνδρα, εἰθισμένον εἰσπλεῖν εἰς τὸν Πόντον, δίδομεν αὐτῷ φυλάττειν τὰς συνθήκας, προστάξαντες αὐτῷ, ἐὰν μὲν διαλλαγῶμεν πρὸς ἡμᾶς αὐτούς, κατακαῦσαι τὸ γραμματεῖον, εἰ δὲ μή, Σατύρω ἀποδοῦναι. §21τὰ μὲν οὖν ἡμέτερʼ, ὦ ἄνδρες δικασταί, οὕτω διεπέπρακτο·
But if he should not do these things, he submitted to Satyrus an arbitration on specified terms, on the condition that he should condemn him to pay one and a half times the money. Having written down these terms and taken Pyron, a man of Pherae who was accustomed to sailing into the Pontus, up to the Acropolis, we gave him the agreement to guard, instructing him that if we reconciled with each other, he should burn the document, but if not, he should hand it over to Satyrus. Now our affairs, gentlemen of the jury, had been settled in this way.
Μενέξενος δʼ ὀργιζόμενος ὑπὲρ τῆς αἰτίας ἧς κἀκεῖνον Πασίων ᾐτιάσατο, λαχὼν δίκην ἐξῄτει τὸν Κίττον, ἀξιῶν τὴν αὐτὴν Πασίωνι ψευδομένῳ γίγνεσθαι ζημίαν ἧσπερ ἂν αὐτὸς ἐτύγχανεν, εἴ τι τούτων ἐφαίνετο ποιήσας.
But Menexenus, being angry on account of the charge which Pasion had also accused him of, brought a suit and demanded the return of Cittus, claiming that the same penalty should befall Pasion for lying as he himself would have suffered if he was shown to have done any of these things.
καὶ οὗτος, ὦ ἄνδρες δικασταί, ἐδεῖτο μου ἀπαλλάττειν Μενέξενον, λέγων ὅτι οὐδὲν αὐτῷ πλέον ἔσται, εἰ τὰ μὲν χρήματʼ ἐκ τῶν συγγεγραμμένων εἰς τὸν Πόντον εἰσπλεύσας ἀποδώσει, αὐτὸς δʼ ὁμοίως ἐνθάδε καταγέλαστος ἔσοιτο· ὁ γὰρ παῖς, ἐὰν βασανίζηται,, περὶ πάντων τἀληθῆ κατεπεῖ. §22ἐγὼ δʼ ἠξίουν πρὸς μὲν Μενέξενον πράττειν ὅ τι βούλοιτο, πρὸς δʼ ἐμὲ ποιεῖν αὐτὸν τὰ συγκείμενα.
And this man, gentlemen of the jury, begged me to reconcile Menexenus, saying that it would be of no advantage to him if he should sail to the Pontus and repay the money according to the agreement, but should still be a laughing-stock here; for the slave, if he should be tortured, would confess the truth about everything. I, for my part, demanded that with respect to Menexenus he should do whatever he wished, but with respect to me, he should perform what had been agreed.
ἐν ἐκείνῳ μὲν οὖν τῷ χρόνῳ ταπεινὸς ἦν, οὐκ ἔχων ὅ τι χρήσαιτο τοῖς αὑτοῦ κακοῖς.
At that time, therefore, he was humbled, not knowing how to deal with his own troubles.
καὶ γὰρ οὐ μόνον περὶ τῆς βασάνου καὶ τῆς δίκης ἐκείνης ἐδεδοίκει τῆς εἰληγμένης, ἀλλὰ καὶ περὶ τοῦ γραμματείου, ὅπως μὴ ὑπὸ τοῦ Μενεξένου συλληφθήσοιτο. §23ἀπορῶν δὲ καὶ οὐδεμίαν ἄλλην εὑρίσκων ἀπαλλαγήν, πείσας τοῦ ξένου τοὺς παῖδας διαφθείρει τὸ γραμματεῖον, ὃ ἔδει Σάτυρον λαβεῖν, εἰ μή μʼ ἀπαλλάξειεν οὗτος.
For he was afraid not only of the torture and that suit which had been brought, but also concerning the document, lest it should be seized by Menexenus. Being in despair and finding no other way of escape, he persuaded the slaves of the host and tampered with the document, which Satyrus was to receive if this man did not settle with me.
καὶ οὐκ ἔφθη διαπραξάμενος ταῦτα καὶ θρασύτατος ἁπάντων ἀνθρώπων ἐγένετο, καὶ οὔτʼ εἰς τὸν Πόντον ἔφη μοι συμπλευσεῖσθαι οὔτʼ εἶναι πρός ἔμʼ αὐτῷ συμβόλαιον οὐδέν, ἀνοίγειν τʼ ἐκέλευε τὸ γραμματεῖον ἐναντιόν μαρτύρων.
No sooner had he accomplished this than he became the boldest of all men, and claimed that he would neither sail with me to the Pontus nor that there was any contract between him and me, and he demanded that the document be opened in the presence of witnesses.
τί ἂν ὑμῖν τὰ πολλὰ λέγοιμι, ὦ ἄνδρες δικασταί;
Why should I tell you many things, gentlemen of the jury?
εὑρέθη γάρ ἐν τὦ γραμματείῳ γεγραμμένος ἀφειμένος ἁπάντων τῶν ἐγκλημάτων ὑπʼ ἐμοῦ.
For in the document he was found written as having been released from all charges by me.
