[울피아누스, 고시 주석 제25권] 만일 토지의 매도인이 자신과 그 후손이 그곳에 인도되도록 하기 위하여 묘지 장소를 제외하였는데, 자신의 망자를 인도하기 위해 도로를 사용하는 것이 금지된다면, 소를 제기할 수 있다. 왜냐하면 매장하기 위하여 그가 토지를 통행하는 것이 허용된다는 점 또한 매수인과 매도인 사이에 제외된 것으로 인정되기 때문이다.
