[ULPIANUS libro septimo decimo ad Sabinum.] If the owner of a bare property has bequeathed a usufruct, it is correct, as Maecianus wrote in the third book of his Questions on Fideicommissa, that the legacy is valid; and that if by chance, during the lifetime of the testator or before the acceptance of the inheritance, the usufruct should accrue to the property, it belongs to the legatee.
plus admittit Maecianus, etiamsi post aditam hereditatem accessisset usus fructus, utiliter diem cedere et ad legatarium pertinere.
Maecianus goes further and admits that even if the usufruct should accrue after the acceptance of the inheritance, the right is validly established and belongs to the legatee.
