[HERMOGENIANUS, In the First Book of Epitomes.] Of civil duties, some belong to patrimony, others to persons.
§50.4.1.1Patrimonii sunt munera rei uehicularis, item nauicularis: decemprimatus: ab istis enim periculo ipsorum exactiones sollemnium celebrantur.
To patrimony belong the duties of land transport, likewise of water transport; also the decemprimatus (office of the ten foremost); for by them, at their own risk, the collections of regular taxes are carried out.
§50.4.1.2Personalia ciuilia sunt munera defensio ciuitatis, id est ut syndicus fiat: legatio ad census accipiendum uel patrimonium: scribatus: καμηλασία: annonae ac similium cura: praediorumque publicorum: frumenti comparandi: aquae ductus: equorum circensium spectacula: publicae uiae munitiones: arcae frumentariae: calefactiones thermarum: annonae diuisio et quaecumque aliae curae istis sunt similes.
Personal civil duties are the defense of the city (that is, to become a syndic), an embassy for taking the census or managing the public property, the office of scribe, camel transport, the care of the grain supply and similar matters, the management of public estates, the procurement of grain, the maintenance of aqueducts, the games of circus horses, the construction of public roads, the grain treasury, the heating of public baths, the distribution of the grain supply, and whatever other tasks are similar to these.
ex his enim, quae rettulimus, cetera etiam per leges cuiusque ciuitatis ex consuetudine longa intellegi potuerunt.
For from these which we have mentioned, the rest also can be understood through the laws of each city based on long custom.
§50.4.1.3Illud tenendum est generaliter personale quidem munus esse, quod corporibus labore cum sollicitudine animi ac uigilantia sollemniter extitit, patrimonii uero, in quo sumptus maxime postulatur.
It must be held generally that a duty is personal indeed which is regularly performed by bodily labor along with anxiety of mind and vigilance, but belongs to patrimony in which expense is chiefly demanded.
§50.4.1.4Aeque personale munus est tutela, cura adulti furiosiue, item prodigi, muti, etiam uentris, etiam ad exhibendum cibum potum tectum et similia.
Equally is guardianship a personal duty, as is the curatorship of an adult or a madman, likewise of a spendthrift, of a mute, even of an unborn child, and also [a curatorship] for providing food, drink, shelter, and the like.
sed et in bonis, cuius officio usucapiones interpellantur ac, ne debitores liberentur, prouidetur: item ex Carboniano edicto bonorum possessione petita, si satis non detur, custodiendis bonis curator datus personali fungitur munere.
But also [the curator appointed] over property, by whose duty usucapions are interrupted and care is taken lest debtors be released, [performs a personal duty]; likewise, when possession of property is sought under the Carbonian Edict and security is not given, a curator appointed to guard the property performs a personal duty.
his similes sunt bonis dati curatores, quae fuerunt eius, qui ab hostibus captus est et reuerti speratur: item custodiendis ab eo relictis, cui necdum quisquam ciuili uel honorario iure successit, curatores constituti.
Similar to these are the curators appointed for properties which belonged to one who was captured by enemies and is expected to return; likewise, curators appointed for guarding the things left by one to whom no one has yet succeeded by civil or honorary law.
