[POMPONIUS, in his sixth book on Sabinus.] With respect to those legacies which, upon our death, pass to our heir, we acquire their benefit through ourselves, in the same case, for those in whose power we are; which is otherwise than what we have stipulated.
nam et sub condicione stipulantes omnimodo eis adquirimus, etiamsi liberatis nobis potestate domini condicio existat.
For even when stipulating under a condition, we acquire for them in every way, even if the condition should be fulfilled after we have been released from the power of the master.
