[PAULUS on Sabinus, book 9] Labeo says that if trees have been stealthily cut down, an action is to be granted both under the Lex Aquilia and under the Twelve Tables; but Trebatius thinks that both are to be granted in such a way that the judge in the subsequent action deducts what was obtained from the first, and condemns for the remainder.
