1. §46.8.11.pruel paciscitur uel quodlibet aliud nomine absentis gerit — This clause semantically continues the conditional clause (si...) from the preceding fragment (§46.8.10.pr). While the preceding verbs were in the present subjunctive (uendat, locet), the verbs here change to the present indicative (paciscitur, gerit). This grammatical shift is a result of the compilers of the Digest combining fragments from different authors. The subject remains the procurator (agent) implied from the previous context.
2. §46.8.11.prnomine absentis — Meaning "in the name of the absent person." The word absentis is the genitive singular of the present participle absens used substantively, referring to the principal represented by the agent. nomine is an ablative of respect or manner.
