[ULPIANUS libro septuagensimo septimo ad edictum. ] §46.7.3.prSi quis apud aliquem iudicem iturus stipulatus est iudicatum solui et agit apud alterum, non committitur stipulatio, quia non huius iudicis sententiae fideiussores se subdiderunt. §46.7.3.1Stipulationem iudicatum solui et procurator et tutor et curator stipulari possunt. §46.7.3.2Procuratorem eum accipere debemus, cui mandatum est, siue huius rei tantum mandatum susceperit siue etiam uniuersorum bonorum.
[ULPIANUS, On the Edict, Book LXXVII] anyone, being about to appear before a certain judge, has stipulated for the payment of the judgment, and brings his action before another, the stipulation is not committed, because the sureties did not subject themselves to the decision of this latter judge. a procurator, a tutor, and a curator can stipulate for the payment of the judgment. must regard him as a procurator who has received a mandate, whether he has undertaken a mandate for this matter only, or even for his entire property.
sed et si ratum fuerit habitum, procurator uidetur. §46.7.3.3Sed et si forte ex liberis uel parentibus aliquis interueniat uel uir uxoris nomine, a quibus mandatum non exigitur, an committatur stipulatio, quaeritur: magisque erit, ne committi debeat, nisi fuerit ei mandatum uel ratum habitum: quod enim eis agere permittitur edicto praetoris, non facit eos procuratores.
But also if it has been ratified, he is regarded as a procurator. also if, perhaps, one of the children or parents should intervene, or a husband in the name of his wife, from whom a mandate is not required, it is asked whether the stipulation is committed. And the better opinion is that it should not be committed unless there has been a mandate or a ratification; for the fact that they are permitted to act by the Edict of the Praetor does not make them procurators.

Therefore, if such a person intervenes, security must be provided anew. also what we have said about a tutor must be understood in this sense: that if he was one who was administering the tutelage, although he was not a tutor, he is not included under the designation of tutor. also, even if he is indeed a tutor, yet he is not administering the affairs as a tutor (either while being ignorant of it or for some other reason), it must be said that the stipulation is not committed; for by the Edict of the Praetor, the power to act is given to that tutor to whom the tutelage has been entrusted by a parent, or by the majority of the tutors, or by him who had the jurisdiction. also we shall accept the curator of a madman or a madwoman, likewise of a male or female ward, and also the curators of others, for instance, of a youth; or if he is the curator of anyone else, I think the stipulation is committed. a person is proposed as tutor of some region, or of a province, or of Italian properties, it will follow that we must say that the stipulation is committed only if they have acted on a cause which belonged to their administration. the defendant, after he has promised the payment of the judgment, should become insane, it is asked whether the stipulation is committed on account of an undefended case; and the better opinion is that it is committed, if no one defends him. stipulation on account of an undefended case is not committed as long as there can appear someone who may defend. there are several sureties, even after joinder of issue has taken place with one of them under the clause on account of an undefended case, the defendant himself can undertake the defense.
