[ULPIANUS libro quinto ad Sabinum. ] §46.2.4.prSi usus fructus debitorem meum delegauero tibi, non nouatur obligatio mea: quamuis exceptione doli uel in factum tutus debeat esse aduersus me is qui delegatus fuerit, et non solum donec manet ei usus fructus cui delegaui, sed etiam post interitum eius: uidebimus quia etiam hoc incommodum sentit, si post mortem meam maneat ei usus fructus.
[ULPIANUS, in the fifth book on Sabinus.] If I delegate my debtor of a usufruct to you, my obligation is not novated; although he who has been delegated ought to be protected against me by an exception of fraud or on the facts, and not only as long as the usufruct remains with him to whom I delegated it, but also after its termination: we shall see whether he also suffers this disadvantage if the usufruct remains with him after my death.
et haec eadem dicenda sunt in qualibet obligatione personae cohaerenti.
And these same things must be said in the case of any obligation closely connected to a person.
