[THE SAME in the thirty-fourth book on Sabinus.] We apply this law, namely, that water can be drawn not only for irrigation, but also for the sake of livestock or amenity.
§43.20.3.1Ex flumine aquam ducere plures possunt, ita tamen, ut uicinis non noceant, uel, si angustus amnis sit, etiam ei, qui in alia ripa sit.
Several persons can draw water from a river, provided, however, that they do not harm their neighbors, or, if the river is narrow, even the person who is on the opposite bank.
§43.20.3.2Si aquam ex flumine publico duxeris et flumen recesserit, non potes subsequi flumen, quia ei loco seruitus imposita non sit, quamuis is locus meus sit.
If you draw water from a public river and the river recedes, you cannot follow the river, because no servitude has been imposed on that place, even though that place is mine.
sed si alluuione paulatim accesserit fundo tuo, subsequi potes, quia locus totus fluminis seruiat ductioni.
But if by alluvion it has gradually acceded to your land, you can follow it, because the entire place of the river serves the drawing of water.
sed si circumfluere coeperit mutato alueo, non potes, quia medius locus non seruiat interruptaque sit seruitus.
But if, by changing its channel, it begins to flow around, you cannot, because the intervening place does not serve, and the servitude is interrupted.
§43.20.3.3Aqua, quae in riuo nascitur, tacite lucri fit ab eo qui ducit.
Water which rises in a channel is tacitly acquired as a gain by the person who draws it.
§43.20.3.4Ductus aquae, cuius origo memoriam excessit, iure constituti loco habetur.
A water conduit whose origin exceeds memory is held in the place of one established by law.
§43.20.3.5Is, qui aquae cottidianae ius habet, uel fistulam in riuo ponere uel aliud quodlibet facere potest, dummodo ne fundum domino aut aquagium riualibus deterius faciat.
He who has the right to daily water can either place a pipe in the channel or do anything else, provided that he does not make the land worse for the owner, or the watercourse worse for his co-users.
§43.20.3.6Si aqua ducatur, supra eam alia aqua per pontem, qui supra riuum factus sit, iure ducitur, dum inferiori riuo non noceatur.
If water is drawn, other water is lawfully drawn above it across a bridge built over the channel, provided that no harm is done to the lower channel.
