[IDEM libro tertio responsorum. ] §42.1.42.prPaulus respondit rescindere quidem sententiam suam praecedentem praetorem non posse, reliqua autem, quae ad consequentiam quidem iam statutorum pertinent, priori tamen sententiae desunt, circa condemnandum reum uel absoluendum debere supplere, scilicet eodem die.
[THE SAME, in the third book of Opinions.] Paulus replied that, while a praetor cannot indeed rescind his own preceding judgment, he ought to supply the remaining matters—which indeed pertain to the consequence of what has already been determined, but are lacking in the prior judgment—concerning the condemnation or acquittal of the defendant, that is to say, on the same day.
