[PAPINIANUS, Opinions, Book XI.] A father gave certain things to his marrying daughter in addition to her dowry, and retained her in his family, and appointed her as a co-heir to her brothers under the condition that she should collate the dowry and the other things which he had delivered to her upon her marriage.
cum filia se bonis abstinuisset, fratribus res non in dotem datas uindicantibus exceptionem doli placuit obstare, quoniam pater filiam alterutrum habere uoluit.
When the daughter had abstained from the estate, it was held that the plea of fraud stood in the way of her brothers when they claimed the things which had not been given as dowry, because the father wished his daughter to have either one or the other.
