[ULPIANUS libro quadragensimo ad edictum. ] §37.7.1.prQuamquam ita demum ad collationem dotis praetor cogat filiam, si petat bonorum possessionem, attamen etsi non petat, conferre debebit, si modo se bonis paternis misceat.
[ULPIANUS, from the fortieth book on the Edict.] Although the praetor compels a daughter to make contribution of her dowry only if she petitions for the possession of the goods, yet even if she does not petition, she will have to make contribution, provided that she meddles with her father’s goods.
et hoc diuus Pius Ulpio Adriano rescripsit etiam eam, quae non petierit bonorum possessionem, ad collationem dotis per arbitrum familiae herciscundae posse compelli.
And the deified Pius replied by rescript to Ulpius Adrianus that even she who has not petitioned for the possession of goods can be compelled to make contribution of her dowry through the arbiter of the partition of inheritance.
§37.7.1.1Si in stipulatum deducta sit dos, si quidem ipsa mulier stipulata sit uel ipsi negotium gestum, aeque conferre cogetur: si uero alii quaesita est stipulatio, dicendum est cessare collationem.
If the dowry has been brought into a stipulation, if indeed the woman herself made the stipulation or business was transacted for her, she will equally be compelled to make contribution; but if the stipulation was acquired for another, it must be said that the contribution ceases.
etsi tantum promissa sit dos, collatio eius fiet.
Even if the dowry has only been promised, its contribution shall be made.
§37.7.1.2Si sit nepos et neptis ex eodem filio et dotata sit neptis, sit et filius non pater eorum: neptis omnem dotem soli fratri collatura est.
If there is a grandson and a granddaughter from the same son, and the granddaughter has been endowed, and there is also a son who is not their father, the granddaughter is to contribute her entire dowry to her brother alone.
emancipata autem neptis dotem et bona sua soli nepoti, non etiam patruo conferet.
Moreover, an emancipated granddaughter shall contribute her dowry and her own goods to the grandson alone, and not also to the uncle.
§37.7.1.3Sed si sit neptis sola, non etiam nepos ex eodem, tunc confertur patruo itemque nepoti uel nepti ex alio.
But if there is only a granddaughter, and not also a grandson from the same son, then it is contributed to the uncle and likewise to a grandson or granddaughter from another son.
§37.7.1.4Sed et si duae neptes sint ex diuersis filiis, conferent et inuicem et patruo, si ex eodem patre, tantum inuicem conferent.
But also, if there are two granddaughters from different sons, they shall make contribution both to each other and to the uncle; if from the same father, they shall make contribution only to each other.
§37.7.1.5Cum dos confertur, impensarum necessariarum fit detractio, ceterarum non.
When a dowry is contributed, deduction is made of necessary expenses, but not of others.
§37.7.1.6Quod si iam factum diuortium est et maritus non sit soluendo, non debebit integra dos computari mulieri, sed id quod ad mulierem potest peruenire, hoc est quod facere maritus potest.
But if a divorce has already taken place and the husband is not solvent, the entire dowry ought not to be computed to the woman, but only what can reach the woman, that is, what the husband is able to pay.
§37.7.1.7Si sub condicione pater uel extraneus dotem promiserit, cautione opus erit, ut tunc conferat mulier dotem, cum dotata esse coeperit.
If a father or a stranger has promised a dowry under a condition, security will be required to the effect that the woman shall contribute the dowry at that time when she begins to be endowed.
§37.7.1.8Filiam, quae ab intestato patri heres sit, conferre quidem dotem oportet: consequens autem est, ut ex pollicitatione dotis pro parte dimidia fratrem suum liberet: aequius enim est in solidum de suo eam dotatam esse.
A daughter who is intestate heir to her father ought indeed to contribute her dowry; but it follows that she should release her brother for a half share from the promise of the dowry; for it is more equitable that she should be endowed entirely from her own share.
§37.7.1.9Si emancipatus filius, qui contra tabulas bonorum possessionem accepit, filiam dotatam habeat, non debet dotem eius conferre, quia in bonis eius non est.
If an emancipated son, who has received possession of goods contrary to the will, has an endowed daughter, he does not have to contribute her dowry, because it is not among his assets.
