[HERMOGENIANUS in the third book of the Epitomes of Law.] A person disinherited under a condition shall petition for the possession of goods contrary to the provisions of the will, although a person instituted as heir under a condition is excluded from the possession of goods contrary to the provisions of the will; for children ought to be removed from the succession of their parents by a certain judgment.
§37.4.18.1Ei, qui contra tabulas bonorum possessionem accepit, tam legati quam fideicommissi exactio, sed et mortis causa donationis retentio denegatur: nec interest, per semet ipsos an per alium quaeratur.
To him who has received the possession of goods contrary to the provisions of the will, the collection of a legacy as well as of a fideicommissum, and also the retention of a donation mortis causa is denied; nor does it matter whether it is acquired by themselves or through another.
