[JULIANUS, thirty-fifth book of the Digest.] When a legacy is left in this way: 'Let my heir give Stichus or whatever shall be born of Pamphila', the right to this legacy does not vest until either something has been born of Pamphila or it has become certain that nothing can be born.
§36.2.16.1Cum seruo legato, antequam hereditas eius qui legauerat adiretur, usus fructus ab alio legatus fuerit et prior hereditas eius, qui usum fructum legauerit, adita fuerit: nulla ratio est, cur diem legati cedere existimemus, antequam ea quoque hereditas, ex qua seruus legatus erat, adeatur, cum neque in praesentia ullum emolumentum hereditati adquiratur et, si interim seruus mortuus fuerit, legatum extinguatur.
When a usufruct is bequeathed by someone else to a slave who has been bequeathed, before the inheritance of the person who bequeathed the slave is entered upon, and the inheritance of the person who bequeathed the usufruct is entered upon first: there is no reason why we should think that the right to the legacy vests before that inheritance, from which the slave was bequeathed, is also entered upon, since in the meantime no benefit is acquired for the inheritance and, if the slave should die in the interim, the legacy would be extinguished.
quare adita hereditate existimandum est usum fructum ad eum, cuius seruus legatus esset, pertinere.
Therefore, when that inheritance is entered upon, it must be considered that the usufruct belongs to the person to whom the slave had been bequeathed.
§36.2.16.2Quod si seruus, cui usus fructus legatus fuerit, ipse legatus non fuerit, dicendum est usum fructum ad hereditatem pertinere, eo quod dies eius ante aditam hereditatem non cesserit.
But if the slave, to whom the usufruct was bequeathed, was not himself bequeathed, it must be said that the usufruct belongs to the inheritance, for the reason that the right to it did not vest before the inheritance was entered upon.
