[ULPIANUS from the fourth book on Trusts.] However, not only those present but also those absent can refuse, or even by letter: for a decree is demanded even against those who are absent, whether their intention of refusing to enter upon and restore the inheritance is certain or uncertain: so much so that their presence is not necessary.
§36.1.6.1Meminisse autem oportebit de herede instituto senatum loqui: ideoque tractatum est apud Iulianum, ad intestatos locum habeat.

§36.1.6.3Si fisco uacantia bona deferantur nec uelit bona adgnoscere et fideicommissario restituere, aequissimum erit, quasi uindicauerit, sic fiscum restitutionem facere.
