[IDEM libro tertio decimo digestorum.
[The same, from the thirteenth book of digests.] A case is found in which the heir can bring an action, although the testator could not have brought an action: as, for example, if a tutor, when paying legacies, did not interpose a stipulation that whatever was paid in excess of what was allowed to be taken under the Falcidian law should be returned: indeed, the pupil does not bring an action under that head of guardianship, but the tutor will be liable to his heir under this head as well.
