[POMPONIUS in the third book on Sabinus.] If a legacy is left to those to whom a patron pays legacies, the praetor ought to temper the condition, so that [the payments] for the sake of fulfilling the condition may be given to both the patron and the appointed heirs in proportion.
If it is written as follows: 'if within the next five years a son is not born to Titius, then let the heir give ten to Seia,' and if Titius dies before that time, the ten is not immediately owed to Seia, because this word 'then' (tum) signifies the time of the end of the five-year period.
