[POMPONIUS in the fifth book of Epistles.] If an heir, while a condition is pending, has legacyed to another a tract of land which was legacyed under a condition by the testator, after the fulfillment of the condition which had been attached to the first will, the ownership does not depart from the first legatee, nor can the heir make a religious place in that land or impose a servitude; but even an imposed servitude will be terminated upon the fulfillment of the condition.
