[PAPINIANUS, in the fifteenth book of Questions.] An heir who has lent a tacit support contrary to the laws does not use the Falcidian law in that part in which he employed fraud; and the senate so decreed.
sed si maior modus institutionis quam fraudis fuerit, quod ad Falcidiam attinet, de superfluo quarta retinebitur.
But if the measure of the institution is greater than that of the fraud, so far as concerns the Falcidian law, a fourth part will be retained from the surplus.
