[PAULUS libro duodecimo quaestionum. ] §34.8.5.prQuod quis sibi adscripserit, si alii restituere a testatore iussus est, cum onere fideicommissum id apud heredem remanet, quamuis pro non scripto esset.
[PAULUS in the twelfth book of Questions.] What someone has written down for himself, if he was ordered by the testator to restore it to another, remains with the heir as a fideicommissum with its burden, although it would be held as not written.
idem est et in testamento militis.
The same is true also in the testament of a soldier.
