[POMPONIUS in the sixth book on Sabinus.] Celsus thinks that an heir who is directed not to claim from a surety can claim from the principal debtor, but that one who is forbidden to claim from the principal debtor, if he should claim from the surety, is liable to the principal debtor under the will.
§34.3.2.1Idem Celsus ait nullam dubitationem habere, quin herede petere a debitore uetito nec heres heredis petere possit.
The same Celsus says that there is no doubt that when the heir is forbidden to claim from the debtor, the heir of the heir also cannot claim.
