[MARCELLUS libro singulari responsorum.
[MARCELLUS, in his single book of Responses.] Seia bequeathed as follows, charging her heir Publius Maeuius: "I bequeath to Antonia Tertulla so many pounds of gold and a pearl with hyacinths." Afterwards she dissolved the pearl from its setting and at the time of her death left no pearl among her ornaments.
I ask whether the heir is obliged under the trust to pay the value of the thing which is not in the inheritance.
Marcellus respondit non debere.
Marcellus replied that he is not obliged.
I also ask: if it can be proved that Seia converted certain pearls and hyacinths into another form of ornament, which she later made more precious by adding other gems and pearls, whether these pearls or hyacinths can be claimed, and whether the heir can be compelled to remove them from the later ornament and deliver them.
Marcellus replied that they cannot be claimed; for how is it possible for a legacy or trust to be considered to continue, when that which was given by the will has not remained in its own form, but has in a manner perished? To pass over for the moment that by such dissolution and alteration the testator's will also seems to have been changed.
§34.2.6.2Lucius Titius testamento scripsit: 'heredem meum uolo fideique eius committo, ut in patriam meam faciat porticum publicam, in qua poni uolo imagines argenteas, item marmoreas': quaero, an legatum ualeat.
Lucius Titius wrote in his will: "I wish my heir, and I commit to his good faith, to construct a public portico in my homeland, in which I wish silver and also marble statues to be placed." I ask whether the legacy is valid.
Marcellus replied that it is valid, and that the legacy of the work and of the other things which the testator wished to be placed there is understood to belong to the homeland; for some ornament could indeed be added to the city.
