[SCAEUOLA libro quarto responsorum.
[SCAEUOLA, in the fourth book of Opinions.] A testator bequeathed three hundred aurei to Gaius Seius, so that from the interest on that sum he might provide the food and clothing for the freedmen which he had determined; but in a codicil he forbade the same sum to be given to Gaius Seius, and wished it to be given to Publius Maeuius. I ask whether Maeuius owes the trust to the freedmen.
respondi Maeuium, nisi aliud, de quo non deliberaretur, doceat sibi a testatore iniunctum, uideri secundum uoluntatem testatoris recepisse ea onera, quae adscripta erant ei summae, quae in eum codicillis transferebatur.
I replied that Maeuius, unless he should prove that something else, which is not under consideration, was enjoined upon him by the testator, appears, in accordance with the will of the testator, to have accepted those burdens which were attached to the sum that was transferred to him by the codicil.
§34.1.13.1Imperator Antoninus Pius libertis Sextiae Basiliae. 'Quamuis uerba testamenti ita se habeant, ut, quoad cum Claudio Iusto morati essetis, alimenta et uestiarium legata sint, tamen hanc fuisse defunctae cogitationem interpretor, ut et post mortem Iusti eadem uobis praestari uoluerit'. respondit eiusmodi scripturam ita accipi, ut necessitas alimentis praestandis perpetuo maneat.
The Emperor Antoninus Pius to the freedmen of Sextia Basilia: "Although the words of the will are such that the maintenance and clothing were bequeathed to you so long as you should remain with Claudius Justus, nevertheless I interpret the intention of the deceased to have been that she wished the same to be provided to you even after the death of Justus." It was replied that a writing of this kind is to be understood in such a way that the obligation to provide maintenance remains perpetually.
§34.1.13.2Item consultus de tali scriptura et tecum sint semper uolo': quaero, cum manumissi ab herede cum eo morati diu sint, sed ob grauiorem seruitutem ab eo discesserint, an alimenta his debeantur, quae negat se praestare, nisi uice seruitutis is uteretur.
Likewise, being consulted concerning such a writing: "and I wish them to be always with you": I ask, when those manumitted by the heir have remained with him for a long time, but have departed from him on account of too harsh a servitude, whether maintenance is owed to them, which he refuses to provide unless he may employ them in place of slaves.
respondit secundum ea quae proponerentur deberi.
He replied that according to the facts presented, it is owed.
