[PAPINIANUS libro septimo responsorum. ] §33.1.9.prFundus, quem pater familias libertis legatorum nomine, quae in annos singulos relinquit, pignus esse uoluit, ex causa fideicommissi rei seruandae gratia recte petetur.
[PAPINIANUS, book seven of Opinions.] A tract of land, which the paterfamilias intended to be a pledge for his freedmen under the title of the legacies which he leaves year by year, will be rightfully claimed on the ground of a fideicommissum for the purpose of preserving the property.
PAULUS notat: hoc admittendum est et in aliis rebus hereditariis, ut et in eas legatarius mittatur.
PAULUS notes: This must also be admitted in the case of other hereditary property, so that the legatee may also be put in possession of them.
