[PAULUS, from his thirteenth book of Responses.] 'If my daughters Maevia and Negidia shall be my heirs, then Maevia shall take from the common estate, preceive, and have for herself my estate that and that, with the cottages and keepers of all these estates, and with all these fields which have accrued to the connection of each of these estates by purchase or by any other event, likewise with all slaves, cattle, beasts of burden, and all other kinds of things which shall be on the same estates or any of them when I die, just as they are in the best and greatest condition, and just as I possessed them up to the day of my death, and, to speak more fully, just as they are enclosed.' Now, on one of these estates which were bequeathed by preception, there is a registry, in which there are purchase documents of several slaves, and also documents of estates and of various contracts, and besides, the names of debtors: I ask whether the documents are common.
respondi secundum ea quae proponuntur instrumenta emptionum, item debitorum, quae in fundo praelegato remanserunt, non uideri legato contineri.
I responded that according to the facts proposed, the purchase documents, likewise those of debts, which remained on the estate bequeathed by preception, do not seem to be included in the bequest.
§32.0.92.1His uerbis domibus legatis: 'fidei heredum meorum committo, uti sinant eum habere domus meas, in quibus habito, nullo omnino excepto cum omni instrumento et repositis omnibus' non uideri testatorem de pecunia numerata aut instrumentis debitorum sensisse.
Where houses are bequeathed in these words: 'I commit to the trust of my heirs that they permit him to have my houses in which I dwell, with absolutely no exception, with all equipment and all things stored away,' it does not seem that the testator had in mind ready money or documents of debts.
