[POMPONIUS libro tertio ad Sabinum. ] §28.5.27.prSi te solum ex parte dimidia pure, ex altera sub condicione heredem instituero et substituero tibi, non existente condicione substitutum ex ea parte heredem fore Celsus ait:
[POMPONIUS libro tertio ad Sabinum.] If I designate you alone as heir unconditionally for a half share, and under a condition for the other half, and I substitute an heir to you, Celsus says that if the condition is not fulfilled, the substitute will be heir for that share.
§28.5.27.1Sed si te heredem instituero et deinde eundem te sub condicione instituam, nihil ualere sequentem institutionem, quia satis plena prior fuisset.
But if I designate you as heir, and then designate the same you under a condition, the subsequent designation has no validity, because the prior one was already sufficiently complete.
§28.5.27.2Sed si plures institutiones ex eadem parte sub diuersis condicionibus fuerint factae, utra prior condicio exstiterit, id faciet quod supra diximus, si pure et sub condicione idem instituatur.
But if multiple designations are made for the same share under different conditions, whichever condition is fulfilled first will produce the same result as we said above in the case where the same person is designated unconditionally and under a condition.
