[JULIANUS, in the twenty-first book of the Digests.] By the advice and assistance of the curator, not only the patrimony but also the body and safety of the madman must be protected.
§27.10.7.1Curator dementi datus decreto interposito, uti satisdaret, non cauit et tamen quasdam res de bonis eius legitimo modo alienauit.
A curator appointed for a demented person did not provide security, despite a decree having been interposed that he should provide security, and yet he alienated certain things from his goods in a lawful manner.
si heredes dementis easdem res uindicent, quas curator alienauit, et exceptio opponetur 'si non curator uendiderit', replicatio dari debet 'aut si satisdatione interposita secundum decretum uendiderit'.
If the heirs of the demented person should claim the same things that the curator alienated, and the exception is opposed "unless the curator sold them", a replication must be given "or if he did not sell them after security had been provided in accordance with the decree".

But if, having received the price, the curator discharged the creditors of the madman, a triplication of fraud will render the possessors secure.
§27.10.7.2Cum dementis curatorem, quia satis non dederat et res male administraret, proconsul remouerit a bonis aliumque loco eius substituerit curatorem, et hic posterior, cum nec ipse satisdedisset, egerit cum remoto negotiorum gestorum, posteaque heredes dementis cum eodem negotiorum gestorum agant et is exceptione rei iudicatae inter se et curatorem utatur: heredibus replicatio danda erit: 'aut si is qui egit satisdederat'.
When the proconsul removed the curator of a demented person from the goods because he had not provided security and was mismanaging the affairs, and substituted another curator in his place, and this latter one, though he himself had not provided security either, sued the removed curator on account of unauthorized agency, and afterwards the heirs of the demented person sue the same removed curator on account of unauthorized agency, and the latter uses the exception of res judicata between himself and the second curator: a replication must be given to the heirs: "or if he who sued had not provided security".

But the judge will estimate whether the replication should benefit the curator: for if the subsequent curator had turned the money, which he had obtained from the condemnation, to the benefit of the madman, a triplication of fraud will stand in the way.
§27.10.7.3Quaesitum est, an alteri ex curatoribus furiosi recte soluetur uel an unus rem furiosi alienare possit.

Also, that he who lawfully purchased a tract of land of the madman from one of the curators would acquire it by usucapion, because payment, sale, and delivery are matters of fact rather than of law, and therefore the person of one of the curators is sufficient, because the other is understood to consent: finally, if he is present and forbids payment to be made, or forbids the property to be sold or delivered, neither will the debtor be discharged, nor will the buyer acquire it by usucapion.
