[ULPIANUS libro primo opinionum. ] §26.9.2.prSi tutor uel curator pecunia eius, cuius negotia administrat, mutua data ipse stipulatus fuerit uel praedia in nomen suum emerit, utilis actio ei, cuius pecunia fuit, datur ad rem uindicandam uel mutuam pecuniam exigendam.
[ULPIANUS, in the first book of Opinions.] If a tutor or a curator, having lent money belonging to the person whose affairs he administers, has personally stipulated for its return, or has purchased estates in his own name, an equitable action is granted to the person to whom the money belonged, either for the purpose of claiming the property or for demanding the loan.
