[IDEM libro sexto ad edictum. ] §26.8.17.prSi tutor pupillo nolit auctor fieri, non debet eum praetor cogere, primum quia iniquum est, etiamsi non expedit pupillo, auctoritatem eum praestare, deinde etsi expedit, tutelae iudicio pupillus hanc iacturam consequitur.
[THE SAME, in the sixth book on the Edict.] If a tutor is unwilling to become an authorizer for the pupil, the praetor ought not to compel him; first, because it is unjust, even if it is not advantageous to the pupil, for him to provide authorization; secondly, because even if it is advantageous, the pupil recovers this loss through the action on guardianship.
