[IDEM libro tertio decimo quaestionum. ] §26.7.44.prQui nominibus a curatoribus prioribus susceptis siue tutoribus nomina adgnouerunt, periculum in se transferunt.
[THE SAME, from the thirteenth book of Questions.] Those who have acknowledged debts that were taken over by previous curators or tutors transfer the risk to themselves.
§26.7.44.1Sed si pupillus post pubertatem rationibus a tutore acceptis reliquationem eius secutus usuras acceptauerit, priuilegium suum non amittit in bonis tutoris uenditis: praetor enim priuilegium ei seruare debet.
But if the pupil, after reaching puberty, having accepted the accounts from the tutor and followed his balance, has accepted interest, he does not lose his privilege in the sale of the tutor's property; for the praetor ought to preserve his privilege for him.
